DECLARATION
of 6 December 2007
amending Decree No 524 / 2006 Coll., on the rules governing the organisation of the gas market and the creation, assignment and use of gas supply type diagrams, as amended by Decree No 184 / 2007 Coll.
According to Article 98 (7) of Act No. 458 / 2000 Coll., on the Terms and Conditions of Business and on the Enforcement of Government Administration in the Energy Sector and on the Amendment of Certain Laws (Energy Act), as amended by Act No. 670 / 2004 Coll., for the implementation of § 17 (7) (e), (h) and (k) of the Energy Act:
Decree No. 524 / 2006 Coll., on the rules for the organisation of the gas market and the creation, assignment and use of gas supply type diagrams, as amended by Decree No. 184 / 2007 Coll., is amended as follows:
1. in Article 7 (1) (a), "30" is replaced by "18" and "20" is replaced by "12."
2. in Article 7 (1) (e):
"(e) the effects of the notification of the allocation of transmission capacities referred to in points (b) and (c) shall cease to exist in the event of non-conclusion of the gas contract on the sixth calendar day following the date of receipt of the notification;"
3. in Article 7 (2) (a), "15" is replaced by "18" and "10" is replaced by "12."
4. in Article 7 (2) (e):
"(e) the effects of the notification of the allocation of transmission capacities referred to in points (b) and (c) shall cease to exist in the event of non-conclusion of the gas contract on the sixth calendar day following the date of receipt of the notification;"
5. In Article 7 (3), at the end of the text in point (a), the words "if the relevant day is the day of work or the day of work, the last previous working day 'shall be added.

Dealing with transport capacity shortages
(1) In the event that all applicants for booking of annual transmission capacity cannot be satisfied, the transmission system operator shall allocate free transmission capacity in proportion to the size of the individual requirements for booking of annual transmission capacity. Where the requirement exceeds free transmission capacity, the transmission system operator shall reduce this requirement to the amount of free transmission capacity before the distribution of free transmission capacity.
(2) Following the allocation of annual transmission capacity, the transmission system operator shall allocate the remaining free transmission capacity in proportion to the size of the individual reserve requirements for monthly transmission capacity. Where the requirement exceeds the remaining free transmission capacity, the transmission system operator shall reduce that requirement to the remaining free transmission capacity before the distribution of the remaining free transmission capacity. ';
7. In Article 9, at the end of paragraph 1, the dot is replaced by a comma and the following points (i) to (k) are added:
"(i) monthly actual income per calendar month for deviations above permitted tolerance over the last 12 months;
(j) monthly actual revenue per calendar month for the missing balancing gas over the last 12 months;
(k) monthly actual expenditure for the calendar month for the remaining balancing gas over the last 12 months. "
8. In Article 10, at the end of paragraph 3, the sentence "For the transfer point of the cross-border pipeline, a gas distribution contract shall be concluded with each user of this point."
9. In Paragraph 11 (1) (c), the word "or 'is deleted.
10. In Article 11 (1), the dot at the end of point (d) is replaced by "or 'and the following point (e) is added:
"(e) a sliding gas distribution contract with fixed capacity; the contract shall be concluded for the number of gas days determined by the number of calendar days of the month in which the gas distribution begins under the contract and shall end on the expiry of the last gas day of the contract. ';
11. in Article 11 (2), the word "Treaty" shall be replaced by the word "Treaty" and after the word "only" the words "for the final customer's sampling site with type A or B measurements shall be inserted."
12. In Paragraph 12, the words "and sliding gas distribution contracts' shall be added at the end of the text of paragraph 1.
13. In Section 12 (2) of the introductory part of the provision, the words "for an annual contract 'are inserted after the words" allocation of distribution capacity'.
14. in Paragraph 12 (2), "20" is replaced by "18" and "16" is replaced by "12."
15. in Article 12 (3), "20" is replaced by "18" and "16" is replaced by "12."
16. In Paragraph 12, the following paragraph 4 is inserted after paragraph 3:
"(4) A request for distribution capacity for a sliding gas distribution contract for each final customer's demand point shall be submitted by the final customer or gas trader only if the final customer or gas trader has another fixed capacity gas distribution contract for the relevant demand point. The maximum capacity required for a sliding gas distribution contract shall not exceed the size of the distribution capacity specified in the connection contract for the relevant demand point of the final customer in the sum of the other allocated distribution capacities. The request for the allocation of distribution capacity for a sliding gas distribution contract shall be evaluated by the distribution system operator no later than 3 working days after receipt of the request and the results of the evaluation of the allocation of distribution capacity shall be notified to the applicant without delay. ';
Paragraph 4 shall become paragraph 5.
