GOVERNMENT REGULATION
of 20 December 1995
on the adjustment of compensation for loss of earnings after invalidity or invalidity
The Government hereby orders pursuant to Paragraph 447 (3) of the Civil Code:
(1) The compensation for loss of earnings after the cessation of incapacity for work or invalidity (hereinafter referred to as "compensation for loss of earnings"), belonging to civil law, is adjusted by increasing the average profit for the calculation of compensation for loss of earnings and, where appropriate, increased in accordance with the earlier rules (1) at the request of the injured party as follows:
(a) by 12,5% for the second half of 1993,
(b) by 3% for the first half of 1994,
(c) 16% for the second half of 1994,
(d) by 3% for the first half of 1995,
(e) 14,5% for the second half of 1995.
(2) Where entitlement to compensation for loss of earnings has arisen during one of the half-years referred to in paragraph 1, the average profit for calculating the loss of earnings shall not be increased for that half-year.
For compensation for loss of earnings, even after adjustment made pursuant to § 1, Article 2 (1) (c) shall apply. In Act No. 160 / 1993 Coll., amending and supplementing the Act of the Czech National Council No. 589 / 1992 Coll., on Social Security Insurance and Contribution to State Employment Policy, as amended by the Act of the Czech National Council No. 10 / 1993 Coll., and some other laws.
Compensation for loss of earnings adjusted under this Regulation shall be due from 1 January 1996.
This Regulation shall enter into force on the day of its publication.
