Law on Members of the Federal Assembly

THE LAW
of 22 March 1989
on Members of the Federal Assembly
The Federal Assembly of the Czechoslovak Socialist Republic decided on this law:
§ 8
(1) A Member who has ceased to be electable loses his mandate; the loss will be expressed on the proposal of the Mandate and Immunity Committee of the House of which it is a member.
(2) The Member also loses his mandate for the reasons laid down in the Constitutional Law on the Czechoslovak Federation.
§ 9
(1) The Member may waive his mandate in writing.
(2) The mandate will expire on the day on which the Presidency of the House took note of the resignation.
§ 19
General principles
(1) The State guarantees the necessary conditions for the performance of the parliamentary function.
(2) Members are protected by the Constitution and enjoy parliamentary immunity.
(3) The publication of speeches by Members in the bodies of the Federal Assembly, the House and its bodies is not subject to any restrictions, not for private meetings or parts thereof.
(4) Those who prevent Members from exercising their rights and obligations or affect their honour and dignity as public officials shall be liable under the law.
(5) The national authorities and their heads of staff shall assist Members in the performance of their duties.
Duties of the institutions
§ 20
(1) Members of the Government and heads of other state bodies of the Czechoslovak Socialist Republic, heads of state bodies are obliged to provide Members with the information, explanations and supporting documents necessary for the performance of his duties and to accept it at his request; in urgent cases, Members shall be obliged to be admitted without delay.
(2) The Heads of State bodies referred to in paragraph 1 shall deal with the initiatives and observations of Members and inform them of their use or processing within 30 days at the latest. Likewise, they are obliged to inform Members of the handling of complaints, initiatives and notifications to citizens who have been referred to them and to allow them to participate in the examination of such complaints.
§ 21
(1) The Heads of State bodies shall be obliged to inform Members of the measures they have taken to remedy the breach of legality, of state discipline or of the labour discipline which they have been brought to their attention within 30 days at the latest.
(2) If the Member is not satisfied with the measures taken, the superior authorities shall, at the request of the Member, examine the procedure of the subordinate body within 30 days and report thereon.
