GOVERNMENT REGULATION
of 20 August 2025
amending Government Regulation No 591 / 2006 Coll., on closer minimum requirements for safety and health at work at construction sites, as amended by Government Regulation No 136 / 2016 Coll.
The Government hereby orders, pursuant to § 21 (a), to implement § 3 (3), § 15, § 18 (1) (c), § 18 (2) (b) and § 21 (b) of Act No. 309 / 2006 Coll., which regulates other requirements for safety and health at work in employment relations and for ensuring safety and health in activity or provision of services outside employment relations (Act on other conditions of safety and health at work), as amended by Act No. 362 / 2007 Coll., Act No. 189 / 2008 Coll., Act No. 88 / 2016 Coll., Act No. 250 / 2021 Coll. and Act No. 318 / 2025 Coll.:
Government Regulation No. 591 / 2006 Coll., on Closer Minimum Requirements for Safety and Health at Work at Construction, as amended by Government Regulation No. 136 / 2016 Coll., is amended as follows:
1. footnotes 4, 5, 7 to 9, 11 and 12 are as follows:
"4) Decree No. 146 / 2024 Coll., on construction requirements.
5) Government Regulation No. 361 / 2007 Coll., laying down conditions for health protection at work, as amended.
7) Act No. 283 / 2021 Coll., Construction Act, as amended.
8) Articles 10 (1) (b) and 164 (1) (f) of the Building Act.
9) Part Six, Title VII of the Building Act.
11) Paragraph 6 (3) of the Building Act.
12) Act No. 49 / 1997 Coll., on Civil Aviation, as amended. '
2. in § 7 (a), the word "recommended" shall be replaced by "determined."
3. In Section 7 (c), the comma after the word "construction site" and the words "and to be agreed and signed by all contractors if they are known at the time of processing of the plan 'is deleted.
4. In Article 8 (2) (c), the words "all concerned 'are inserted after the words" alerted'.
5. In Annex 1, Part I, at the end of point 1, the dot is replaced by a comma and the following point (f) is added:
"(f) when lighting the construction site, light pollution of the surrounding environment shall be minimised."
6. In Annex No 1, Part I, the following point 9 is added:
'9. The following principles shall be observed for internal roads at the construction site:
(a) prior to the start of transport at the construction site and any substantial change thereto, a check must be carried out on communications, passable profiles, operating conditions and an adjustment to non-compliant communications;
(b) the underpass or other rigid obstacle shall be prohibited if the height of the vehicle, including the load, is not less than or equal to 0,3 m. Underpasses having a clearance of less than 4,3 m shall be marked as on public roads,
(c) the minimum width of pedestrian communication at the construction site shall be 0,75 m, 1,5 m in two-way operation Communication with a gradient greater than 1: 3 shall have, on at least one side, a single-bar rail with a height of 1,1 m;
(d) underpass heights must be at least 2,1 m; in an exceptional case this height may be reduced to 1,8 m, the necessary safety measures being taken, in particular, by marking or coating;
(e) obstacles to roads affecting safe passage, as well as entry and exit bans, must be marked with appropriate safety signs and signs;
(f) all obstacles on roads above 0,1 m where persons cross or serve transport shall be provided with crossings and crossings of adequate load capacity;
(g) on roads where there is an increased risk of the fall of persons, of the removal or withdrawal of vehicles or of the means of mechanisation, at the ends of roads and prohibited entry, security measures, such as fences or barriers, shall be carried out. ";
(7) footnotes 15, 16 and 17 shall read:
"15) Government Decree No. 375 / 2017 Coll., on the appearance, location and execution of security signs and marking and the introduction of signals.
16) Decree No. 294 / 2015 Coll., implementing road traffic rules, as amended.

8. In Annex 3, Part II, point 1, the words "technical infrastructures 25) 'are replaced by the words" technical infrastructures 8)'.
footnote 25 is deleted.
(9) footnotes 26 and 27 read:

10. In Annex 3, Part In point 4, including footnote 42:
"4. The vertical side walls of mechanically depth excavations shall be secured against deformation by arms or protection frames, safety cages, spacing structures or other technical structures at the depth of the excavation at points where persons enter. In the soil of incoherent, submerged or otherwise susceptible to landslide and where repeated shocks must be counted, the walls of these excavations must be secured according to a specified technological procedure even at depths smaller than those laid down in the first sentence. In the case of depth up to 1,3 m in the built-up area and up to 1,5 m in the unbuilt area, the depth of the arms may be determined, by way of derogation from the depth specified in the first sentence, on the basis of a geological assessment or a geological survey processed by a geologist with competence in the field of engineering geology42 with regard to the type of soil and risk assessment; the obligation under the second sentence is not affected. Where a coordinator is designated, it shall process the risk assessment in accordance with the third sentence.

11. In Annex 3, Part In the first sentence of point 5, the words "at a depth of more than 0,8 m up to and including 1,2 m shall be inserted after the word" persons, "and" at a depth of more than 1,2 m. "
12. In Annex 3, Part the following point 8 is added:
'8. It shall be prohibited to descend into excavations or exit from excavations on horizontal spacing elements as well as on other parts of the stock structure. '
13. In Annex 3, Part VIII, point 3, the words "Special Legislation (26) 'are replaced by the words" Special Legislation (13)'.
14. In Annex No 3, Part IX.1, the following point 2 is inserted:
'2. It shall be prohibited to enter the spacing horizontal formwork construction. ';
Points 2 to 4 shall be renumbered 3 to 5.
15. In Annex No 3, Part IX.2, point 2, the words "or floors, where appropriate, to avoid the walking of natural persons immediately after the stored reinforcement 'are deleted and the sentence" Temporary communication areas through the stored reinforcement spaces shall be added at the end of that point to prevent the walking of natural persons immediately after the stored reinforcement'.
16. In Annex 3, Part XII, point 1, first sentence, the words "cutting work 12) 'are replaced by the words" cutting work7).
17. In Annex 3, Part XII, point 6, the word "interest 'is replaced by the word" interest 43'.
Footnote 43 reads:
"43) E.g. Government Decree No. 361 / 2007 Coll. '.
18. In Annex 3, Part XII, point 21, the words "and non-load bearing 'are inserted after the words" load bearing'.
19. Footnote No 37 reads:
"37) Act No. 18 / 1997 Coll., on the Peaceful Use of Nuclear Energy and Ionizing Radiation (Atomic Act) and on the amendment and addition of certain laws, as amended."
20. In Annex 5, at the end of the text in point 6, the words "except for the construction of technical infrastructure networks in low-voltage electricity or gas at pressure levels up to 4 bar of distribution licences under the Energy Act 'are added.
Efficacy
This Regulation shall take effect on 1 November 2025.
