on the function and organisation of the national radiation monitoring network
The State Nuclear Safety Authority provides, pursuant to § 47 (7), for the implementation of § 3 (2) (l) and § 46 (1) of Act No. 18 / 1997 Coll., on the Peaceful Use of Nuclear Energy and Ionising Radiation (Atomic Act) and amending and supplementing certain laws, as amended by Act No. 13 / 2002 Coll., hereinafter referred to as "the Act":
§ 1
Subject matter
This decree sets out the requirements for the function and organisation of the national radiation monitoring network (hereinafter referred to as the "monitoring network ') and sets out the means of data transmission.
§ 2
Definitions of terms
For the purposes of this decree:
(a) by monitoring the radiation situation - measurement of quantities and evaluation of the results of measurement of quantities for the purpose of radiation control;
(b) monitoring network - a system of measuring points and a system of means professionally, technically and staffed and organically linked for the purpose of monitoring the radiation situation in the Czech Republic,
(c) the usual radiation situation - the situation with the exception of a radiological emergency, 1)
(d) data transmission system - data transmission system within the monitoring network,
e) information system - system for collection, verification, archiving and presentation of data transmitted by the data transmission system and for their transmission in the Czech Republic and abroad 2) and for publication .3)
§ 3
Monitoring network functions
(1) The monitoring network ensures monitoring of the radiation situation on the territory of the Czech Republic ("monitoring '), including data transmission and management of the information system for
(a) assessment of the radiation situation for monitoring and assessing the state of exposure;
(b) deciding on measures to reduce or avert exposure in the event of a radiation accident;
(c) international exchange of information and data on the radiation situation;
(d) publication and provision of information and data on the radiation situation in the Czech Republic.
(2) Monitoring is ensured:
(a) the Office of State Nuclear Safety ("the Office"), to the extent and in a manner specified by the Office's emergency plan, 4)
(b) in accordance with Article 46 (1) of the Act, by the relevant ministries to the extent and in the manner laid down by the Treaty;
(c) holders of a permit for the operation of a nuclear installation or site of Category IV (5) to the extent and in the manner laid down by specific legislation6) and a monitoring programme (7) and an internal emergency plan (8) approved by the Authority;
(d) legal and business natural persons to the extent and in the manner specified in the contract to ensure the performance of tasks arising from the crisis plan of the Office (9) (hereinafter referred to as "the contracting entities").
Monitoring network organisation
§ 4
(1) The monitoring network shall consist of permanent components of the monitoring network which operate continuously under normal and radiological emergency situations, and emergency components of the monitoring network that are activated when a suspected or radiological emergency occurs. The contingency components of the monitoring network may not be included in the permanent components of the monitoring network at the same time.
(2) The permanent components of the monitoring network consist of:
(a) a network of early detection, consisting of a system of measuring points carrying out continuous measurement of batch power on the territory of the Czech Republic and informing immediately of any increase in power over normal values; a teledosimeter system is part of the early detection network, which is the means of continuous measurement of doses, dose inputs, radionuclides' activity and their time-integral in nuclear installations with a view to recording or suspecting a radiological emergency and assessing leakage into the air and into the watercourses;
b) a network of thermal luminescent dosimeters, which is a system for measuring the dose of gamma radiation in the Czech Republic,
(c) measuring points of air contamination, which are means for measuring the dose input and for ensuring sampling of aerosols and falls and for easy determination of radionuclide activity in these samples;
(d) measuring points of contamination of foodstuffs, which are means of ensuring the sampling of food chain cells and of determining the activity of radionuclides in these samples;
(e) measuring points of water contamination, which are means of ensuring water, river sediments and fish sampling and determining the activity of radionuclides in these samples;
(f) measuring points at border crossing points which are means of obtaining data on radionuclide contamination of persons, means of transport, goods, objects and materials at border crossing points;
(g) mobile groups carrying out monitoring of doses, dose inputs and activity of radionuclides in the field, sampling of environmental constituents and the distribution and exchange of dosimeters in thermoluminescent dosimeters networks;
(h) aerospace groups carrying out dose, dose and field activity monitoring;
(i) laboratory groups which provide for environmental sampling carry out spectrometric or radiochemical analyses of environmental samples to determine the activity of radionuclides;
(j) a central laboratory of the monitoring network, which coordinates the measurement of samples taken by laboratory and mobile groups and ensures the selected measurements of those samples, and further ensures the evaluation of the results of those measurements, in order to provide evidence for decision-making on measures to reduce or prevent the exposure of persons, and which coordinates and ensures the measurement of internal contamination of persons;
(k) a meteorological service which receives the meteorological data necessary to enable the assessment and forecasting of the development of the radiation situation to be carried out using the models for the spread of escaped radionuclides in the air.
