of 20 October 2011
establishing protection zones for natural mineral water sources in Buchlovice and defining specific protective measures
According to § 46 (3) (b) of Act No. 164 / 2001 Coll., on Natural Medical Resources, Natural Mineral Water Resources, Natural Spa and Spa Areas and on the amendment of certain related laws (Spa Act):
§ 1
Establishment of protection zones
(K § 21, 22 and 23 of the spa law)
(1) In order to protect the natural medical source of mineral water LL-1 (hereinafter referred to as "the source"), located on land parcel No 2568 / 7 of the cadastral territory of Buchlovice, part of Smrdávka, the district of Uherské Hradiště, Zlínský county, protection zones I and II shall be established.
(2) Level I protection zone is the immediate vicinity of the source output. The first stage protection zone is graphically marked in a copy of the cadastral map in the scale 1: 1 000, which is annexed to the decree No 1.
(3) A zone of physical protection of the source is defined in the Level I protection zone. It has the shape of a rectangle with dimensions of 10 x 7 m, with its long side oriented in the direction of the northwest towards the southeast. The source is located in the geometric centre of the physical protection zone.
(4) The Level II protection zone is established to protect the infiltration area. It is graphically marked on the map on the scale 1: 10 000, which is annexed to the decree No 2.
(5) The definition of protection zones I and II in a copy of the cadastral map in the scale 1: 1 000 and the basic map of the Czech Republic in the scale 1: 10 000 are available for inspection at the Ministry of Health, the Regional Office of the Zlín Region and the Office of Buchlovice.
Definition of specific safeguard measures
§ 2
(K § 22 and 23 of the spa law)
(1) The following shall be prohibited in the protection zone I:
(a) to build or operate objects for agricultural production, industrial production objects and other objects in which defective substances are handled (1);
(b) carry out landscape2) permanently disrupting continuous soil cover; If the work and arrangements related to the protection and use of the resource are concerned, the provisions of Section 37 of the Spa Act shall be followed;
(c) to carry out farming activities with the exception of the maintenance of permanent grassland, livestock and game farming (3);
(d) treat particularly dangerous substances or harmful substances to a greater extent, or where treatment is associated with an increased risk to surface or groundwater; If the treatment required for the protection and use of the resource is concerned, the water law shall be followed;
(e) apply livestock and industrial fertilisers and chemical products for plant protection 4),
(f) carry out mining and mining activities 5) without the permission of the Ministry of Health;
(g) to camp freely in nature;
(h) discharge waste water into groundwater and dispose of the contents of the cesspool and of the urine pit (6).
(2) The following shall be prohibited in Level II protection zone:
(a) treat particularly dangerous substances or harmful substances to a greater extent, or where treatment is associated with an increased risk to surface or groundwater;
(b) to discharge uncleaned waste water into groundwater and to dispose of the contents of the cesspool and of the urine pit (6);
(c) establish permanent storage areas for petroleum products, fertilisers and chemical products;
(d) to establish and operate premises of industrial and large-scale agricultural buildings, the operation of which may adversely affect the physical, chemical and microbiological characteristics of the source and its health, as well as the stocks and eligibility of the source;
(e) carry out mining and mining activities 5) without the permission of the Ministry of Health.
§ 3
The band of physical protection of the source shall be fenced with a fixed fence.
§ 4
Efficacy
This Decree shall take effect on 1 November 2011.
