DECLARATION
of 3 August 2005
on the establishment of protection zones for natural mineral water sources in Okehov and the definition of specific protection measures (Ordinance on protection zones for natural mineral water sources in Okehov)
According to § 46 (3) (b) of Act No. 164 / 2001 Coll., on Natural Medical Resources, Natural Mineral Water Resources, Natural Spa and Spa Areas and on the amendment of certain related laws (Spa Act):
(1) In order to protect the source of natural mineral water, which is ingested by a well BJ 11 located on land parcel 56, the cadastral territory of Očihov, the region of Ústecký (hereinafter referred to as "the source"), protection zone I and II shall be established.
(2) Level I protection zone (2) forms the immediate vicinity of the source output and is defined by a rectangle of sides of 16 and 20 m. The well is located in its geometric center, the longer side of the rectangle faces from the west-northwest to the east-southeast. The first stage protection zone is graphically marked on a copy of the cadastral map in the scale 1: 2880, annexed to No 1 of this decree.
(3) Level II protection zone (3) is established for the protection of the infiltration territory of the established source structure. It is defined by the territory whose border is drawn from the square in Očihov to the intersection of roads to Podbořany, Blšan and Kryr, from there along the field road to the hill Na old village and to the top of the plain, further towards Očihov along the northern boundary of the land parks No 1463 / 21 and 1463 / 18, via the road to Podbořín to the field road leading from Očihova to Blšan, then along its western edge to the traffic station in Očihova, further along the local road to the south direction to the square and along its northwestern edge to the starting point. The 2nd grade protection zone is graphically marked in the basic maps of the Czech Republic on the scale 1: 10 000 and 1: 50 000, copies of which are annexes 2 and 3 to this decree.
(4) The definition of the 1st degree protection zone in the cadastral map in the scale 1: 2880 and the 2nd degree protection zone in the basic maps of the Czech Republic in the scale 1: 10 000 and 1: 50 000 are available for inspection at the Ministry of Health, the Municipal Office in Podborány and the Regional Office of the Ústecký Region.
(1) Level I protection zone is also a physical resource protection zone (4).
(2) The following shall be prohibited in Level II protection zone:
(a) to operate landfills and storage of hazardous waste (5);
(b) mine miners6);
(c) carry out drainage work which could jeopardise the natural groundwater regime;
(d) discharge waste water into groundwater (7);
(e) to operate rendering plants, slaughterhouses and waste incineration plants;
(f) to operate production ducts of hazardous defective substances (7);
(g) operate a parking lot not secured against oil losses into the terrain (7);
(h) to collect groundwater if the intake object exceeds 6 m in depth or to collect groundwater 0,1 litre per second or the free CO2 content of the extracted groundwater exceeds 200 mg per litre; This does not apply if the groundwater collection started before the date of entry into force of this decree.
The activities referred to in paragraph 2 (a) to (g), if carried out in Level II protection zone, shall be completed within 2 years of the date of entry into force of this Decree.
This Decree shall enter into force on 1 October 2005.