(3) The contingency components of the monitoring network consist of:
(a) mobile groups carrying out monitoring of doses, dose inputs and activity of radionuclides in the field, sampling of environmental components and the distribution and exchange of dosimeters in thermoluminescent dosimeters networks;
(b) laboratory groups which provide for environmental sampling carry out spectrometric or radiochemical analyses of environmental samples to determine the activity of radionuclides;
(c) aerial means of the survey for dose monitoring, dose inputs and field radionuclide activity;
(d) measuring points of contamination of water, which are means for determining the activity of radionuclides in water, river sediments, aquatic macrophytes and fish samples;
(e) measuring points of food contamination, which are the means for determining the activity of radionuclides in food chain cells;
(f) measuring points at border crossing points, which are means of obtaining data on batch inputs, radionuclide contamination of persons, means of transport, goods, objects and materials;
(g) measuring points on closures, which are means of obtaining data on batch inputs and on radionuclide contamination of persons, means of transport, objects and materials at the borders of closed areas and around the site of the radiation accident.
(4) The Office shall ensure the information system and shall ensure or participate, to the extent and in a manner specified by its crisis plan, in the data transmission system and in the activities of:
(a) early detection networks;
(b) thermoluminescent dosimeter networks;
(c) measuring points of air contamination;
(d) mobile groups;
(e) air groups;
(f) laboratory monitoring groups;
(g) central laboratories of the monitoring network.
(5) The Ministry of Finance, the Ministry of Defence, the Ministry of Interior, the Ministry of Agriculture and the Ministry of the Environment ensure or participate in the data transmission system and in the activities of the components of the monitoring network in accordance with the law to the extent and in the manner laid down by the Treaty.
(6) Holders of a nuclear installation or Category IV site permit shall, to the extent and in the manner set out in the monitoring programme and in the internal emergency plan approved by the Authority, participate in the data transmission system and ensure the operation of:
(a) early detection networks;
(b) thermoluminescent dosimeter networks;
(c) measuring points of air contamination;
(d) mobile groups;
(e) laboratory groups.
(7) The Contracting Parties shall ensure or participate, to the extent and in the manner laid down in the contract to ensure the performance of the tasks arising from the Office's crisis plan, of the data transmission system and of the activities of:
(a) measuring points of water contamination;
(b) measuring points of food contamination;
(c) laboratory groups,
(d) mobile groups.
§ 5
(1) The monitoring network operates in normal and emergency mode.
(2) The normal regime is monitoring under normal radiation conditions, and
(a) permanent components of the monitoring network are involved;
(b) monitoring is aimed in particular at monitoring the temporal and spatial distribution of doses, batch inputs and activity of radionuclides in environmental compartments in order to establish long-term trends and to detect deviations from them in a timely manner, while at the same time maintaining the organisational, technical and personnel preparedness of the components of the monitoring network for monitoring in emergency mode;
(c) monitoring shall be carried out by the monitoring network components:
1. under the responsibility of the Office in accordance with Table 1 of Part And the annexes to this decree, to the extent and in a manner specified by the Office's crisis plan,
2. under the responsibility of the Ministry of Finance, the Ministry of Interior, the Ministry of Agriculture and the Ministry of the Environment according to Table 1 of Part A of the Annex to this Decree in the scope and in the manner laid down by the Treaty,
3. within the scope of the holder of a permit to operate a Category IV nuclear installation or site, to the extent and in a manner specified by a specific legislation and in a monitoring programme and in an internal emergency plan approved by the Authority; and
4. within the scope of the contracting parties as defined in Table 1 of Part And the annexes to this decree, to the extent and in the manner laid down by the contract to ensure that the tasks arising from the Office's crisis plan are carried out,
(d) monitoring in normal mode during the period after the radiation accident also serves to assess its long-term effects.
