on the food recipient's information obligations at the place of destination in relation to certain food species
The Ministry of Agriculture provides, pursuant to Article 18 (1) (f) of Act No. 110 / 1997 Coll., on Food and Tobacco Products and amending and supplementing certain related acts, as amended by Act No. 139 / 2014 Coll.:
§ 1
Subject matter
(1) This decree regulates the extent of information on the origin of food of plant origin and food supplements following the directly applicable European Union Regulation (1).
(2) This Order applies to:
(a) fresh fruit of the species
1. peaches, including nectarines,
2. pears,
3. apples,
4. Slugs and plums,
5. oranges,
6. bananas,
7. table grapes,
(b) fresh vegetables of the species
1. onions and garlic,
2. carrots and celeriac,
3. Tomatoes, peppers and cucumber,
4. head cabbage, cauliflower and broccoli,
(c) early potatoes and late potatoes,
(d) grapevine products as defined in the Regulation on the common organisation of the markets in agricultural products3), including wine sorrow4), in packages of a volume exceeding 2 litres, not intended for the final consumer, and in unpackaged wine;
(e) fresh grapes other than table grapes (5);
(f) poppy seed 6),
(g) dietary supplements 7).
(3) This decree shall apply only where the destination is the place of first reception, including any first treatment or handling in the territory of the Czech Republic of the food referred to in paragraph 2.
(4) This decree shall not apply to the products referred to in paragraph 2 (d) which are transported within the territory of the Czech Republic under a conditional exemption scheme pursuant to Decision No 1152 / 2003 / EC of the European Parliament and of the Council of 16 June 2003 establishing an electronic system for the transport and monitoring of products subject to excise duty.
§ 2
Scope of the information obligation, deadline and method of transmission
The consignee of the food at the place of destination, if the food referred to in § 1 (2) and the destination referred to in § 1 (3) are concerned, shall notify the competent Regional Inspectorate of the State Agricultural and Food Inspection by means of a service enabling long-distance transmission of data at the latest 24 hours before the arrival of the food at its destination.
(a) the type of food coming to its destination;
(b) the quantity of food arriving at the place of destination;
(c) the Member State, the name and address of the food business operator supplying the food to the place of destination;
(d) the address of the destination and the consignee of the food; and
(e) the estimated date of arrival of the food at the place of destination.
§ 3
Efficacy
This Decree shall enter into force on 1 January 2015.

4) § 3 (h) of Act No. 321 / 2004 Coll., on Vineyard and Vineyard and on the amendment of certain related laws (Vineyard and Wine Act), as amended by Act No. 256 / 2011 Coll.
(5) Annex I, Part XII, point (c) to Regulation (EU) No 1308 / 2013 of the European Parliament and of the Council.
6) Paragraph 12 (4) of Decree No. 329 / 1997 Coll., implementing § 18 (a), (b), (e), (f), (g) and (h) of Act No. 110 / 1997 Coll., on Food and Tobacco Products and amending and supplementing certain related laws, for starch and starch products, leguminous and oil seeds, as amended by Decree No. 399 / 2013 Coll.