17. in Article 13 (2), "13" is replaced by "6."
18. In Paragraph 13 (3), "4 'is replaced by" 3 and 5'.
19. After Paragraph 13, the following Section 13a is inserted:
Gas distribution in test operation
(1) The distribution of gas in test operations is the distribution of gas for the verification of technical parameters, operational values and demonstration of the operational capability of the newly installed or reconstructed gas collection facility of the final customer. The distribution of gas in the test run can only be initiated for a newly connected final customer or for a final customer with a technical nature that has reconstructed the whole or part of the sampling gas facility and the reconstructed gas collection device has more than 30% of the daily maximum gas consumption at the relevant final customer sampling point. The final customer's sampling point with the nature of the technology collection shall be considered to be the final customer's sampling point where less than 50% of the annual gas consumption is used for heating and hot water preparation.
(2) The distribution system operator shall start the distribution of gas in test operations with the final customer, having the nature of the acquisition of the technologist, at the earliest on the date indicated in the application and shall end on the date indicated in the application and at the latest on the last day of the third calendar month following the month in which the distribution of the gas started. In the case of final customers with the characteristics of heating, the distribution system operator shall initiate the distribution of gas in the test run on the date indicated in the application and end on the date indicated in the application but not later than the last day of February. The maximum duration of the gas distribution in test operations for the final customer with the characteristics of heating take-off is 6 calendar months. The final customer's sampling point with the characteristics of the heating process shall be considered to be the final customer's sampling point where 50% or more of the annual gas consumption is used for heating and hot water preparation.
(3) The maximum daily gas consumption at the final customer's sampling point during the distribution of gas in the test run must not exceed the maximum daily distribution capacity for the relevant sampling point agreed in the connection contract.
(4) The request for distribution capacity in the test run shall be submitted by the final customer or gas dealer who has its consent, no later than 18 calendar days and not earlier than 14 calendar months before the start of the gas day of the calendar month when the distribution of gas in the test run is to start. The application shall include a schedule of daily quantities of gas collected during the test run.
(5) In the event that the gas distribution will follow up the distribution of gas in the test run, the final customer or gas trader authorised by the test run may request the allocation of annual or monthly distribution capacity no later than 10 calendar days before the end of the gas distribution in the test run, unless otherwise agreed with the distribution system operator. If the distribution system operator does not enter into a gas distribution contract with the user within 6 calendar days of the end of the gas distribution in test operations, the annual or monthly distribution capacity may not be allocated unless the distribution system operator agrees with the user otherwise. ';
20. in Article 16 (5) (b) and (c):
"(b) a monthly contract for the storage of solid gas; the minimum duration of the contract is 1 gas month and the maximum duration of the contract is 12 gas months,
(c) a daily contract for the storage of solid gas; the minimum duration of the contract is 1 gas day and the maximum duration of the contract is 30 gas days; or ';
Point (c) shall be renumbered (d).
21.
Procedure for reservation of storage capacity
(1) The operator of the underground gas storage tank reserves storage capacities for annual fixed-power gas storage contracts each year from the beginning of the storage year.
(2) The request for the reservation of storage capacity for annual fixed-power gas storage contracts shall be submitted by the user no later than 40 calendar days and no later than 6 calendar months before the start of the storage year from which the reservation is requested by the gas storage operator. The gas storage tank operator shall evaluate the requests received and report the results of the storage capacity reservation to all applicants 30 calendar days before the start of the storage year.
(3) A request for the reservation of storage capacity for monthly gas storage contracts shall be submitted by the user no later than 25 calendar days and no later than 40 calendar days before the start of the first gas day of the calendar month from which the reservation is requested by the gas storage operator. The gas storage tank operator shall evaluate the requests received and report the results of the storage capacity reservation to all applicants 20 calendar days before the start of the first gas day of the calendar month from which the reservation is requested.
(4) A request for the reservation of storage capacity for daily gas storage contracts shall be submitted by the user no later than 10 calendar days and no later than 25 calendar days before the start of the first gas day from which the reservation is requested by the gas storage operator. The gas storage tank operator shall evaluate the requests received and report the results of the storage capacity reservation to all applicants 5 calendar days before the start of the first gas day from which the reservation is requested.
(5) In the short term, the gas storage contract with interruptible power shall be concluded by the operator of the underground gas storage tank only with users who have a fixed power storage contract. A request for the reservation of storage capacity for short-term interruptible gas storage contracts shall be submitted by the user no later than 25 calendar days and no later than 40 calendar days before the start of the first gas day from which the reservation is requested by the gas storage provider unless the gas storage provider agrees otherwise with the relevant user. The gas storage tank operator shall evaluate the requests received and report the results of the storage capacity reservation to all applicants 20 calendar days before the start of the first gas day from which the reservation is requested, unless the gas storage tank operator agrees otherwise with the relevant user.