(3) The emergency regime is a monitoring in a radiological emergency or a suspected occurrence; and
(a) the permanent and emergency components of the monitoring network are involved;
(b) monitoring in emergency mode commences the monitoring network constituents
1. under the responsibility of the Office under the Office's emergency plan;
2. under the responsibility of the Ministry of Finance, the Ministry of Defence, the Ministry of Interior, the Ministry of Agriculture and the Ministry of the Environment under contract and following the instructions of the Office,
3. under the responsibility of the holder of a permit to operate a Category IV nuclear installation or site where a radiological emergency has occurred, depending on the classification of the status of the installation and in the extent and manner of the monitoring programme and the internal emergency plan,
4. under the responsibility of the contracting parties under a contract to ensure the performance of tasks arising from the Office's crisis plan and following the instructions of the Office;
(c) monitoring in emergency mode is aimed in particular at:
1. confirmation of radiological emergency; in the case of a radiological emergency arising from the territory of the Czech Republic, as well as an estimate of the further development of the radiation accident and the spread of radionuclides around the nuclear installation or site of Category IV where the radiation accident occurred,
2. identification and characterisation of the leakage found,
3. an estimate of the benefits of persons,
4. the assessment of the radiation situation and the preparation of the basis for deciding on measures to reduce or avert the exposure of persons, including the identification of the territory where such measures are recommended in view of the radiological emergency;
5. evaluation of the effectiveness of the safeguards implemented;
6. forecast of the development of the radiation situation,
(d) monitoring in emergency mode takes place in two stages
1. in the first stage, which includes the period before radionuclides escape into the environment, the period when radionuclides escape into the environment, and the period just after the leakage and, in particular, simpler methods of monitoring are used, in particular the measurement of dose inputs and doses; the monitoring is aimed at rapidly obtaining documentation for decision-making on urgent protective measures, (7); and
2. in the second phase, which includes the post-exit period, and more demanding and sensitive methods are used to determine the activity of radionuclides in the environmental components, monitoring is aimed at obtaining documentation to decide on subsequent protective measures, 7)
(e) monitoring in emergency mode is carried out by constituents
1. under the responsibility of the Office in accordance with Table 2 of Part And the annexes to this decree, to the extent and in a manner specified by the Office's crisis plan and as instructed by the Office,
2. under the responsibility of the Ministry of Finance, the Ministry of Defence, the Ministry of Interior, the Ministry of Agriculture and the Ministry of the Environment and the Ministry of the Environment according to Table 2 of Part A of the Annex to this Decree to the extent and in accordance with the terms of the contract and the instructions of the Office,
3. within the scope of the holder of a permit to operate a Category IV nuclear installation or site, to the extent and in a manner specified by the specific legislation and in the monitoring programme and in an internal emergency plan approved by the Authority and as instructed by the Authority,
4. within the scope of the contracting parties as defined in Table 2 of Part A annex to this Order to the extent and in a manner laid down by the Treaty to ensure the performance of the tasks arising from the Office's crisis plan and following the Authority's instructions.
(4) Components of the monitoring network
(a) use methods and procedures within the Authority's competence and transmit the results of the monitoring to the extent and in the manner specified in the Authority's crisis plan;
(b) the Ministry of Finance, the Ministry of Defence, the Ministry of Interior, the Ministry of Agriculture and the Ministry of the Environment shall use methods and procedures to monitor and transmit the results of the monitoring to the Office in the extent and manner specified in the contract;
(c) within the scope of the holder of a permit to operate a nuclear installation or a Category IV workplace, use methods, procedures and transmit the results of the monitoring to the Authority in the extent and manner specified in the monitoring and quality assurance programmes; 10) and the internal emergency plan approved by the Authority,
(d) use methods and procedures for monitoring and transmitting the results of the monitoring to the Authority in the manner and in the manner specified in the contract to ensure the performance of the tasks arising from the Office's crisis plan.
(5) Instruments used in the framework of the monitoring network activity and designated by the Authority shall be regularly calibrated and, if a specific regulation so requires, also checked. 11)
§ 6
Method of data transmission
(1) The monitoring data transmitted to the Office by the data transmission system to the information system shall be transmitted in the form of data files by means of appropriate technical media,
(a) continuously in the case of monitoring by the early detection network;
(b) immediately after the results of the monitoring have been established in other monitoring cases.
(2) In addition, data from emergency monitoring shall be transmitted in a manner specified by the Office.
