DECLARATION
of 11 October 2023
amending Decree No 366 / 2005 Coll., on the requirements applicable to certain frozen foodstuffs
The Ministry of Agriculture provides, pursuant to § 18 (1) (a), (g) and (h) of Act No. 110 / 1997 Coll., on Food and Tobacco Products and amending and supplementing certain related laws, as amended by Act No. 316 / 2004 Coll., Act No. 120 / 2008 Coll., Act No. 139 / 2014 Coll. and Act No. 180 / 2016 Coll.:
Decree No 366 / 2005 Coll., on the requirements applicable to certain frozen foodstuffs, is amended as follows:
1. In Section 1, the words "European Communities' are replaced by the words" European Union 'and the words "into circulation' are replaced by the words" to the market '.
2. in Articles 2 (1) (b), 4 (5) and 5 (1), the words "minus 18 ° C" are replaced by the words "-18 ° C";
3. in Article 3 (1) (b), "minus 18 ° C" is replaced by "-18 ° C";
4. In Paragraph 3 (1), the words "in the law and in the specific legislation3) 'are replaced by the words" in the Regulation on the provision of information on foodstuffs to consumers (m3), in the law and in the legislation governing certain labelling of foodstuffs (4)'.
footnotes 3 and 4 are as follows:
"(3) Regulation (EU) No 1169 / 2011 of the European Parliament and of the Council of 25 October 2011 on the provision of food information to consumers, amending Regulations (EC) No 1924 / 2006 and (EC) No 1925 / 2006 of the European Parliament and of the Council and repealing Commission Directive 87 / 250 / EEC, Council Directive 90 / 496 / EEC, Commission Directive 1999 / 10 / EC, Directive 2000 / 13 / EC of the European Parliament and of the Council, Commission Directives 2002 / 67 / EC and 2008 / 5 / EC and Commission Regulation (EC) No 608 / 2004, as amended.

5. In Paragraph 4 (2), footnote 4 is replaced by footnote 9.

"9) For example, Decree No. 397 / 2021 Coll., on requirements for preserved fruits and preserved vegetables, nuts, mushrooms, potatoes and their products and bananas, Decree No. 398 / 2016 Coll., on requirements for spices, edible salt, dehydrated products, seasonings, cold sauces, dressing and mustard, Decree No. 18 / 2020 Coll., on requirements for milk and milk products, Frozen creams and edible fats and oils, as amended by the Ministry of Agriculture No. 329 / 1997 Coll., Act No. 76 / 2003 Coll., Decree No. 76 / 2003 Coll., which lays down requirements for natural sweeteners, med, cocoa powder and mixtures of cocoa, as well as well as well as amended by Decree No 274 / 2019 Coll.
6. In Article 4, paragraphs 7 and 9, including footnote 8, are deleted.
Paragraphs 8 and 10 shall be renumbered paragraphs 7 and 8.
7. In Section 5, the words "into circulation 'are replaced by the words" to the market'.
8. In Paragraph 5 (1), "not more than minus 15 ° C 'is replaced by" not more than 3 ° C'.
9. Paragraph 5 (2) reads as follows:
"(2) Offers for the sale of quick-frozen food in freezer boxes to consumers must be made under conditions such that the temperature of the quick-frozen food does not increase by more than 3 ° C. '
10. in Article 5, paragraph 3 is deleted;
Efficacy
This Decree shall take effect on 1 January 2024.
