DECLARATION
of 19 August 2008
amending Decree No. 423 / 2004 Coll., establishing a credit system for the issue of a certificate for the exercise of the profession without direct management or professional supervision of health professionals
According to Section 90 (2) (c) of Act No. 96 / 2004 Coll., on the conditions for obtaining and recognising eligibility for the pursuit of non-medical medical professions and for carrying out activities related to the provision of medical care and amending certain related laws (Law on non-medical health professions):
Decree No 423 / 2004 Coll., establishing a credit system for the issue of a medical certificate without direct management or professional supervision of health professionals, is hereby amended as follows:
1. In Article 1, the words "the acquisition of which is necessary for the issue of a certificate for the exercise of the health profession without direct guidance or professional supervision (2) of a health professional (hereinafter referred to as the certificate) ', including footnote 2, are deleted.
2. Paragraph 2, including the title and footnotes Nos 3 to 7, reads:
Definition of terms
For the purposes of this decree:
(a) credit assessment of individual forms of lifelong education3),
(b) an innovative course of expertise which lasts at least 4 hours on each day of renewal of knowledge and skills and which is organised
1. accredited equipment4) with accreditation for the training programme, obtaining professional, specialised or specific competence for specific activities in which the health professional is to restore knowledge and skills; or
2. health care establishments providing practical training or experience for secondary, higher vocational or higher education institutions in respect of innovative courses for activities which are part of professional competence; or
3. another natural or legal person who has been authorised by the Ministry to do so in respect of an innovative course for theoretical knowledge and skills which are part of the competence;
(c) professional traineeships in accredited equipment4) with accreditation for an educational programme which acquires professional, specialised or specific competence for specific activities in which a health professional is required to develop knowledge and skills in the traineeship aimed at enhancing knowledge at a place of work other than the place of employment under the professional supervision of a healthcare professional who is competent to pursue a medical profession without professional supervision;
(d) a seminar on educational events,
1. which lasts at least 2 hours each day,
2. whose programme relates to the exercise of the relevant medical profession of non-medical health professional; and
3. which is organised by a health-care institution, accredited facilities (4) or by an establishment which has been given a favourable opinion by a professional association and which has a work-related lifelong learning plan,
(e) a training event or a training course;
1. which lasts at least 4 hours on each day,
2. whose programme relates to the exercise of the relevant medical profession of non-medical health professional; and
3. which is organised by accredited equipment4) or an establishment which has obtained a favourable opinion from the professional association at the request of the organiser;
(f) professional conference, congress, convention, working day or symposium of an educational event of a professional nature;
1. which shall last at least 1 day, and the programme of expertise shall be provided at least 4 hours per day;
2. which is secured by at least 4 speakers each day,
3. on which the professional association gives a favourable opinion on classification in the credit system,
4. whose programme concerns the field of activity of an non-medical health professional applying for certification; and
5. which is intended not only for staff of the organization,
(g) by an international congress, an educational event guaranteed by an international organisation;
1. which shall last at least 2 days, the programme of expertise being provided within at least 4 hours of each day;
2. which is secured by at least one foreign speaker in each day,
3. whose programme relates to the exercise of the relevant medical profession of non-medical health professional; and
4. which is intended not only for staff of the organization,
(h) publication of technical material relating to the performance of the relevant medical profession or healthcare;
1. in periodical print5), or in electronic form, having a professional character,
2. in non-periodical publics6), or in electronic form thereof, having a professional character,
3. in the form of specialist monographs, textbooks, scripts or technical interpretations,
4. in the form of an abstract of the expert communication provided in the international magazine opted for; or
5. in the form of a teaching aid; a CD-ROM or a professional background for a lifelong learning action, including an eLearning course, shall be considered as a teaching aid;
the publication activities are not considered to be reviews, the abstract of expert communications other than those referred to in point 4, the discussion contributions and articles of a personal nature,
(i) teaching activities in theoretical or practical training in specialised training, a certified or innovative course, a training event, a seminar, a professional internship or a training course in the study department which is qualified for the medical profession;
(j) scientific and research activities involving participation in research projects and research projects under a specific legislation7), provided that:
1. they are supported by a supported final report, a list of researchers for a research project or research project, basic data of the project theme and, in the case of international projects, copies of the decision of the relevant international institution to approve the project, a list of its researchers and basic data on the project theme; and
2. concerns the field of activity of an unmedical health worker or healthcare generally;
(k) a form of expert communication published on the tables containing comments on topics, tables, photographs,
(l) e-learning course means a form of educational action or teaching aids carried out by a technique enabling remote access;
(m) a standard or a new procedure, the use of which has been approved by the Ministry or by another central administration in the provision of health care;
(n) the registration period for a period of 6 years for which a certificate for the exercise of the profession of health is issued without professional supervision;
o) Impact Factor indicator evaluating the scientific significance of the journal. It expresses the sensitivity of the journal in relation to the total number of published articles and thus its impact (i.e. effect, impact, impact) on the response of other authors. Impact Factor for a given year is the ratio of the sum of the quotes for the two preceding years contained in the articles of this journal in the year for which Impact Factor is ascertained to the number of articles published in these two previous years.

(3) footnotes 8 and 9 are deleted.
4. Article 3, including the title and footnotes No 10 and 11, reads as follows:
Number of credits per form of lifelong learning
(1) For the study of follow-up higher education programmes (10), the field of medical specialisation in higher education (11), the field of medical training in higher education, after being qualified to pursue the non-medical medical profession, post-graduate specialisation studies, special training or a long-term thematic course, 25 credits are allocated for each completed semester or every 6 months of study in the event that the study does not cover semesters.
(2) There are 3 credits for taking part in an innovation course or training event for each starting day, but not more than 12 credits per lifelong learning event. If the innovation course is implemented as an eLearning course, there are 2 credits per course, but not more than 14 credits per registration period.
(3) There are 1 credits for participation in the seminar, but not more than 10 credits per registration period.
(4) There are 3 credits for participating in a vocational internship for each starting day, but not more than 15 credits per internship.
(5) In the case of congressional, professional conference, working day, convention or symposium,
(a) each day of participation of 4 credits, but not more than 12 credits per action;
b) presentation of your own lectures, authorship of the post or active participation in competitions related to the exercise of the medical profession 10 credits,
c) co-authorship at a lecture or presentation of a foreign lecture of 5 credits; and
d) co-authorship on the poster of 4 credits.
(6) In the case of an international congress,
(a) each day of participation of 5 credits but not more than 15 credits per international congress;
b) presentation of your own lecture or authorship of 15 credits,
(c) co-authorship in a lecture or presentation of a foreign lecture of 10 credits; and
d) co-authorship at 5 credits.

5. the following Sections 3a and 3b are inserted after Section 3:
(1) The publication activities include:
(a) as an expert article
1. author of 15 credits,
2. co-author of 10 credits,
a 100% increase for publication in the Impact Factor magazine and a 30% increase for publication in the journal reviewed,
(b) 25 credits to the author of professional publications, textbooks, scripts or other teaching tools (CD-ROM); and
(c) 20 credits to the co-author of professional publications, textbooks, scripts or teaching aids.
(2) There are 2 credits per teaching hour for teaching activities, but not more than 20 credits per registration period.
(3) There are 25 credits for scientific research activities.
(4) 20 credits are included in the methodology.
(1) The number of credits shall be increased by 30% for participation in training actions under Articles 3 (1) to (6) and 3a (1) to (2) which take place in a State other than that in which the health professional is established; The decimal places are always rounded up to integers.
(2) In taking part in training activities under § 2 (1) (d) to (f) which take place in another State, the favourable opinion of the professional association shall not be required. The number of credits shall be determined by the Ministry in the administrative procedure for the certification of the medical profession without professional supervision in accordance with this Decree.
(3) The number of credits for specialist training or certified courses not completed by a health professional shall be determined by the Ministry in the administrative procedure for certification of the medical profession without professional supervision, according to the extent of the completed part and the total amount of credits for the certified course, specialisation training or module.
(4) The number of credits for educational activities abroad corresponding to specialised training or a certified course is determined by the Ministry in the administrative procedure for certification of the medical profession without professional supervision according to the total number of credits allocated to similar training in the Czech Republic.
(5) When combining types of participation in individual forms of lifelong learning, credits shall be added. ';
6. The heading of Section 4 reads: "Evidence of forms of lifelong learning."
7. In Paragraph 4 (1), the words "under § 3 (2) to (4) 'are replaced by the words" under § 3 (2) to (6) and under § 3a (2)'.
8. in Article 4 (2) (b):
"(b) the name of the action and the form of lifelong learning; and"
9. In Article 4 (2) (c), at the end of the text, the words "on a daily basis for multi-day training events, the reference number of the consent opinion issued, including the name of the professional association and the profession for which the consent opinion has been issued 'shall be added.
Transitional provision
Credits belonging to the participation in the educational activities of individual forms of lifelong learning which took place before the date of entry into force of this Order shall be counted against the number laid down in Decree No. 423 / 2004 Coll., as effective by the date of entry into force of this Order. If, according to Decree No. 423 / 2004 Coll., as effective from the date of entry into force of the Order, a higher number of credits than those of the first sentence are to be credited for participation in educational activities of individual forms of lifelong learning.
Efficacy
This decree shall take effect on the day of its publication.