(3) Data from the information system shall be transmitted from the Office after processing and checking the results of the monitoring in the form of data files by means of appropriate technical media,
(a) for publication in the Czech Republic, or
(b) abroad in accordance with the law and the provisions of the relevant international agreement.2)
§ 7
Ensuring the activities of the monitoring network
In order to coordinate monitoring, data transmission and information system
(a) manage the activities of the permanent components of the monitoring network under normal radiation conditions, in particular coordinating the processing of methodologies for the components of the monitoring network and the activities linked to the development and verification of new monitoring methods;
(b) manage the transition of the monitoring network to emergency mode in the event of a radiological emergency, that is to say it coordinates the activity of the permanent components and activates the emergency components;
(c) manage the activities of the permanent and standby components of the monitoring network in a radiological emergency and ensure that a specific range and monitoring method is established appropriately according to the situation arising;
(d) manage the transition of the monitoring network to normal mode at the end of the radiological emergency, that is to say to coordinate the situation appropriately with the operation of permanent constituents and put an end to the activity of emergency constituents;
(e) manage and determine the extent and manner of involvement of the individual components of the monitoring network that may be implemented under contract, in emergency exercises and in the verification of new monitoring methods.
§ 8
Transitional provisions
(1) The components of the monitoring network under the responsibility of the Ministry of Finance, the Ministry of Defence, the Ministry of Home Affairs, the Ministry of Agriculture and the Ministry of the Environment will ensure their activities under this Decree by 31 December 2004 at the latest.
(2) The transmission of data to the Authority pursuant to Article 6 (1) (a) shall be ensured by the holder of the permit to operate a nuclear installation by 31 December 2004 at the latest.
§ 9
Efficacy
This decree shall take effect on the day of its publication.

Notes to Table 1:
Further details shall be provided in the Authority's emergency plan, the contract to ensure compliance with the Authority's crisis plan and the approved documentation of the authorisation holders.
The measurement time shall be chosen to measure the positive activity of the radionuclides monitored in the sample as far as possible.
All the above values apply to food and feed in its native state.
1) The minimum number of places from the territory of the Czech Republic in the "Food Chain Ingredients" section is the minimum number of sites for which a composite sample is produced from multiple sites of the site. The formation of a composite sample is described in the methodology of the relevant corresponding commodity.
2) Radiation monitoring network component: SVZ - early detection network, MS - mobile groups, TLD - thermoluminescent dosimeters network, MMKO - air contamination sites, LS - laboratory groups, CLMS - central laboratory monitoring network, MMKP - food contamination site, MMKV - water contamination sites, MAS - meteorological service, Les - aviation groups.
3) The dose (dose input) means the value of the dosimetric value (per unit of time) in which the measuring device is calibrated (Sections 3 and 4 of Decree No. 307 / 2002 Coll., on radiation protection, as amended by Decree No. 499 / 2005 Coll.).
4) MDD is of importance to the minimum detectable dose, which is the smallest dose distinguishable from zero, determined as three times the mean quadratic background deviation (i.e. the signal measured when reading the non-irradiated dosimeter).
5) Activity is defined in ČSN ISO 31-9 under 9- 33 and also in ČSN ISO 31-10 under 10- 49; mass activity is defined in CSN ISO 31-9 under item No 9-34; volume activity is defined in CSN ISO 31-9 under item No 9-35.
(6) MDA has the meaning of minimum detectable activity and is defined in Part B of the Annex.
7) Flat activity means the proportion of activity and area sampled.
8) Mixed diet - samples are taken:
(a) commodities which form a substantial part of the food basket (in particular meat, potatoes, cereals, vegetables, fruit or products thereof);
(b) commodities which may be expected to contain higher levels of artificial radionuclides (e.g. forest fruits, forest mushrooms, venison);
c) commodities which are grown for the whole of the Czech Republic, or some region of importance in terms of production or export (e.g. oats, barley, maize, fish, honey or their products).
9) Minimum number of sampling points:
(a) the trading network for commodities referred to in note 8a (a) shall be 5 seats (4 × a year, one-off for each quarter), for commodities referred to in note 8b) and 8c (5 seats (1 × a year, one-off).
(b) for growers and producers, the extent of production and, where appropriate, regional consumption depends and there are at least 2 places for each commodity (for commodities of a seasonal nature, 1 × for the relevant harvest / collection period, for commodities of a non-seasonal nature once each quarter).
10) The data necessary to assess the current meteorological situation in terms of possible spread of radionuclides in the environment transmitted by the Czech Hydrometeorological Institute.

1) The minimum number of places from the territory of the Czech Republic in the "Food Chain Ingredients" section is the minimum number of sites for which a composite sample is produced from multiple sites of the site. The formation of a composite sample is described in the methodology of the relevant corresponding commodity.
2) Radiation monitoring network component: SVZ - early detection network, MS - mobile groups, LES - aviation groups, LPP - aerial means of exploration, TLD - thermal luminescent dosimeters network, MMHP - measuring places at border crossing points, MMU - closing points, LS - laboratory group, MMKO - measuring places of air contamination, MMKV - measuring place of water contamination, MMKP - measuring place of food contamination, CLMS - central laboratory monitoring network, MS - meteorological service
3) Dose (dose input) means the value of the dosimetric value (per unit of time) in which the measuring device is calibrated (Sections 3 and 4 of Decree No. 307 / 2002 Coll., on Radiation Protection, as amended by Decree No. 499 / 2005 Coll.)
4) MDD is of importance to the minimum detectable dose, which is the smallest dose distinguishable from zero, determined as three times the mean quadratic background deviation (i.e. the signal measured when reading the non-irradiated dosimeter).
5) Activity is defined in ČSN ISO 31-9 under 9- 33 and also in ČSN ISO 31-10 under 10- 49;
mass activity is defined in CSN ISO 31-9 under item No 9-34; volume activity is defined in CSN ISO 31-9 under item No 9-35.
(6) MDA has the meaning of minimum detectable activity and is defined in Part B of the Annex. The required sensitivity does not apply to the measurement of the content of radionuclides in foodstuffs for commercial purposes.
7) The MDA values for 131I and 137Cs correspond to the requirement to determine the volume activity of individual radionuclides normally detectable by gamma spectrometry (with energy emitted by photons greater than 100keV and with the representation of photons for a given radionuclide of characteristic energy greater than 10%), which will result in an effective dose (see Section 3 of Decree No. 307 / 2002 Coll., on radiation protection, as amended by Decree No. 499 / 2005 Coll.) not greater than 1µSv per month (see Section 18 of Decree No. 307 / 2002 Coll., on radiation protection, as amended by Decree No. 499 / 2005 Coll.).
8) Flat activity means the proportion of activity and area sampled.
9) For screening use indicators such as total volume beta activity according to ČSN 757612
10) The required MDA values for a particular commodity are determined by the Authority according to the real situation (taking into account the significance of the commodity in the consumer basket and the extent of contamination), while allowing reliable determination of the activity of radionuclides listed in Tables 4 and 6 of Annex 8 to Decree No 307 / 2002 Coll., as amended by Decree No 499 / 2005 Coll. In the case of surface water, proceed as in the case of drinking water.
11) The selection of monitored commodities and the minimum number of sampling points may vary depending on the level of contamination and the size of the affected territory and the relevance of the commodities in the consumer basket.
In the event of an accident outside the territory of the Czech Republic, the control regime for imported food is governed by the same rules as the control of food from commercial food networks in the Czech Republic under normal radiation conditions.
12) Mixed diet - samples are taken:
(a) commodities which form a substantial part of the food basket (in particular meat, potatoes, cereals, vegetables, fruit or products thereof);
(b) commodities for which higher levels of artificial radionuclides can be expected (e.g. forest fruits, forest mushrooms, venison);
(c) commodities grown in terms of production (export) or regionally important for the Czech Republic (e.g. oats, barley, maize, fish, honey or products made thereof).
13) The data necessary to assess the current meteorological situation in terms of possible spread of radionuclides in the environment transmitted by the Czech Hydrometeorological Institute.
14) Meteorological data necessary for predicting the development of the situation in terms of possible spread of radionuclides in the environment, both at the point of escape and its surroundings and throughout the country, whether the leak occurred in the territory of the Czech Republic or outside the territory of the Czech Republic transmitted by the Czech Hydrometeorological Institute.

Determination of minimum detectable activity
The minimum detectable activity at a confidence level of 95% in determining the activity of alpha, beta or gamma (non-spectrometric methods) of the radionuclide shall be determined according to:
