GOVERNMENT REGULATION
of 8 December 2014
on the adjustment of compensation for loss of service income following the cessation of incapacity for service resulting from accidents or occupational diseases and the adjustment of the cost of maintenance for survivors and the setting up of a memorial or a plaque
The Government mandates the implementation of Act No. 361 / 2003 Coll., on the service relationship of members of the Security Corps, as amended by Act No. 186 / 2004 Coll., Act No. 436 / 2004 Coll., Act No. 586 / 2004 Coll., Act No. 626 / 2004 Coll., Act No. 169 / 2005 Coll., Act No. 253 / 2005 Coll., Act No. 413 / 2005 Coll., Act No. 470 / 2005 Coll., Act No. 167 / 2012 Coll., Act No. 189 / 2006 Coll., Act No. 531 / 2006 Coll., Act No. 261 / 2007 Coll., Act No. 308 / 2008 Coll., Act No. 306 / 2008 Coll., Act No. 326 / 2009 Coll., Act No. 341 / 2011 Coll.
The compensation for loss of service income after the cessation of incapacity for service resulting from an accident or occupational disease (hereinafter referred to as "compensation for loss of service income ') and the reimbursement of the maintenance costs of survivors belonging to members or survivors under Act No. 361 / 2003 Coll., on the service relationship of members of the Security Corps, as amended, or under previous legislation1), shall be adjusted by increasing by 1,6% the average service income applicable to the calculation of compensation for loss of service income and to the reimbursement of maintenance costs of survivors, possibly increased by the former legislation2).
In the event of entitlement to compensation for loss of service income and maintenance costs of survivors after 31 December 2014, the average service allowance applicable to the calculation of compensation shall not be increased in accordance with Article 1.
The provisions of Paragraph 1 shall apply from 1 January 2015 and shall be implemented without the application of a member or survivors and at the request of a member only if he was not entitled to compensation for loss of service because of an increase in disability pension under social security or pension insurance legislation.
If a person dies as a result of an accident or an occupational disease, the cost of setting up a memorial or a plaque shall be reimbursed to the person who incurred the costs.
Efficacy
This Regulation shall enter into force on the day of its publication.