(6) The resulting reserved storage capacity notified to the applicant shall not be deemed to be reserved unless the applicant enters into a gas storage contract with the operator of the underground storage tank by the 10th calendar day following the date of notification of the results of the reservation of storage capacities for annual gas storage contracts, by the fifth calendar day for monthly gas storage contracts and by the second calendar day for daily and short-term gas storage contracts.
(7) When concluding fixed-power gas storage contracts, the operator of the underground gas storage tank shall take into account changes in the fixed-power deficiency due to the failure to conclude fixed-power storage contracts of the user to whom the required performance has been confirmed.
(8) The request for a reservation of storage capacity shall be made on a form the model of which is provided by the operator of the underground gas storage tank in a way that allows remote access. The details of the request for reservation of storage capacity are set out in Annex 4 to this Order.
(9) The date and order of receipt of the applications referred to in paragraphs 2 to 4 shall not affect the examination of requests for reservation of storage capacity. "
22. in Paragraph 19 (a):
"(a) an annual plan to reduce storage capacity or to reduce the quality of the services provided to the virtual gas storage tank for reasons of shutdown or planned maintenance of individual underground gas storage tanks,";
23. in Paragraph 19, the words "for each storage year" shall be added at the end of point (b).
24. in Article 20 (2) (a):
"(a) transmission points for cross-border pipelines,"
25. In Paragraph 21, the following sentence is added at the end of paragraph 2: "For the transfer point or, where appropriate, the sum of the gas production points for which the settlement entity responsible for the derogation is not assigned, the responsibility for the derogation shall be assigned to the gas manufacturer. The derogation at the final customer's sampling point without the entity responsible for the derogation shall be paid by the final customer to the system operator to which the gas demand facility is connected at the price of the missing balancing gas in accordance with the price decision of the Authority. ';
26. In the second sentence of Article 21 (3), the words "with the exception of restrictions on or interruptions to carriage or storage activities of fluent 2a 'are inserted after the words" after the supplied'.
Footnote 2a reads:
"(2a) Sections 58 (1) (i) and 60 (1) (f) of the Energy Act. ';

33. In Paragraph 29, paragraphs 3 and 4 are added:
"(3) Each calendar day, no later than 10: 30, the gas manufacturer shall transmit to the distribution system operator, for the previous gas day, the preliminary value of the gas supply from the transfer point or, where applicable, the sum of the gas production points.
(4) By 11: 30 on the ninth calendar day and by 11: 30 at the latest on the sixth working day of the gas month, the gas manufacturer shall transmit to the distribution system operator the actual value of the gas supply from the transfer point and, where appropriate, the sum of the gas production points for each gas day preceding the gas month. ';
34. In Paragraph 30 (1), the word 'eighth' is replaced by 'ninth' and the word 'fifth' is replaced by 'sixth'.
35. in Article 30 (1) (d), the words "for the relevant calendar month" shall be replaced by the words "on the last gas day of the relevant calendar month."
36. In Paragraph 30, the dot is replaced by a comma at the end of paragraph 1 and the following point (f) is added:
"(f) the value of the total planned annual consumption for each class of type diagrams for all final customer sampling points with type C measurement calculated monthly in the relevant distribution system in force on the last gas day of the relevant calendar month."
37. In Article 30, paragraphs 4 to 7 are added:
"(4) By 12: 00 on the ninth calendar day and by 12: 00 at the latest on the sixth working day of the gas month, the distribution system operator shall transmit to the transmission system operator, for the previous gas month, all the data referred to in Annex 7a to this Regulation for the gas distribution account for the previous gas month for the sampling points where the supplier has changed, and those sampling points have been designated for the gas month for each data transmission.
(5) The transmission system operator shall make available the data sent by the distribution system operator in accordance with paragraph 4 no later than 24 hours after receipt.
(6) Each day, no later than 13.00 hours, the transmission system operator shall make available, in its information system, the pre-value of the gas collection at the final customer's sampling point, which has changed the supplier, to the clearing entity responsible for the derogation at the relevant sampling point and to the gas supplier at the relevant sampling point. In addition, it shall make available the pre-values of the gas collection to other registered market participants permitted access to the pre-values of the gas collection by the gas supplier or the clearing entity responsible for the derogation at the relevant sampling point.
