DECLARATION
of 17 December 2018
on strategic noise mapping
The Ministry of Health provides, pursuant to § 108 (1) for the implementation of § 80 (1) (s) of Act No. 258 / 2000 Coll., on the Protection of Public Health and on amendments to certain related laws, as amended by Act No. 392 / 2005 Coll., Act No. 222 / 2006 Coll., Act No. 151 / 2011 Coll., Act No. 223 / 2013 Coll., Act No. 267 / 2015 Coll. and Act No. 202 / 2017 Coll.:
Initial determination
This Decree implements the relevant European Union Regulations (1), following the directly applicable European Union6) and regulates the limit values for noise indicators, their calculation for noise generated by road, rail, air and noise from integrated prevention facilities (2) (hereinafter referred to as "integrated equipment '), the essential requirements for the content of strategic noise maps and action plans (hereinafter referred to as" strategic noise mapping'), the details of how the public is informed of strategic noise maps, the preparation of draft action plans and the participation of the public and the action plans drawn up.
Noise indicators and their limit values
(1) The harmful effects of noise are the effects which are adverse to human health, noise harassment and the feeling of discomfort arising from noise exposure to persons exposed to the noise indicator values set out in Annex 4 to this Decree.
(2) Noise indicators for strategic noise mapping are noise indicators for day-night (Ldvn), day (Ld), evening (Lv) and night (Ln). The method of calculation of noise indicators is laid down in Annex 1 to this Decree.
(3) The noise indicators referred to in paragraph 1 correspond to those defined by the European Union Regulation governing the assessment of outdoor noise (3) (hereinafter referred to as the Directive), by:
(a) for the evening-night (Ldvn) under this Decree, the indicator Lden corresponds to the directive,
(b) for the day (Ld) according to this decree, the Lday indicator corresponds to the Directive,
(c) for the evening (Lv) according to this decree, the Levening indicator corresponds to the directive; and
(d) for night (Ln) according to this decree, the indicator Lnight corresponds to the indicator Lnight according to the Directive.
(4) Noise indicator for:
a) day-evening (Ldvn) is a noise indicator for all-day noise harassment,
(b) day (LD) is a noise indicator for noise harassment during the day;
(c) evening (Lv) is a noise indicator for noise harassment during the evening;
(d) night (Ln) is a noise indicator for sleep interference.
(5) For noise indicators for day-night (Ldvn) and night (Ln) the following limit values are set:
(a) for road transport Ldvn is equal to 70 dB and Ln is equal to 60 dB;
(b) for rail transport Ldvn is 70 dB and Ln is 65 dB;
(c) for air transport Ldvn is equal to 60 dB and Ln is equal to 50 dB;
(d) for integrated Ldvn devices is 50 dB and Ln is 40 dB.
Strategic noise maps
(1) The strategic noise map contains a map, tabular and text section describing the current noise situation, the number of persons, buildings for housing, schools and sleeper health facilities exposed to the noise indicators set out in Annex 1 to this Regulation in the area for which the strategic noise map is drawn up.
(2) The essential requirements for the content of strategic noise maps are set out in Annex 2 to this Decree.
Information to the public on strategic noise maps
Strategic noise maps are made available to the public by the Ministry of Health on its website in the form of open data allowing viewing and downloading of data. 6), 7)
Action plans to reduce the harmful effects of noise
(1) The action plan contains a map, table and text section.
(2) The essential requirements for the content of the action plans are set out in Annex 3 to this Decree.
Information to the public on action plans
(1) The Ministry of Transport and the Regional Authorities (hereinafter referred to as the "Buyer") make available draft action plans and already adopted action plans on their website.
(2) The contracting authority shall publish, in accordance with paragraph 1, the arrangements for evaluating the public's initiatives and opinions on draft action plans.
Repeal
Decree No. 523 / 2006 Coll., laying down the limit values for noise indicators, their calculation, the essential requirements for the content of strategic noise maps and action plans and the conditions for public participation in their preparation (Noise Survey Order), shall be deleted.
Efficacy
This decree shall take effect on the day of its publication.

