DECLARATION
Ministry of Agriculture
of 21 August 2000
implementing the hop protection law
The Ministry of Agriculture provides pursuant to Section 14 of Act No. 97 / 1996 Coll., on the Protection of Hops, as amended by Act No. 68 / 2000 Coll., hereinafter referred to as "the Act":
§ 1
Hop regions and hop positions
(K § 3 of the Act)
The hop areas and hop positions shall consist of the cadastral territories listed in Annex 1.
Management of hop records
(K § 4 of the Act)
§ 2
(1) The hops are recorded separately for each cadastral territory, broken down into individual entrepreneurs with hops.
(2) The register contains the registration number of the hop plant, the parcel numbers of the land according to the property register, the total, production and auxiliary area of the hop plant, the variety, the category and generation of propagating material, the buckle and the year of the establishment of the hop plant, the name, surname and permanent residence, if the person is a natural person, or the business name and the registered office and identification number (IČO), if the holder is a legal person.
(3) The production area of the hop plant, which is formed at the head of the structure by the coupling of the anchorages at the ground level, is visible in a longitudinal direction at a distance of 1,5 m outside the last set. The parts of the hops outside the production area which form the auxiliary area of the hops shall also be recorded.
§ 3
(1) For each cadastral territory, a separate set of registration numbers shall be maintained by the Central Audit and Examination Institute (hereinafter referred to as the Institute).
(2) The allocated registration number of the hop plant shall be fixed to all four corner pillars of the structure so that it is not damaged by passing mechanical means.
(3) The notice of cancellation of hops shall indicate the cadastral territory, the registration number and the area of the cancelled hops.
Procedure for the labelling of hops and the particulars of the proof of its designation
(Paragraph 6 (1) of the Act)
§ 4
(1) The application for the designation of hops shall be submitted by the hop entrepreneur in writing on a form, a model of which is given in Annex 2.
(2) The Institute carries out on-the-spot labelling of hops for entrepreneurs; to this end, ensure:
(a) determination of the weight of each hops filled with packaging by weighing on certified scales, 1)
(b) seal the top of the packaging,
(c) the fixing of the label on the side of the packaging by two seals;
(d) the registration of the number and weight of each container with hops in the document indicating the hops.
§ 5
Where hops are grown in one of the hop positions, the name shall be indicated on the label under the name of the cadastral territory. In this case, the label has a vertical coloured stripe in the middle of the hop position of the Golden Creek Valley, in the hop position of the Green Underwood and in the hop position of the Polepská Blata blue.
§ 6
The proof of the designation of hops issued by the Institute shall include:
(a) the name of the cadastral territory and district in which the hops are situated;
(b) the area of the hop harvest area;
(c) where the person is a person with hops, the name, surname and permanent residence and the person is a person with hops;
(d) the vintage and variety of hops,
(e) number and number of packages,
(f) the weight of the container with hops and the weight of the container.
§ 7
(1) Where the designated hops are required to be repackaged prior to verification due to a threat to their quality (§ 13) or health (§ 12), the institute shall, upon request of the hop entrepreneur, remove label labels from the hops packaging and, after adjustment and re-packaging, affix new labelling labels according to the original cadastral territory.
(2) Paragraphs 4 to 6 apply mutatis mutandis to the changed hops and to the remaining hops.
Procedure for verifying hops and hop products
(K § 7 of the Act)
§ 8
(1) The application for verification of hops or hop products shall be submitted by the hop entrepreneur in writing on a form, the model of which is set out in Annex 3.
(2) The Institute shall not verify hops or hop products not complying with the health requirements set out in Section 12 and shall also not verify hops if they do not comply with the quality requirements set out in Section 13.
(3) At the same time as the application for the verification of hops and hop products, the hop entrepreneur shall submit the number and numbers of the hop packages applied for by cadastral territory and varieties, or the number and number of the hop products by variety.
§ 9
(1) Hops and hop products are verified by the Institute in space-appropriate, sufficiently illuminated spaces equipped with a certified weight.
(2) At the request of the entrepreneur, the Institute shall carry out verifications at the premises of the entrepreneur, in compliance with the conditions referred to in paragraph 1, in cooperation with him.
(3) Upon submission of the application by the hop entrepreneur, the Institute shall carry out verification of the modified hops or hop products, provided that the mixing of hops and the production of hop products has taken place within a closed circle. The hop operator treating and adjusting hops or producing hop products shall provide the Institute with a complete technological process of production and a diagram of the assembly of hop processing facilities.
(4) For the purposes of verifying hops and hop products, the Institute shall ensure:
(a) checking the completeness of the data on the application for verification of hops and hop products;
(b) checking the origin of hops by labelling and weighing instruments, checking of hop products by certification mark and weighing instruments;
(c) removal of labels and seals from packaging;
(d) supervision of hop treatments and processing of hop products;
(e) sealing and sealing of hops packaging, except granulated and ground hops packaging;
(f) the indication of the packaging with hops indicating whether the hops are prepared or not;
(g) the determination of weight.
