GOVERNMENT REGULATION
of 29 August 2012
determining the spa site of Karlovy Vary and the spa site status of Karlovy Vary
The government orders pursuant to § 28 (2) of Act No. 164 / 2001 Coll., on Natural Medical Resources, Natural Mineral Water Resources, Natural Spa and Spa Places and on the amendment of certain related laws (Spa Act):
Subject matter
(1) This Regulation provides for a spa site of Karlovy Vary and the Statute of the spa site of Karlovy Vary (hereinafter referred to as the Statute), which provides for a system for the protection of the spa site and conditions for the creation and maintenance of a spa environment and the provision of spa rehabilitation care.
(2) The Statute defines the external and internal territories of the spa site of Karlovy Vary and provides for:
(a) restrictions relating to its construction and development;
(b) activities which are restricted or prohibited at the spa site;
(c) establishments which may not be established therein;
(d) for the internal territory of the spa site, additional restrictions relating to the application of increased requirements for the appearance and layout of public spaces, the establishment, modification, maintenance, cleaning and lighting of public spaces, public greenery, parks and their equipment.
The spa area
(1) The territory of the spa area consists of the cadastral territory of Bohemia, Cihelny, Chankov, Doubí u Karlovy Vary, Dvory, Drahovice, Karlovy Vary, Olšová Vrata, Počerně, Rosnice u Stará Role, Rybář, Sedlec u Karlovy Vary, Stará Role, Tašovice and Tuhnice.
(2) The internal territory of the spa site is defined on the basis of the cadastral map in Annex 1 to this Regulation, the external territory of the spa site covers the rest of the spa area.
(3) The definition of the spa area on the basis of the basic map of the Czech Republic with the distinction of the inner and outer territory of the spa site is graphically indicated in Annex 2 to this Regulation.
Restrictions related to the construction and development of a spa site and facilities which may not be established therein
(1) It is prohibited to place structures, facilities and facilities on the territory of the spa site which would clearly adversely affect the internal territory of the spa site by physical, chemical or biological pollutants above the permissible level laid down by other legislation1).
(2) In the internal territory of the spa site, construction and other development not related to the purposes of the spa, spa and amenities, housing and corresponding transport and technical infrastructure and green protection are prohibited.
(3) In the inner territory of the spa site construction is prohibited, which would not respect preserved urban, architectural and historical values and which would lead to excessive thickening of the building, especially at the expense of the green. In addition, the internal territory of the spa site is prohibited the construction of buildings which would be clearly unbalanced in terms of floor and height of buildings or building elements and which would clearly exceed the existing installation.
(1) In the inner territory of the spa site, the construction of entertainment facilities, parking and garage houses is restricted in order to protect the treatment regime and to preserve or to create a spa environment; such construction may be authorised only after assessment of the suitability of their location.
(2) Construction is prohibited in the internal territory of the spa site
(a) individual and group garages;
(b) agricultural establishments, warehouses, housing in conjunction with the productive use of gardens;
(c) facilities for small-scale production and services which may have disruptive effects on the treatment regime in the natural spa,
(d) industrial, warehouse, building yards and technical equipment and communications maintenance equipment.
(3) In the inner territory of the spa site, the location of the buildings and changes to the buildings and equipment are prohibited.
(a) inducing or causing the transit or accumulation of vehicles to a greater degree than is necessary for the transport operation of the internal territory of the spa site or its relevant drop-off part;
(b) technology involving the handling of substances harmful to the rock environment;
(c) technology exceeding the noise or vibration limits specified by other legislation (m2);
(d) with a technology exceeding the emission limits of pollutants or odoriferous substances discharged into the air under the law governing air protection.
(4) The location and operation of buildings, equipment and activities in the internal territory of the spa site are prohibited, which would reduce the proportion of unpaved areas and reduce the area of parks and green areas.
(5) The construction of new motorways, roads and local roads of Class I and Class II are prohibited in the internal area of the spa.
Activities which are restricted or prohibited in the spa area
(1) It is prohibited to carry out activities and work in the internal territory of the spa site using machinery and equipment exceeding noise or vibration limits 2)
(a) on working days and on Saturdays between 18.00 and 8.00, and
(b) on Sundays and other working days, in accordance with the Act governing public and other holidays.
(2) The implementation of fireworks, fireworks and pyrotechnic articles with sound and light effects for entertainment purposes (3) shall be prohibited in the part of the spa area defined in Annex 3 to this Regulation. The prohibition shall not apply to 31 December and 1 January.
(1) In spa colonnades, in pavilions and in public spaces related to them outside the infrastructure, entry, entry, entry, introduction and postponement and operation of motor and non-motor vehicles and other means of transport, with the exception of wheelchairs, medical aids for disabled persons and baby carriages, are prohibited.
(2) Access to animals is prohibited in spa colonnades, pavilions and public areas related thereto. This prohibition shall not apply to dogs which at the moment serve to accompany persons who are blind or physically disabled, and to dogs of the components of the integrated rescue system and the city police.
(3) Spa colonnades and public spaces related thereto are defined in Annexes 4 and 5 to this Regulation. Spa pavilions are defined in Annexes 6 and 7 to this Regulation.
(4) Spa colonnades, pavilions and public spaces related thereto are identified by an appropriate information board with a inscription or graphic character showing the respective prohibitions figuratively.
In the inner territory of the spa site, the maintenance and cleaning of public spaces during summer and winter periods shall be carried out without the use of defective substances under the Water or Substances Act in easily soluble waters.
(1) In the inner territory of the spa is prohibited in public places
(a) the dissemination of sound advertising by means of transport and off-site and from stationary sources;
(b) the dissemination of illuminated advertising dazzling, flashing and otherwise harassing;
(c) the distribution of advertising leaflets.
(2) It is possible to place posters and leaflets in the inner territory of the spa site only on advertising and promotional facilities and advertising buildings which are located on areas and places designated under the building law.
(3) It is forbidden to feed stray and wild animals in the inner territory of the spa area.
(4) It is prohibited to keep livestock and animals requiring special care in the internal territory of the spa.
Efficacy
This Regulation shall take effect on 1 January 2013.

Internal territory of the spa site Karlovy Vary
The internal territory of the spa site of Karlovy Vary is defined by a border which is situated on the cadastral territory of Karlovy Vary from the northwestern corner of the plot No. (plot No.) 2289 / 1 at the building of the Elizabeth Spa (No. 1145) in Smetana orchards, the Bulgarian street, the overloading class T. G. Masaryk, continues through the streets of Dr. David Becher, King Jiří and Svahová, further along the eastern border of the lot no. 1873 and in the south direction along the nameless road to the western border of the lot No 1792 / 1 and 1806 / 1, where the upper part of the slope is westrohan cross. The border of the inner territory of the spa site continues with the Rohan trail and the nameless path connecting the Rohan and Nerudo path, along which it leads in the southwest direction of 30 m, then the Nerudo trail overloads and continues through plot No 1763 / 1 to the west corner of plot No 1767 and then towards the Owl path. It follows in a southeast direction and then turns southwest towards Rusel's path, which continues to the House of Friendship, where it moves on to the road leading to Rusalka's path. Following Rusalina's foot, the border of the inner area of the spa site continues to the crossroads of Rusalina's path and the Afternoon Path, from where it passes perpendicular to plot 781 / 1 for a length of approx. 9.5 m to the afternoon path, which turns to plot 854 / 3, where the petrol station is on Slovak street. Following the border of the forest, it continues in the northeast direction, where it crosses Slovak street and crosses the Tepla River at the same time, continues on the right bank of the Tepla River, entering the forest path after 180 m, which will result in the Circular road near Beethoven's cottage. After crossing the Circular Road, the border continues along Beethoven's path to the turn on Vítkova Mountain. The road that leads along the blue tourist sign, the border passes to the cadastral territory of Olšová Vrata and is led to the top of Vítkova mountain, where it turns sharply in the eastern direction and along the southern borders of plots No 491 / 5 and No 491 / 1 is led to the road Olšová Vrata - Kol. After that it continues to the southeast part of the parcel No 516 / 1 and leads along the road, on the southwest border of the parcel No 514 / 2 turns north. In this respect, parcels No 514 / 1, 515, the south-west border of parcels No 595 / 1, the south-east border of parcels No 595 / 2 and 596 / 2 continue along the eastern border, mostly along the forest border. Subsequently, the border turns in the east direction and runs along the south and east edges of plot No 596 / 1 to plot No 622 / 1, along which the border leads to the south edge as with plot No 622 / 2, and construction lot No 624. It then crosses the street to the Airport and leads through a path to the observatory, which, at first, is south and then east and north along the southern border of plot No 651, south, east and north of plot No 653. Then continues through the forest path which connects separate parts of Hůrek to Prague Road. It crosses and passes back to the cadastral territory of Karlovy Vary after Gogol's foot and rises to Goeth's glare, circling it from the north, and continues along Gogol's path to the view of Camera Obscura. Furthermore, the border of the inner area of the spa site is guided along the asphalt road towards the cemetery street. Just before the opening, it turns south and then west and passes south of the water works area (plot 3014) and row garages (plot 3000), then enters Cemetery Street. The border also crosses the street on May 5th and the southern edge of Máchov Street leads to Bezručov Street, which it crosses. In the northwest direction it continues along the edge of Bezručová Street and turns south on plot 2781 and 2943. East of Building No. 1321 returns on a pedestrian path to the lower corner of Bezručová Street and further drops to the connecting path between Nezruček Street and I. P. Pavlov Street. After that, the border is in I.P. Pavlova. It continues in the north-west direction of I. P. Pavlova and then crosses the Tepla River on the 17 November bridge, after which it returns to the street of Bulgaria, along the north border of plot 2437 and behind the building of Elizabeth Spa, the border of the inner area of the spa site is closed.