Calculation of noise indicators
Noise indicators related to the harmful effect of noise shall be calculated;
1. harmful effects of noise are the effects which are unfavourable to human health, noise harassment, the feeling of discomfort arising from noise exposure to persons exposed to noise indicators in accordance with Annex 2 to this Decree,
2. dose-effect relationship means the relationship between the value of the noise indicator and its harmful effect;
3. the value of the noise indicator for the day-evening (Ldvn) in decibels (dB) is defined by the formula
Ldvn = 10 * lg12412 * 10Ld10 + 4 * 10Lv + 510 + 8 * 10Ln + 1010
where
Ld is the long-term average of the sound pressure level weighted by function A according to Czech technical standard4) determined for all daily periods of one year,
The lion is the long-term average of the sound pressure level weighted by function A according to the Czech technical standard4) for all evening periods of one year,
Ln is the long-term average of the sound pressure level weighted by function A according to Czech technical standard4) for all night periods of one year
and where
the day is 12 hours between 6.00 and 18.00 hours; the evening is 4 hours between 18: 00 and 22: 00; the night is 8 hours between 22.00 and 6.00 hours and the year is the relevant calendar year in terms of noise emission and the average year in terms of weather conditions.
4. When calculating the noise indicator, account shall be taken of a sound incident which does not contain sound reflecting from the circumference of the protected object concerned. In the case of verification of the values of this noise indicator, the value of 3 dB shall be deducted from the values measured for the circuit shell.
5. In the case of a calculation for the purposes of strategic noise mapping with regard to the exposure of persons to noise in and near buildings, the assessment point shall be at a height of 4,0 m above the terrain, according to the calculation methods set out in Annex II to Directive 2002 / 49 / EC of the European Parliament and of the Council on the assessment and control of noise in the outdoor environment, in the version in force (hereinafter referred to as the "calculation methods').
6. Other heights may be chosen for the acoustic planning and definition of noise zones, in particular for rural areas with single-storey houses, the design of local measures designed to reduce noise load on certain housing structures or detailed noise mapping in a defined area, with the aim of identifying the level of exposure to noise levels as set out in Annex 2 to this Decree. However, in such cases the assessment points shall never be less than 1,5 m above the terrain.
7. For the calculation of noise values Ldvn and Ln shall be used for road, rail and air noise and for industrial noise specified calculation methods.
Only software containing a declaration of proven compliance with this software with specified calculation methods shall be used for this calculation.

Essential requirements for the content of strategic noise maps
1. General
The strategic noise map represents a noise situation in the 5dB bands (hereinafter referred to as the "relevant 5dB bands'), namely:
(a) for the Ldvn noise indicator, the values 50,0- 54,9; 55,0- 59,9; 60,0- 64,9; 65,0- 69,9; 70,0- 74,9; > 75,0 dB;
(b) for the noise indicator Ln values 40,0- 44,9; 45,0- 49,9; 50,0- 54,9; 55,0- 59,9; 60,0- 64,9; 65,0- 69,9; > 70,0 dB.
The map part is obtained separately for the Ldvn noise indicator and for the Ln noise indicator.
1.1. The map section shall contain at least the following information:
1.1.1. Ldvn noise indicators in 5dB bands.
1.1.2. Noise indicators Ln in 5dB bands.
1.1.3. Display the boundaries of the municipalities and their name around the source of noise.
1.1.4. Display the noise sources that are the subject of the calculation.
1.1.5. Display buildings around noise sources.
1.1.6. Display critical points.
1.2 The table section shall contain at least the following information:
1.2.1. Estimated number of persons affected in the relevant 5dB bands.
1.2.2. Estimated number of noise-affected housing structures in the corresponding 5dB bands.
1.2.3. Estimated number of noise-affected housing structures with a silent facade in the relevant 5dB bands, if any; a silent façade means a façade where the value of Ldvn at a height of 4 m above the ground and 0,1 m before the façade is more than 20dB lower for noise from a specific source than that of a façade with the highest value of Ldvn and simultaneously Ldvn is less than 55dB.
1.2.4. The estimated number of noise-affected housing buildings with special noise-response measures in the relevant 5dB bands, where available; a special noise prevention measure means protection against one or more types of noise in the environment, in combination with such ventilation or air conditioning equipment, in order to maintain high noise protection values.
1.2.5. Estimated number of school buildings affected by noise in the corresponding 5dB bands.
1.2.6. Estimated number of noise-affected buildings in the corresponding 5dB bands.
1.2.7. In the cases referred to in points 1.2.1. to 1.2.6. the number of persons and housing structures exceeding the noise limit values.
1.2.8. Total area of territory in km2 exposed to Ldvn > 55 dB, Ldvn > 65 dB, Ldvn > 75 dB.
1.2.9. Total number of people exposed to Ldvn > 55 dB, Ldvn > 65 dB, Ldvn > 75 dB.
1.2.10. Total number of housing buildings exposed to Ldvn > 55 dB, Ldvn > 65 dB, Ldvn > 75 dB.
The data referred to in points 1.2.1. to 1.2.6. of this Annex shall be structured by region for each source, followed by the municipality code and the name of the municipality according to the Numerical of the municipalities of the Czech Statistical Office and, where applicable, by sections, including the sum for the whole Czech Republic.
1.3. The text part shall contain at least the following information:
1.3.1. Identifying information of the customer and processor (name, address, IČO).
1.3.2. A brief description of the territory under consideration.
1.3.3. Description of the materials for processing the strategic noise map and their source.
1.3.4. Description of the methodology for processing the strategic noise map.
1.3.5. Evaluation of uncertainties of calculation.
1.3.6. Identification of critical points on the basis of exceeding noise limit values. In the case of the accumulation of noise of the same category of sources of different operators, on the basis of the data available, their share and the impact of each source shall be determined as a basis for the processing of the noise action plans. Critical locations shall then be determined on the basis of contributions from all noise sources of the same categories.
2. Strategic noise maps for agglomeration
Strategic noise maps for roads, major roads, railways, major railways, airports, major airports and integrated equipment2 are available in the conurbations. A total strategic noise map showing the current effects of all these sources of noise in the agglomeration is also taken.
The strategic noise maps for agglomeration shall include, in addition to the requirements set out in point 1:
2.1. Name and brief description of the association: location, size, population, description of the transport network including public transport, airport code International Civil Aviation Organisation.
2.2. List and content of the noise protection programmes and anti-noise measures so far implemented.
2.3. The sum map shall not include the data referred to in paragraphs 1.2.7 to 1.2.10 of this Annex.
2.4. The data referred to in points 1.2.1. to 1.2.6 shall be structured for individual sources in municipalities with the village code and the name of the municipality according to the Numerical of the municipalities of the Czech Statistical Office, including the sum for the whole agglomeration.
3. Strategic noise maps for major roads, major railways and major airports shall include, in addition to the requirements set out in point 1:
3.1 General description of major roads, main railway lines or major airports outside the agglomeration: identification, section number, traffic data, airport code of the International Civil Aviation Organisation.
3.2 Ambient characteristics: built and unbuilt part of the village territory, information on land use and other significant sources of noise.
3.3 The list and content of the noise protection programmes and anti-noise measures so far implemented.

Basic requirements for the content of action plans
1. The action plan shall include at least the following information:
1.1. Identifying information of the customer and processor (name, address, IČO).
1.2. Title of the Action Plan.
1.3. Definition of the territory for which the action plan is established.
1.4. Address of the website on which the action plan is located.
1.5. Description of the source of noise. In the case of traffic noise, the identification of the communication sections for which the action plan is taken is also part.
1.6. All applicable noise limit values pursuant to Section 2.
1.7. Summary of results of strategic noise mapping - estimated number of buildings for housing, schools and berths exposed to noise indicators listed in Annex 2 to this Decree, in the area for which an action plan is being drawn up.
1.8. Evaluation of the harmful effects of noise on the population on the basis of the relationship between dose and effect referred to in Annex 4 to this Decree.
1.9. Evaluation of the estimation of the number of persons exposed to noise, definition of the problems and situations to be improved.
1.10. All noise reduction programmes implemented, implemented or approved so far, indicating the start and end dates of their implementation, including the announcement of silent areas in the agglomeration, and the estimates of the reduction in the number of people exposed to noise at the time of the day and night that these programmes will bring.
1.11. Measures which the purchasers plan to take or implement over the next five years, indicating the date of the envisaged start and end, including proposals for the announcement of silent areas in the agglomeration and measures to protect them.
1.12. Long-term noise protection strategy.
1.13. Economic information: estimation of costs and assessment of their efficiency, assessment of noise protection costs and benefits, in particular with regard to the number of persons who have reduced noise.
1.14. Results of public consultation, number of consultations in total and number of comments received.
1.15. Spatial demarcation of quiet areas in the agglomeration.
1.16. Summary of the most important facts mentioned in the Action Plan.

Methods for the evaluation of harmful effects
1. File of harmful effects
The assessment of harmful effects shall take into account:
1.1. Ischemic heart disease corresponding to codes BA40 to BA6Z International Statistical Classification of Diseases and Associated Health Problems (MKN-11),
1.2. High noise harassment,
1.3. High sleep disturbance.
2. Calculation of harmful effects:
2.1. Relative risk of harmful effects defined as
RR = Likelihood of harmful effects in the population exposed to specific noise levels in the outdoor environment The probability of harmful effects occurring in a population not exposed to outdoor noise

2.2. Absolute risk of harmful effects defined as

2.3. Ischemic heart disease
The following dose-effect relationships shall be used to calculate the relative risk to noise as regards the harmful effect of coronary heart disease and the incidence rate:

2.4. High noise pollution
2.4.1. For the calculation of absolute risk (AR) for road noise as regards the harmful effect of high noise harassment, the following dose-effect relationships shall apply:
ARHA, road = (78,9270 - 3,1162 * Ldvn + 0,0342 * L2dvn) / 100
where
ARHA, road is the absolute risk of harmful effects of high noise pollution for road traffic noise, and
Ldvn is a noise indicator for all-day noise harassment from road transport.
2.4.2. In order to calculate the absolute risk to rail noise as regards the harmful effect of high noise pollution, the following batch-to-effect relationships shall apply:
ARHA, rail = (38,1596 - 2,05538 * Ldvn + 0,0285 * L2dvn) / 100
where
ARHA, rail is the absolute risk of the harmful effect of high noise pollution for rail noise; and
Ldvn is a noise indicator for all-day noise harassment from rail transport.
2.4.3. In order to calculate the absolute risk to air traffic noise as regards the harmful effect of high noise pollution, the following batch-to-effect relationships shall apply:
ARHA, air = (-50,9693 + 1,0168 * Ldvn + 0,0072 * L2dvn) / 100
where
ARHA, air is the absolute risk of harmful effects of high noise pollution for air traffic noise; and
Ldvn is a noise indicator for all-day noise harassment from air transport.
2.5. High sleep disturbance
For the calculation of absolute risk (AR) as regards the harmful effect of high sleep disturbances, the following dose-effect relationships shall apply:
2.5.1. For road traffic noise:
ARHSD, road = (19,4312 - 0,9336 * Ln + 0,0126 * L2n) / 100
where
ARHSD, road is an absolute risk of harmful effects of high sleep disturbances for road traffic noise; and
Ln is a noise indicator for noise interference from road transport.
2.5.2. For rail noise:
ARHSD, rail = (67,5406 - 3,1852 * Ln + 0,0391 * L2n) / 100
where
ARHSD, rail is an absolute risk of harmful effects of high sleep disturbances for rail noise, and
Ln is a noise indicator for noise interference from rail transport.
2.5.3. For air traffic noise:
ARHSD, air = (16,7885 - 0,9293 * Ln + 0,0198 * L2n) / 100
