on the scope and method of ensuring the separate concentration of municipal waste components
According to § 17 (3) of Act No. 185 / 2001 Coll., on waste and amending certain other laws, as amended by Act No. 229 / 2014 Coll.:
§ 1
Method of ensuring separate concentration of municipal waste components
Separate concentration of municipal waste components may be carried out by the municipality through:
(a) collection yards;
(b) installations under Section 14 (1) of the Act and, in the case of biodegradable municipal waste, also through small installations under Section 33b of the Act;
(c) large containers,
(d) collection vessels,
(e) the bag collection method; or
(f) a combination of the methods referred to in points (a) to (e).
§ 2
Biodegradable municipal waste
(1) The municipality is obliged to provide annual separate concentration sites for at least biological waste of plant origin. In the period from 1 November to 31 March of the following calendar year, the municipality may adapt the frequency of collection to the climatic conditions and the quantity of biological waste produced.
(2) The obligation referred to in paragraph 1 shall also be fulfilled where biological waste of plant origin is concentrated with biological waste of animal origin, taking into account the subsequent recovery method (1).
(3) Biological waste of plant origin means biodegradable municipal waste which does not contain or come into contact with biological waste of animal origin or animal by-products.
(4) Biological waste of animal origin means biodegradable municipal waste which contains or has come into contact with biodegradable waste of animal origin from kitchens and catering plants.
(5) The municipality must ensure conditions for the protection of public health and the environment when concentrating waste, in particular food waste, by means of a system of collection, type of containers and frequency of disposal.
(6) The obligation to provide separate locations for the concentration of biodegradable municipal waste is also fulfilled if the municipality has a Community composting system in place in its territory, to which it is possible to transfer all plant residues from the maintenance of the green and gardens arising in the municipality.
(7) The municipality is obliged to provide annual places for separate concentration of edible oils and fats. Edible oils and fats shall not be concentrated together with other biodegradable wastes. Obligations under this paragraph may not be fulfilled in accordance with the procedure laid down in paragraph 6.
§ 3
Paper, plastics, glass and metals
(1) The municipality is obliged to ensure annual separate concentration of waste paper, plastics, glass and metals.
(2) The obligation referred to in paragraph 1 shall also be fulfilled where, with regard to the system of further disposal, some of the waste is concentrated together, provided that this does not impair the recovery of the waste collected as compared to those which would be concentrated separately.
§ 4
Hazardous municipal waste
The obligation to provide a place for the separate concentration of hazardous waste shall be fulfilled by the municipality by designating a place for the concentration of hazardous waste at the specified dates, but at least twice a year.
§ 5
Efficacy
This Decree shall enter into force on 1 January 2015.