(7) The transmission system operator shall, no later than each 11th day of the calendar month by 12: 00, make available in its final customer demand point information system, which has changed the supplier, the clearing entity responsible for the derogation at the relevant demand point, the gas supplier at the relevant demand point and other registered market participants to whom access has been granted by the gas supplier or the clearing entity responsible for the derogation at the relevant demand point, the actual measurement values for the previous month for each single gas day. ';
38. In Article 31 (6), the words "as the arithmetic mean of the last known actual purchases of four calendar days equal to or prior to that date 'are replaced by the words" as referred to in paragraph 8'.
39. In Article 31, paragraphs 7 to 10 are added:
"(7) If actual climate conditions are not available for the recalculated type diagram, the last known climate forecast shall be used for the relevant gas day.
(8) A replacement estimate of the estimated consumption at the sampling point with type B measurement shall be made by the transmission system operator in the following manner:
(a) for a sampling point measuring the type B of the final customer that has changed the supplier, a replacement estimate of the expected consumption shall be determined as the product of the preliminary daily consumption of all final customers in the relevant distribution system, the coefficient determined in accordance with paragraph 9 and the weight of the sampling point determined in accordance with paragraph 10;
(b) for sampling points with type B measurements of final customers where no change of supplier has taken place, a replacement estimate of the estimated consumption of such sampling points shall be determined as the product of the preliminary daily consumption of all final customers in the relevant distribution system, the coefficient determined in accordance with paragraph 9 and the difference in value 1 and the sum of the weights for all final customers with type B measurements where the change of supplier has taken place, as determined in accordance with paragraph 10.
(9) The ratio of the final customer sampling points with type B measurement in total consumption shall be determined as the proportion of actual daily consumption at final customer sampling points with type B measurement and the total daily consumption in the relevant distribution system for the last known 4 gas days equal to the name.
(10) The weight for the sampling point with the measurement of type B of the final customer, which changed the supplier, shall be determined as the proportion of consumption at that sampling point and the total daily consumption of all customer sampling points with type B measurement in the relevant distribution system for the last known 4 gas days equal to the name. '
40. in Article 32 (3) (f):
"(f) by 9: 00 at the latest on the first day following the gas day, the actual climatic conditions, if the actual gas climate conditions are not known, shall be used the value of the latest known forecast of the climatic conditions.";
41. in Paragraph 34 (1), "12" is replaced by "13."
42. In Paragraph 34 (3), the word 'tenth' is replaced by 'eleventh'.
43. In Paragraph 34, the following paragraph 4 is added:
"(4) The transmission system operator shall evaluate and notify to individual distribution system operators, each 11th day of the calendar month by 12: 00, the actual values by allocating the amount of gas to the transmission point of the cross-border gas pipeline for the previous month for each single gas day. ';
44.
(1) The change of supplier of the gas market participant is the change
(a) supplier for another supplier;
(b) the number of suppliers;
(c) the supplier of the last instance for another supplier; or
(d) the supplier for the last instance.
(2) No later than 20 calendar days before the change of supplier, the gas market participant shall conclude a gas supply contract with the new supplier or an associated gas supply service contract.
(3) At the earliest 12 months before the change of supplier and no later than 18 calendar days before the change of supplier, if the relevant day on the day of work or on the day of work, the last preceding working day, by 10: 00 hours at the latest, the new supplier will deliver a request for the change of supplier to the transmission system operator. The request for a change of supplier shall include the following:
(a) the identification and registration number of the new supplier;
(b) the type of gas supply contract, the date from which the supply is to take place and the duration of the contract;
(c) the supplier's undertaking to take responsibility for the derogation of the gas market participant or the agreement of the clearing entity which is responsible for the derogation for the sampling points for which delivery takes place;
(d) a list of the sampling points and their identification of the EIC codes.
(4) Not earlier than 12 months before the change of supplier and not later than 18 calendar days before the change of supplier, if the relevant day on the day of work or on the day of work, the last preceding working day, by 10: 00, the new supplier shall deliver a request for the change of supplier to the operator of the relevant distribution system. The request for a change of supplier shall include the following:
(a) the identification and registration number of the new supplier;
(b) the type of gas supply contract, the date from which the supply is to take place and the duration of the contract;
(c) the listing and identification of the sampling points.
(5) Where it is necessary to conclude a gas distribution contract when a change of supplier is made, an application for a change of supplier shall be submitted in accordance with paragraph 4 at the same time as an application for allocation of distribution capacity pursuant to Paragraph 12.
(6) Within 7 calendar days of receipt of the request for a change of supplier, but not later than 16 calendar days before the change of supplier, the transmission system operator shall inform the transmission system operator of the receipt of the change of supplier of the relevant distribution system operator, the existing supplier, the new supplier, the existing clearing entity and the new clearing entity.
