amending Act No. 26 / 2000 Coll., on public auctions, as amended, and certain other laws
Parliament has decided on this law of the Czech Republic:
Amendment of the Trade Act

1. In the first sentence of Paragraph 52 (1), the words "together with all the documents submitted by the applicant for the concession which are necessary to deliver an opinion 'shall be inserted after the words" submit an application for a concession'.
2. In Annex 3 to the CONCESTED LIFE of group 314 "Other ', column 1, at the end of the text" Implementation of public auctions', the words "(a) voluntary, (b) non-voluntary 'are added.
The text in column 2 reads: "for the performance of public auctions of voluntary: (a) higher education and 1 year of experience in auctioning or real estate activities, or (b) secondary education and 5 years of experience in auctioning or real estate activities, or (c) documents pursuant to § 19 (1) (e) of the Act 18 / 2004 Coll., and 6 years of experience in auctioning or real estate activities, or (c) documents pursuant to § 19 (1) (e) of the Act 18 / 2004 Coll., on the recognition of professional qualifications'.
The text in column 5 reads: "§ 6 paragraph 1 of Act No. 26 / 2000 Coll., on Public Auctions."
Transitional provisions
1. (b) voluntary, unless otherwise specified.
2. The Trade Authority shall, at the request of an entrepreneur who, at the date of entry into force of this Act, shall issue a business with the subject of "Implementation of public auctions' and who intends to continue to conduct only public auctions on a voluntary basis, a new concession with the subject of" Implementation of public auctions a) voluntary '. The issue of a new concession instrument shall not be subject to an administrative fee.
3. Persons who, under existing legislation, are entitled to an activity which is the licensed business of the "Implementation of public auctions' and who intend to continue to carry out public auctions on a voluntary basis, shall, within 1 year of the date of entry into force of this Act, submit to the Trade Union Office evidence of professional competence if the Trade Union Office is not already available from previous procedures and demonstrate compliance with the conditions laid down in Section 6 (1) of Act No. 26 / 2000 Coll., as effective from the date of entry into force of this Act. Where such persons provide evidence and fulfil the conditions set out in the first sentence of this paragraph, the trade mark office shall issue a decision amending the decision granting the concession and issue a concession note with the revised particulars. If these persons do not do so, the business office shall issue a decision amending the decision granting the concession and shall issue a concession note in the scope of the public auction voluntary. Such acts shall not be subject to an administrative fee.
4. The procedure for the award of the concession "Implementation of public auctions" initiated before the date of entry into force of this Act shall be completed in accordance with Act No. 26 / 2000 Coll., as effective from the date of entry into force of this Act.
Amendment of the Civil Code
In Article 35 (1) of Act No. 99 / 1963 Coll., Civil Code, as amended by Act No. 133 / 1982 Coll., Act No. 519 / 1991 Coll., Act No. 360 / 1999 Coll., Act No. 30 / 2000 Coll., Act No. 105 / 2000 Coll., Act No. 451 / 2001 Coll. and Act No. 205 / 2005 Coll., the dot is replaced by a comma at the end of (l) and the following point (m) is added, including footnote No. 57b:
"(m) the annulment of the auction57b).
57b) Act No. 26 / 2000 Coll., on public auctions, as amended. '
EFFECTIVE
This Act shall take effect on 1 September 2006.
