of 27 August 2009
on the holding of animals temporarily or permanently unable to survive in the wild and the care of such animals in rescue stations (Disabled Animal Regulation)
The Ministry of the Environment provides pursuant to § 5 (10) of Act No. 114 / 1992 Coll., on Nature and Landscape Protection, as amended by Act No. 312 / 2008 Coll.:
This decree sets out the detailed conditions for the holding of animals unable to survive temporarily or permanently in the wild (hereinafter referred to as the "handicapped animal '), in rescue stations, in particular with regard to the possibility of involving those animals back in wild populations, and the manner in which they are cared for.
Other circumstances referred to in Article 1 shall mean the weakening of a parasite animal, starvation or signs of poisoning, the occurrence of an animal belonging to a migratory or hibernating species at an inappropriate time of year, or the violation of natural behavioural patterns; natural behavioural patterns are species or sex-specific behavioural patterns occurring in animals born and resident in the wild, in particular shyness, the ability to perform natural movement activities, the ability to receive and provide natural food, the ability to respond to and communicate with individuals of their species and the ability to defend territory and to respond to natural enemies.
Rescue station in the care of temporarily handicapped animals
(a) ensure that there is no excessive contact with humans, natural predators or individuals of domesticated species which could jeopardise the ability of handicapped animals to respond to natural enemies; in particular, the contact necessary for the treatment or feeding of handicapped animals and, where appropriate, for the necessary cleaning of premises intended for their possession shall not be regarded as excessive contact with humans;
(b) ensure that they are fed in accordance with the biological requirements of the species concerned; food corresponding to the biological requirements of the species is natural or similar, including the possibility of submitting live prey to predators;
(c) ensure that the care of young birds and certain mammals is taken, if appropriate, by immediate introduction to nests in nature, or by rearing in a rescue station with adoptive parents of the same or closely related species; in the case of artificial breeding of pups without adoptive parents, those pups shall be placed close to those of the same species when kept in a rescue station;
(d) respect the natural social structure of the species in the breeding of the pups and the holding of adult individuals, in particular to ensure the rearing of the pups and the holding of adults in the natural groups or pairs, as far as is appropriate and without prejudice to their health, sexual activity or social status;
(e) adapt the environment for the holding of temporarily handicapped animals in such a way as to correspond as far as possible to their natural biotope and species requirements, in particular with regard to movement activities and the need for shelter.
The rescue centre may use permanently handicapped animals in environmental education only for the purpose of informing the public of the causes and consequences of threats and appropriate animal protection practices.
(1) Handicap animals must be properly prepared before they are involved in wild populations; they must be placed in such a physical and psychological state that neither the medical condition nor any identifiable obstacles prevent them from being fully involved in life in the natural environment.
(2) As part of the preparation of handicapped animals to be involved in wild populations, the rescue station shall, where possible, ensure that they are kept in an area overlooking the surroundings, as far as possible overlooking an environment consistent with the natural biotope or the conditions at the place of the expected discharge.
(3) Only animals that are in good health, without the consequences of damage, injury or illness that would make life in the natural environment impossible and retain natural behavioural patterns, without malpractice and printing ("cured animal ') may be released into the wild.
(4) The release of treated animals into the wild must not jeopardise the health of wild individuals or populations and disrupt the population or social structure of the wild population.
(5) The release of treated animals into the wild is possible only within the area of the population of the species. For species occurring in smaller fragmented populations or producing geographically and genetically specific forms, in particular invertebrates, fish, amphibians and reptiles, the release is only possible in the area of the occurrence of the genetically related population to the released individuals.
(6) The rescue station shall ensure that treated animals are released into the wild preferably at the place where they were found. If this site is not known, or is inappropriate for other reasons to be released, the rescue station will release the treated animals into another suitable environment which meets the needs of the species and which will ensure the possibility of feeding and surviving the released animals. It is possible to release treated animals into another suitable environment only after the risk of repeated injury or stress that could occur immediately after the release.
(7) The discharge of treated animals may only be in the annual period corresponding to the period of activity of the species.
This Decree shall take effect on 1 October 2009.