(7) Within 7 calendar days of receipt of the request for a change of supplier, but not later than 16 calendar days before the change of supplier, the relevant distribution system operator shall inform the relevant distribution system operator of the receipt of the change of supplier of the transmission system operator, the existing supplier and the new supplier.
(8) Within 10 calendar days of receipt of a request for a change of supplier, but not later than 15 calendar days before the change of supplier, the relevant distribution system operator shall register with the transmission system operator the demand point of the gas market participant in which the change of supplier takes place.
(9) Within 20 calendar days of the receipt of the request for a change of supplier, but no later than 10 calendar days before the change of supplier, the operator of the relevant distribution system shall notify the transmission system operator, the existing supplier and the new supplier of the results of the assessment of the change of supplier's request within 12: 00 on the last preceding working day.
(10) Within 25 calendar days of receipt of the request for a change of supplier, but not later than 9 calendar days before the change of supplier, the transmission system operator shall notify the operator of the relevant distribution system, the existing supplier, the new supplier, the existing clearing entity and the new clearing entity of the results of the assessment of the change of supplier.
(1) No later than 1 working day by 10: 00 hours before the change of supplier, an existing clearing entity responsible for the derogation at the sampling point where the change of supplier takes place or an existing supplier not associated with the derogation at the sampling point where the change of supplier takes place may request the transmission system operator to return the transmission capacity.
(2) An existing clearing entity assigned to the responsibility for the derogation at the sampling point where the change of supplier takes place or an existing supplier not assigned to the derogation at the sampling point where the change of supplier occurs may request the return of the transport capacity up to a maximum of the agreed distribution capacity at the final customer's sampling point where the change of supplier occurs.
(3) The transmission system operator shall comply with the requirement to return the transmission capacity in the event that a new clearing entity at the final customer's demand point where the change of supplier occurs or an existing supplier who is not responsible for the deviation in the demand point where the change of supplier occurs has reserved the transport capacity for the relevant domestic point of the transmission system. The transmission system operator shall comply with the demand for a return of transmission capacity up to a maximum level so that, at the relevant domestic point of the transmission system, the size of the returned transmission capacity does not exceed the size of the newly booked transmission capacity.
(4) The transmission system operator shall notify the applicant of the return of transmission capacity no later than 5 calendar days after the change of supplier of compliance with the return requirement and to what extent. After notification of the results of the evaluation of the application, the transport capacity may be returned no later than the 12th calendar day following the change of supplier. ';
45. in Paragraph 38 (2), the words "and the previous settlement entity" shall be inserted after the word "supplier."
46. In Paragraph 38 (3), the words "or a gas market participant 'are replaced by" an existing supplier and final customer'.
47. in Article 38 (5) and (6):
"(5) A change in the supplier of the final customer whose gas demand facility is connected to the transmission system shall be treated mutatis mutandis in accordance with § 36 to 38.
(6) When changing the supplier at the final customer's sampling point with type B measurement, the operator of the relevant distribution system shall send to the transmission system operator, at the latest, the actual daily gas consumption values at the final customer's sampling point for the last 2 known calendar months. The distribution system operator shall send to the transmission system operator the actual daily gas consumption values for the final customer's demand point by the deadline set in Article 29 (2) (d) and for the gas month preceding the change of supplier. ';
48. The following Section 39a is inserted after Section 39:
Common provisions
(1) Values transmitted or published pursuant to Articles 23 to 25, 29 (2), 30 (1) (a), (b), (d) to (f), 30 (3) and (5), 31 (6) and 34 (1), (2) and (4) shall be reported rounded to the nearest kWh.
(2) Values transmitted or published pursuant to Articles 29 (2), 30 (1) (a) and (b) shall be reported in whole m3.
(3) Values transmitted pursuant to Paragraph 29 (1) shall be sent rounded to the nearest kWh or m3, using, in the case of data sent in m3, the transmission system operator for conversion to kWh of the preliminary GCV. ';
49. Annex 5 reads as follows:
"Annex No 5 to Decree No 524 / 2006 Coll.
Rules for assessing the feasibility of re-nomination
The transmission system operator shall refuse re-nomination at the point of entry or exit of the transmission system two hours before the start and during the gas day if:
(a) nominations at the entry or exit point of the transmission system are not mutually agreed;
(b) any of the following inequalities (1) and (2) are met at the entry or exit point of the transmission system:

Nrj is the recalculation of a given clearing entity at the entry or exit point of the transmission system on a given gas day;

Npj nominations and re-nominations accepted and registered in time T determined as:

The distribution system operator shall send at least the following data for the gas distribution account for the final customer's demand point:
