Government regulation on the treatment of pyrotechnic articles

GOVERNMENT REGULATION
of 26 February 2014
on the handling of pyrotechnic articles
The Government orders the implementation of Act No. 156 / 2000 Coll., on the Verification of Firearms, Ammo and Pyrotechnic Articles and on the Treatment of Certain Bomb Products, as amended by Act No. 227 / 2003 Coll., Act No. 148 / 2010 Coll. and Act No. 217 / 2013 Coll.:
§ 1
Subject matter
(1) This Regulation provides for details of the handling of pyrotechnic articles in storage.
(2) Pyrotechnic articles are:
(a) pyrotechnic articles of categories 1, 2, 3, P1, T1,
(b) pyrotechnic articles of categories 4, P2 and T2 which are not regarded as explosive articles; the list of those pyrotechnic articles is set out in Annex 1 to this Regulation,
(c) pyrotechnic articles of Classes I, II, III and subclasses T0, T1; and
(d) pyrotechnic articles of Section IV and subsection T2 which are not regarded as explosive articles; the list of those pyrotechnic articles is set out in Annex 2 to this Regulation.
§ 2
General storage requirements
Pyrotechnic articles can only be stored
(a) according to the instructions for use and labelling and instructions given on the product or its smallest consumer packaging (1), or as required by the manufacturer, or where pyrotechnic articles are stored in transport packaging (2);
(b) separately from flammable and flame-retardant substances;
(c) in such a way as to prevent their spontaneous fall and to prevent their involuntary initiation or ignition;
(d) in a dry state and in such a way that their temperature does not exceed 40 degrees Celsius unless otherwise stated in the instructions for use, labelling or instructions given on the product or its smallest consumer packaging;
(e) in original transport packages of the manufacturer or importer or in the smallest consumer packaging; and
(f) in such a way that their unintentional initiation or ignition minimises the life and health of persons or property and that storage conditions do not jeopardise the conformity of the product with the essential safety requirements for pyrotechnic articles (1).
§ 3
Storage at premises
(1) In the establishment it is possible to store pyrotechnic articles only in the sales room or in the manual warehouse of the establishment.
(2) Pyrotechnic articles containing not more than 80 kg net weight of explosive substances may be stored in the sales room.
(3) Pyrotechnic articles may be stored in a storage facility in a quantity not exceeding:
(a) 300 kg net weight of explosive substances, where they are all in original packaging of the manufacturer or importer, bearing a classification code 1.4 G under another legislation (2), of which not more than one such packaging of each product type may be opened,
(b) 200 kg net weight of explosive substances, if the conditions of (a) are not fulfilled; or
(c) 750 kg net weight of explosive substances, when stored in combination with (a) or (b) together with pyrotechnic articles found in original packaging of the manufacturer or importer, bearing, under another legislature2, the classification code 1.4 S.
§ 4
Security
In the premises referred to in Section 3, where pyrotechnic articles are present, the rules on fire protection shall be complied with, in particular it shall be prohibited to smoke, handle open fire and hot objects and to launch pyrotechnic articles. When repairing such premises which may endanger stored pyrotechnic articles, the pyrotechnic articles must be removed from these premises before the repair begins.
§ 5
Stable sales
(1) For the sale of pyrotechnic articles in the sales stand, the conditions set out in Section 2 must be complied with.
(2) The sales stand shall be equipped with at least one portable water or foam fire extinguisher with a fire extinguisher of at least 13A or a portable fire extinguisher with a powder extinguisher of at least 21A.
(3) Smoking is prohibited in order to ensure safety in the market for pyrotechnic articles.
§ 6
Final provision
This Regulation was notified in accordance with Directive 98 / 34 / EC of the European Parliament and of the Council of 22 June 1998 laying down a procedure for the provision of information in the field of technical standards and regulations and of rules on information society services, as amended.
§ 7
Efficacy
This Regulation shall enter into force on the 15th day following its publication.
