DECLARATION
of 24 November 2015
amending Decree No 24 / 2011 Coll., on river basin management plans and flood risk management plans, as amended by Decree No 49 / 2014 Coll.
The Ministry of Agriculture and the Ministry of the Environment, pursuant to Articles 25 (2) and 26 (2) of Act No. 254 / 2001 Coll., on Water and on the Amendment of Certain Laws (Water Act), as amended by Act No. 150 / 2010 Coll., hereinafter referred to as "the Act ':
Decree No. 24 / 2011 Coll., on river basin management plans and flood risk management plans, as amended by Decree No. 49 / 2014 Coll., is amended as follows:
1. In Article 5 (l), the words "p-DDT 'are replaced by the words" p' -DDT 'and the words "tetrachloroethylene' are inserted after the words" tetrachloroethylene '.
2. In Section 12, paragraphs 9 and 10 are added, including footnote 18:
"(9) For substances listed under Nos 2, 5, 15, 20, 22, 23, 28 of Annex 6 to the Government Regulation on the parameters and levels of permissible pollution of surface water and waste water, the formalities for the authorisation to discharge waste water into surface and sewerage waters and sensitive areas (18), a good chemical status of surface water for these substances shall be achieved by 22 December 2021, through the programmes of measures referred to in the river basin plans.
(10) For substances listed under headings 34 to 45 of Annex No 6 to the Government Regulation on the parameters and values of permissible pollution of surface water and waste water, the particulars of the authorisation for the discharge of waste water into surface water and sewerage and sensitive areas (18), a good chemical status of surface water for these substances shall be achieved by 22 December 2027 and the deterioration of the chemical status of surface water bodies shall be avoided in relation to these substances by means of a preliminary programme of measures for these substances prepared by 22 December 2018 and a final programme of measures drawn up by 22 December 2021, which shall be adopted and implemented immediately after that date, but not later than 22 December 2024.

3. Annex No 1, including the title and footnotes 19 to 21, reads:
"Annex No 1 to Decree No 24 / 2011 Coll.
Basic content of the national river basin management plan
The national river basin management plan shall include:
1. General description of the characteristics of part of the international river basin management area on the territory of the Czech Republic, established pursuant to Sections 8 and 9, which shall include in particular:
1.1. For surface waters
(a) maps of the international basin area and sub-basins;
(b) a description and justification of the change in the definition of water bodies;
(c) maps of the location and boundaries of water bodies;
(d) maps of ecoregions, territories and types of surface water bodies;
(e) the reference conditions for surface water bodies,
(f) justification for excluding a particular component of quality from the environmental assessment;
(g) a description of the approaches and methodology used to define the mixing zones.
1.2. For groundwater
(a) maps of the location and boundaries of bodies of groundwater;
(b) a list of bodies of groundwater and related bodies of surface water, water and directly dependent terrestrial ecosystems, including a summary of information on the interaction;
(c) information on groundwater risk bodies, in particular information on their size, relations with related surface water bodies, water and directly dependent terrestrial ecosystems, and information on natural concentrations of pollutants.
2. Overview of significant impacts and impacts of human activity on surface and groundwater status, including:
(a) an estimate of the source of pollution, including a map of their location, of the aggregate information on affected surface and groundwater bodies;
(b) an estimate of diffuse sources of pollution, including an overview of land use, and summary information on affected surface and groundwater bodies;
(c) an estimate of the effects on the quantitative status of waters and of the aggregated information on the affected bodies of groundwater;
(d) analysis of other impacts of human activities on water status;
(e) evaluation of trends and contamination clouds;
(f) the list of emissions, discharges and releases of substances referred to in Article 9 (2) (c);
(g) a summary of the information on the groundwater risk bodies, in particular the number of water bodies or groups of water bodies and the pollutants and pollution indicators contributing thereto, including the values or concentrations found.
3. Identification and map of protected areas and a description of the legislation on which those areas are defined.
4. Results of the survey and evaluation of water status including:
(a) maps of monitoring networks set up for the purposes of the detection and evaluation of the status of waters and protected areas, maps of the results of the monitoring programmes for the status
1. ecological and chemical, in the case of surface water,
2. chemical and quantitative, in the case of groundwater;
3. protected territories,
(b) an overview of identified significant and sustained upward trends;
(c) an overview of monitoring points where groundwater quality standards or thresholds have been exceeded;
(d) a summary of how the assessment of trends from individual monitoring sites within the body or group of bodies of groundwater has contributed to identifying a significant and sustained upward trend with regard to the concentration of the pollutant or its changes and the reasons for the start of the change of trend;
(e) estimates of the level of reliability and accuracy of the results of the water survey and assessment programmes and an explanation of how the assessment took into account cases of overshoot of groundwater quality standards or thresholds at individual monitoring sites;
(f) a table containing the limits of determination of the analytical methods used and information on the effectiveness of these methods, taking into account the minimum working criteria laid down in another legislation19);
(g) a justification for the frequency of monitoring applied in accordance with other legislation20) if the monitoring intervals are longer than 1 year.
5. List of objectives adopted under Section 12 for surface waters, groundwater and protected areas, supplemented by:
(a) summary information on the water bodies in which Article 23a (4) of the Act was applied;
(b) summary information on the water bodies in which Article 23a (7) of the Act was applied;
(c) summary information on the water bodies in which Article 26 (5) of the Act was applied, including relevant conditions and indicators;
(d) summary information pursuant to Article 14 on heavily affected and artificial water bodies;
(e) the list of threshold values for each body of groundwater, including summary information on their relationship to natural concentrations of pollutants, environmental quality standards or other standards, and other relevant information on toxicology, ecotoxicology, persistence, bioaccumulation potential of pollutants and the tendency to disperse.
6. Summary of results of the economic analysis of water use according to § 11, including
(a) information on the proceeds of the various water use to cover the costs of water services;
(b) information on the planned steps towards applying the principle of return on costs for water services, including environmental and resource costs, and towards achieving the objectives of water protection as an environmental component, in accordance with the polluter-pays principle
(c) where appropriate, the reasons for the incomplete application of the principle of cost recovery.
7. Summary of the programme or programmes of measures adopted pursuant to Article 17, including procedures to achieve the objectives adopted pursuant to Article 12
(a) a summary of the measures needed to implement European Community legislation on water protection;
(b) a summary of the practical steps and measures taken pursuant to Article 4 (1) (b) to apply the principle of return on water use costs;
(c) a summary of the measures for water used or intended for the collection of water intended for human consumption;
(d) a summary of measures to improve bathing water quality;
(e) a summary of the measures to limit the collection and recovery of water, including justification for any exemptions;
(f) a summary of the restrictions adopted in relation to the discharge of pollution from point sources and other activities affecting the state of water;
(g) identification of cases in which Article 17 (4) and (5) has been applied, including the list of water bodies, justification and description of how this application has been reflected in the water survey and assessment programmes;
(h) a summary of the measures against pollution of water by the substances listed in Annex 1 to the Act;
(i) a summary of measures taken to prevent or reduce the impact of emergency pollution cases and information on measures to be taken in exceptional circumstances;
(j) a summary of the measures implemented under Article 26 (4) of the Act;
(k) details of the additional measures necessary to achieve the objectives adopted to protect and improve the state of surface, groundwater and aquatic ecosystems;
(l) details of the measures taken to prevent pollution of marine waters;
(m) details of the measures deemed necessary to achieve the good condition of the body of water within the period extended under Section 23a (5) of the Act, the reasons for any delay and the expected timetable for their implementation, including an estimate of costs;
(n) a description of the measures to reduce the scope of mixing zones in the future, e.g. measures to eliminate pollution of surface water by substances listed in the list of priority substances and measures to reduce pollution of surface water by other substances, review of authorisations under Act No. 76 / 2002 Coll., on integrated prevention, regulation of discharges of pollutants from point sources of pollution,
(o) a description of the measures aimed at ensuring that the concentrations of selected priority substances (21) in the sediment or relevant biota do not increase significantly;
(p) an overview of the measures taken in relation to cross-border pollution and a description of the actions taken at the level of the relevant international river basin area or at European Union level;
(q) an assessment of the most cost-effective combination of measures on the basis of an estimate of the costs of such measures and the financing strategy of the measures.
8. Registration of other more detailed programmes and plans for a given part of the international part of the river basin area in the Czech Republic relating in particular to sub-basins, sectors, problems or water types, together with a summary of their content.
9. Summary of the measures taken to inform the public and to consult, their results and changes that have been made in the river basin management plan.
10. List of competent authorities and a description of the administrative coordination of the river basin management work.
11. Contact points and procedures for obtaining basic documentation and information and in particular details of permits for water management and the actual results of the survey and evaluation of water status pursuant to § 21 of the Act.
The update of the national river basin management plan also includes:
1. Summary of changes since the publication of the previous river basin management plan, including an overview of the measures implemented and planned at departments with specific water protection objectives.
2. Evaluation of progress in achieving the objectives of water protection as an environmental component, including their identification in the map, the results of the assessment of water status during the period of validity of the previous plan and an explanation of the reasons for not meeting the objectives of water protection as an environmental component.
3. Summary and explanation of measures not implemented from previous plans.
4. Summary of additional measures under Section 26 (4) (d) of the Act since the publication of previous river basin management plans.
5. Summary of the consequences of exceptional circumstances and summary of the measures provided for in Section 26 (5) (e) of the Act.

Efficacy
This Decree shall enter into force on 1 December 2015.
