amending Act No. 117 / 1995 Coll., on State Social Support, as amended, Act No. 94 / 1963 Coll., on Family, as amended, and Act No. 359 / 1999 Coll., on Social Protection of Children, as amended

Parliament has decided on this law of the Czech Republic:

ČÁST PRVNÍ

Amendment of the State Social Support Act

Čl. I

In § 43 of Act No. 117 / 1995 Coll., on State Social Support, as amended by Act No. 91 / 1998 Coll., at the end of paragraph 3, the sentence "The benefits referred to in § 37 to 42 also belong to a person who has personal custody of a child who does not have a maintenance obligation, for as long as the legal proceedings for the provision of that person are pending by the guardian of the child; if the same child is at stake, the dose is only once. ';

Amendment to the Act on Social Protection for Children

Čl. III

Act No. 359 / 1999 Coll., on Social Protection of Children, as amended by Act No. 257 / 2000 Coll., Act No. 272 / 2001 Coll., Act No. 309 / 2002 Coll., Act No. 320 / 2002 Coll., Act No. 518 / 2002 Coll., Act No. 222 / 2003 Coll. and Act No. 52 / 2004 Coll., is amended as follows:

1. In Article 10 (4), the sentence "The founder of the establishment referred to in Article 39 (c) shall, when the child is admitted to the establishment, be obliged to declare this fact without undue delay to the municipal authority of the municipality having extended jurisdiction in whose administrative district the child is resident and, if not known, to the municipal authority of the municipality with extended competence in whose administrative district the establishment to which the child has been admitted is situated. '

2. in Article 19 (1) (a) and (b), the words "or an institution requiring immediate assistance" shall be inserted after the words "in the Institute."

3. In Paragraph 19 (4), the words "the municipal authority of the municipality with extended competence 'are replaced by the words" the State Social Aid Office responsible for providing a contribution to the reimbursement of the needs of the child under special legislation 20a)';

footnote 20a is replaced by the following:

"20a) Sections 37 and 38 of Act No. 117 / 1995 Coll., on State Social Aid, as amended. '.

4. In Article 42, the following paragraph 3 is added:

"(3) The establishment shall keep a record of the children admitted to the establishment within the

(a) the date and time of admission of the child to the establishment;

(b) the name and surname of the child, if known,

(c) the date of birth of the child, if known; If the date of birth of the child is unknown, the approximate age of the child shall be indicated,

(d) the address of the place of residence; If the address of the place of residence is not known, another possible indication of the place of residence of the child shall be given before admission to the establishment,

(e) the reason for the child's admission;

(f) a record of compliance with the obligation laid down in the second sentence of Paragraph 10 (4);

(g) the date and time of the release of the child from the establishment. ';

Čl. IV

Transitional provision

The institution of a child facility requiring immediate assistance which has a child in place at the date of application of this Act shall, without undue delay, comply with the notification requirement laid down in Article III (1) and, by the end of the calendar month following the month in which that law came into force, introduce a record of children in accordance with Article III (4).
