DECLARATION
of 20 October 2011
amending Decree No. 104 / 1997 Coll., implementing the Road Law, as amended
The Ministry of Transport provides for the Act No. 13 / 1997 Coll., as amended by Act No. 102 / 2000 Coll., Act No. 132 / 2000 Coll., Act No. 489 / 2001 Coll., Act No. 256 / 2002 Coll., Act No. 259 / 2002 Coll., Act No. 320 / 2002 Coll., Act No. 358 / 2003 Coll., Act No. 186 / 2004 Coll., Act No. 80 / 2006 Coll., Act No. 347 / 2009 Coll., Act No. 152 / 2011 Coll., Act No. 311 / 2006 Coll., Act No. 97 / 2009 Coll., Act No. 227 / 2009 Coll.
Decree No. 104 / 1997 Coll., implementing the Road Act, as amended by Decree No. 300 / 1999 Coll., Decree No. 355 / 2000 Coll., Decree No. 367 / 2001 Coll., Decree No. 555 / 2002 Coll., Decree No. 490 / 2005 Coll. and Decree No. 527 / 2006 Coll., are amended as follows:
1. In Paragraph 6 (1), the second sentence is replaced by the sentence "The inspections are divided into ordinary, main, exceptional and security inspections of communications included in the trans-European road network (16)."

2. the following Section 7a is inserted after Section 7, including the title and footnote 17:
Security inspections
(1) Security inspection17) means the assessment of the impact of road safety communication on road safety and the evaluation of risks arising from road users' communication characteristics. The security inspection shall be carried out by the owner or manager of the communication included in the trans-European road network. The safety inspection shall be carried out by the infrastructure safety auditor together with at least one other natural person.
(2) Security inspections are carried out every 5 years.
(3) The minimum scope of the security inspection is set out in Annex 11.

3. After Paragraph 36, the following Sections 37 to 38b are inserted:
Minimum scope of infrastructure safety audit
The minimum scope of the road safety audit (17) is set out in Annex 12.
Areas related to road safety audit
The fields related to the audit of road safety are transport construction and transport engineering.
Scope and content of training of road safety auditors
(1) The scope of training to obtain the necessary knowledge, skills and procedures for carrying out an audit on road safety is 40 hours. Training is focused on
(a) accident theory and road safety;
(b) the formation of roads safe for road users; and
(c) legal and technical standards governing road safety and road safety audit.
(2) The training consists of theoretical teaching in the range of 24 hours, practical teaching in the range of 16 hours and the processing of case studies.
(3) Regular training shall be carried out in the form of theoretical instruction of 16 hours, with a focus on deepening and maintaining the knowledge acquired under paragraph 2.
Test to demonstrate the competence of road safety auditors
(1) The test to demonstrate the competence of the infrastructure safety auditor consists of a written test and an oral interview before the examination committee.
(2) The written test shall consist of 45 questions divided into 3 groups according to the thematic training courses referred to in Section 38a (1). Each group consists of 15 questions. Each question is assigned 4 possible answers, of which only 1 is correct. Each correct answer is evaluated by 1 point.
(3) The oral interview shall consist of open questions to examine the deeper knowledge of the thematic headings referred to in paragraph 2 and the interconnections.
(4) The result of the whole test shall be assessed by the degree "benefit 'or" benefit'. At least 39 points should be obtained in the test and the questions from at least two thematic circuits in the oral interview should be answered correctly.
(5) The test result report shall contain:
(a) the designation "report on the outcome of the test to demonstrate the professional competence of the infrastructure safety auditor,"
(b) the name and, where appropriate, the name, surname, date of birth and address of residence of the tested person;
(c) the place and date of the examination;
(d) the total test result; and
(e) the names, surnames and signatures of all members of the Examination Committee. ';
4. After Paragraph 40, the following Section 40a is inserted:
Amount of compensation for providing police escort
(1) The amount of compensation for providing a police escort is set at the sum of CZK 600 for each calendar day for which a police escort has been provided and the total amount of additional costs associated with providing a police escort.
(2) The additional costs of providing a police escort are:
a) 400 CZK for 1 hour of service of a police officer who participated in a police escort,
b) 15 CZK per 1 km of service vehicle of the Police of the Czech Republic, which was used in police escort, and
(c) the purchase price of the material consumed by the Police of the Czech Republic in a police escort, excluding fuel. "
5. Article 47a shall be deleted, including the title.
6. The following Annex 11 is added:

Minimum scope of security inspection
1. Verification of available transport engineering characteristics (e.g. speed, density, intensity)
2. Verification of the width of the communication area, including the way in which communication is transferred to the built-up territory
3. Assessment of directional and height lines
4. Assessment of the arrangement of the intersection (view ratios, connecting and turning lanes) and vehicle movements at the intersection
5. Assessment of road and road conditions (e.g. skid resistance, drainage, surface quality)
6. Assessment of parking and parking spaces
7. Assessment of the accuracy of the use and execution of road signs and accessories, including light signalling equipment used to control traffic in the motorway and road section
8. Assessment of lighting
9. Assessment of existing fixed obstacles and applications of passive safety elements (e.g. supporting structures, greenery, advertising equipment, dangerous shape of ditch, rails, railing)
10. Assessment of the safety of all road users and visibility under different conditions (e.g. darkness, weather conditions)
11. Assessment of level crossings (e.g. vertical and horizontal traffic signs, view ratios, angle of cross-border crossing, crossing safety)
12. Assessment of the impact of work on road safety communication
13. Conclusions and Recommendations'.

Minimum scope of infrastructure safety audit
I. Criteria for assessing draft project documentation
1. Clear and general situation of communication construction, seasonal and climatic conditions and weather conditions
2. Assessment of the arrangement of crossroads and level crossings (e.g. level crossings) and their distances
3. Assessment of the width of the communication area
4. Assessment of the suitability of the selected communication design category with regard to downstream sections and expected track and traffic current intensity
5. Assessment of the integration of the construction in question into the existing network, including an assessment of the impact on communication safety
6. Assessment of basic transport engineering characteristics of the proposed construction (e.g. speed, density, intensity)
7. Assessment of route direction and height lines and their combinations
8. Examination of view ratios
9. Evaluation of the way in which communication is transferred to the built-in territory
10. Assessment of the needs of all road users (pedestrians, cyclists, motorcyclists, drivers of passenger and freight vehicles and persons with reduced mobility)
11. Assessment of the possibilities and impacts of public transport
II. Criteria for assessing project documentation design
1. Assessment of parameters of design elements, including ground body and drainage
2. Assessment of the correctness, logical continuity and consistency of vertical and horizontal traffic markings, including assessment of the possibility of overtaking
3. Examination of view ratios
4. Evaluation of the immediate surroundings of communication and fixed obstacles
5. Assessment of lighting
6. Assessment of Green Elements
7. Assessment of the needs of all road users (pedestrians, cyclists, motorcyclists, drivers of passenger and freight vehicles and persons with reduced mobility)
8. Assessment of parking and parking spaces
9. Assessment of applications of passive safety elements (e.g. intermediate separation belts and collision barriers designed to prevent risks to vulnerable road users)
10. Assessment of possible local and transitional arrangements for communication
11. Assessment of the results of the previous phase of the infrastructure safety audit
III. Criteria for assessing the construction carried out for the test operation
1. Assessment of the safety of all road users and visibility under different conditions (e.g. darkness, weather conditions)
2. Assessment of the accuracy of the use and execution of road signs and accessories, including light signalling equipment used to control traffic in the motorway and road section
3. Assessment of road state
4. Verification of drainage
5. Assessment of existing fixed obstacles
6. Verification of visibility and viewing conditions
7. Assessment of applications for passive safety elements
8. Assessment of Green Elements
9. Assessment of the results of previous phases of the infrastructure safety audit
IV. Criteria for assessing completed construction for approval
1. Overall Road Safety Assessment
2. Situation of broader communication relations
3. Assessment of the needs of all road users (pedestrians, cyclists, motorcyclists, drivers of passenger and freight vehicles and persons with reduced mobility)

5. Evaluation of the immediate surroundings of communication and fixed obstacles
6. Assessment of Passive Safety Elements Applications
7. Assessment of the accuracy, consistency and logic of the road signs
8. Assessment of the results of previous phases of the infrastructure safety audit '.
Efficacy
This decree shall take effect on the day of its publication.