§ 10
(1) The certificate for hops and hop products contains, in addition to the information referred to in Article 7 (6) (a) and (b) of the Act: the type of packaging, the number of packages, the number of packages and the weight of the hops or hop products packaging, the method of treatment of hops or hop products, the signatures of authorised staff of the Institute, the stamp of the official, the date and place of issue.
(2) The certificate for hops mixed in accordance with Article 8 (1) (g) of the Act contains, in addition to the information referred to in Article 7 (6) (c) of the Act, the number and type of packages, the number and weight of the hops or hop products packaging, the method of treatment of hops or hop products, the registration numbers of the original certificates, the signatures of the authorised staff of the Institute, the print of the official stamp, the date and place of issue.
(3) One certificate may contain a maximum of 50 packages of hops or hop products.
(4) Written documents on the verification of hops or hop products, as well as the text on the certification mark, the seal and the certificate, if the hops and hop products intended for export are concerned, shall be drawn up and, where appropriate, indicated bilingual, in Czech-German or Czech-English.
§ 11
Records of processed hops

The register kept by the hop-handling operator and the handling of hops or hop products shall include an inventory of hop lots for processing, indicating the weight of the processed product, the weight of the waste and, where appropriate, the weight of other materials and the value of the loss of moisture.
Quality and health requirements for hops
§ 12
[K § 14 (e) of the Act]
Hops must have a characteristic smell, must not be degraded by foreign odours, polluted, moldy, severely damaged by diseases or pests.
§ 13

(2) When hops are processed into hop products, the quality requirements referred to in paragraph 1 shall not be impaired.
Test methods including sampling
[K § 14 (f) of the Act]
§ 14
(1) The evaluation of the quality and health of hops and hop products under Sections 7 and 10 of the Act shall be carried out in accordance with the procedure laid down in Sections 15 and 16.
(2) The quality and health assessment of hops and hop products is carried out on an average sample. The average sample shall be prepared by mixing the incremental samples taken from a single batch of hops. The average sample shall be used to evaluate the quality of the methods set out in Section 16.
§ 15
(1) The incremental samples shall be taken in accordance with Annex 4.
(2) The sampling of incremental samples of unpressed and unpackaged hops is carried out from different locations and from different depths of the pile to obtain an average sample of approximately 200 g.
(3) The partial sample of packed unpressed hops shall be taken by hand after cutting the side seam of the package, alternately from the bottom, middle and upper part of the contents of the package. The proportion of samples from the surface shall not exceed 10% of the total quantity of samples.
(4) The partial sample of hops pressed shall be taken manually after the upper part of the packaging has been cut out by cutting the hops. The proportion of samples from the surface shall not exceed 10% of the total quantity of samples.
(5) The average sample of hops shall be prepared by homogenising the incremental samples and dividing them into an average sample of approximately 200 g. The sample shall be protected from light and stored dry at temperatures below 5 ° C.
(6) Samples of hop extract shall be taken after heating the contents of the container to 40 ° C and homogenisation of the extract.
§ 16
(1) In case of doubt, determination of the water content of the hop sample shall be carried out in a manner consistent with the procedure set out in ČSN 46 2520-3.
(2) The determination of the proportion of foreign component in the hop sample shall be carried out in a manner consistent with the procedure set out in ČSN 46 2520-4.
(3) The determination of the proportion of hops in the hop sample shall be carried out in a manner consistent with the procedure laid down in the CSN 46 2520-5, with the addition of parts of stalks of more than 25 mm in the hop component.
§ 17
Import of hops and hop products
(K § 9a of the Act)
(1) Imported hops and hop products must meet the health requirements laid down in Section 12 and the quality requirements of the certified hops set out in Section 13.
(2) A hop operator who has imported hops or hop products shall communicate to the Institute the details of the subject matter of the import in the Notice of import of hops or hop products, a model of which is given in Annex 5. This notification shall be submitted by the importer in the original Institute and shall keep a copy for 3 years from the date of import.
(3) Each consignment of hops must bear on each package an indication of whether the hops are prepared or not, followed by an indication of the country of origin, variety, vintage year, packaging number. Each delivery of hop products shall bear on each package a description of the product type, country of origin, variety, vintage year, packaging number. The inscriptions shall be indelible on the outer part of the package.
(4) The Institute shall carry out regular checks to ensure that deliveries comply with minimum quality requirements for hops, at least 5% of the deliveries. The Institute shall report to the Ministry of Agriculture on the outcome of the checks.
(5) The provisions of paragraphs 1 to 4 shall not apply to small packages of up to 1 kg for hop heads, hop powder and mixed hop product, or small packages of up to 300 g for hop extract intended for the importer's own consumption, for scientific and technical research, for fairs with special customs procedure. In such cases, the packaging shall bear a marking, weight and end use.
§ 18
Repeal
Decree No. 162 / 1996 Coll., implementing the Act on the Protection of Hops, is hereby repealed.
§ 19
Efficacy
This decree shall take effect on the day of its publication.
