THE LAW
of 29 April 2004
amending Act No. 200 / 1994 Coll., on Surveying and amending and supplementing certain laws related to its implementation, as amended
Parliament has decided on this law of the Czech Republic:
Act No. 200 / 1994 Coll., on Geometry, and amending and supplementing certain laws related to its introduction, as amended by Act No. 120 / 2000 Coll. and Act No. 186 / 2001 Coll., is amended as follows:
1. In Article 2, at the end of point (k), the dot is replaced by a comma and the following point (l) is added:
"(l) basic bases of geographical data of the Czech Republic (hereinafter referred to as" database ") database set of selected geographical, topographic and geodetic data from the whole territory of the Czech Republic (hereinafter referred to as" data ")."
2. in Article 4 (1), the following point (e) is inserted after point (d):
"(e) the creation and management of a database,"
Points (e) to (j) shall be renumbered as points (f) to (k).
3. In Article 4 (1) (j), the words "(a) to (h) 'are deleted.
4. In Article 4 (2) (b), the words "or founded 'shall be inserted after the words" established by it'.
5. the following paragraph 3 is added to Article 4, including footnote 4a:
"(3) Geometric activities in the public interest requiring the use of measuring instruments may only be carried out using such measuring instruments complying with the requirements of a specific legislation. (4a)

6. the following Section 4a is inserted after Section 4, including the title and footnotes Nos 4b, 4c, 4d, 4e and 4f:
Content, administration, use and dissemination of database data
(1) Database contains data on objects in categories
(a) residential, economic and cultural objects;
(b) communication, 4b)
(c) distribution networks and pipelines;
(d) vodstvo,
(e) territorial units including protected territories;
(f) vegetation and surface;
(g) field relief;
(h) geodetic points.
(2) Administrator (4c) creates and maintains a database as part of the public administration information system. 4d) Data databases are generally usable as basic data.
(3) The database data may be used and disseminated only with the consent of the administrator and under the conditions laid down in the implementing legislation.
(4) Data databases are binding on the creation of 1: 10 000 and smaller national map works and the basis for the creation of data-containing public administration information systems. The provisions of the first sentence shall not apply to State map works and information systems intended for the purpose of ensuring State defence and crisis management.
(5) The database administrator shall be entitled to require the data managed by the authorities for the purpose of managing the database,
(a) watercourses and water catchment areas identifiers, the course of distribution facilities from the Ministry of the Environment,
(b) identifiers from the Ministry of the Environment of specially protected territories and conquest areas, including their delimitation;
(c) data on the motorway, road, railway and airport networks owned by the State (4e) from the Ministry of Transport,
(d) the codes of territorial units according to the nomenclature of territorial units of statistics CZ-NUTS4f) from the Czech Statistical Office.
(6) The central administrations referred to in paragraph 5 shall provide the necessary data to the database administrator free of charge. Data from the database shall be provided free of charge to administrative, judicial and public authorities for the exercise of their responsibilities.

4f) Measures of the Czech Statistical Office of 27 April 1999 on the introduction of the Classification of Territorial Statistical Units - CZ- NUTS (amount 33 / 1999 Coll.), as amended by the Czech Statistical Office of 15 June 2001 (amount 88 / 2001 Coll.). "
7. In Article 6 (2) (b), the words "for the management of essential national map works' are deleted.
8. In Article 14a (2), the words "and recall 'are inserted after the words" Paragraph 13 (1) (d)'.
9. Paragraph 17 (2) reads as follows:
"(2) Geodetic reference systems and national map works binding on the whole territory of the State, including the principles of their application, shall be laid down by a regulation."
10. in Article 20 (1), the following points (b) and (c) are inserted after point (a):
"(b) the subject matter and content of the management of the database;
(c) the forms of provision and conditions of use and dissemination of database data; ';
Points (b) to (f) shall be renumbered (d) to (h).
11. in Paragraph 20 (2):
"(2) The Ministry of Defence hereby provides for:
(a) details of the application for official authorisation and the request for the termination of official authorisation and the form of verification of the results of the geographical activities for the purpose of State defence;
(b) the content and method of carrying out the test;
(c) the content and manner of carrying out the comparative proficiency test. ';
This Law shall take effect on 1 January 2005.
