of 27 August 2025

amending Decree No 79 / 2022 Coll., on technical and economic parameters for the determination of reference ransom prices and green bonuses and implementing certain other provisions of the Act on Supported Energy Sources (Technical and Economic Parameters), as amended

According to Article 53 (2) (a), (b) and (l) of Act No. 165 / 2012 Coll., on Supported Energy Sources and on the Amendment of Certain Acts, as amended by Act No. 131 / 2015 Coll. and Act No. 382 / 2021 Coll.:

Čl. I

Decree No. 79 / 2022 Coll., on Technical and Economic Parameters for the Determination of Reference Ranking Prices and Green Bonus and on the Implementation of Certain Other Provisions of the Act on Supported Energy Sources (Technical and Economic Parameters Order), as amended by Decree No. 275 / 2023 Coll. and Decree No. 371 / 2024 Coll., is amended as follows:

1. In Paragraph 2 (4), the words "as set out in Annex 1 to this Decree 'are deleted.

2. Annexes 1 and 2, including footnote 1, read:

The specific operating costs of emission allowances shall be determined according to the formula:

Nep = (1 - BAP) × ETScene × EFCO2,

where

N_ep	[Kč/GJ] je měrný provozní náklad na emisní povolenku,
BAP	[-] je hodnota 0,1 odpovídající průměrné bezplatné alokaci emisních povolenek ve výši 10 % pro výtopny a teplárny (z celkového počtu vyřazených emisních povolenek za kalendářní rok),
ETS_cena	[Kč/tCO₂] je cena emisní povolenky na Evropské energetické burze (EEX), která se stanoví jako vážený průměr závěrečných cen (settlement price) produktu EUA Spot za období leden až červen kalendářního roku pro IV. obchodovací období, ve kterém se stanovuje výše provozní podpory; ceny jsou převedeny z EUR/tCO₂ na Kč/tCO₂ podle devizových kurzů vyhlášených Českou národní bankou pro příslušné dny,
$E F_{C O_{2}}$	[tCO₂/GJ] je hodnota emisního faktoru 0,1 tCO₂/GJ podle jiného právního předpisu¹⁾.

Čl. II

Transitional provision

For electricity, heat and biomethane plants put into service or upgraded from 1 January 2025 to 31 December 2025, the technical and economic parameters referred to in Decree No 79 / 2022 Coll., as effective before the date of entry into force of this Decree, shall apply.

Čl. III

Efficacy

This Decree shall take effect on 1 January 2026.
