fixing the flat-rate amount of the costs of criminal proceedings
According to Articles 152 (3) and 153 (1) of Act No. 141 / 1961 Coll., on criminal proceedings, the Ministry of Justice provides for judicial (criminal) proceedings, as amended:
The flat-rate amount of the costs of criminal proceedings referred to in Article 152 (1) (d) of the criminal Code shall be:
(a) in cases where a criminal order has been issued which has acquired legal authority, CZK 2 000,
(b) in other matters in which the proceedings at first instance were conducted before the district court, CZK 4,000,
(c) in cases where the proceedings at first instance were conducted before the Regional Court, CZK 6,000.
If the defendant has been legally recognised by the Regional Court in the proceedings brought at first instance by the Regional Court as a criminal offence in respect of which proceedings at first instance by the District Court are required, the lump sum of the costs of the criminal proceedings shall be determined in accordance with Paragraph 1 (b).
If an expert opinion has been submitted in criminal proceedings, the lump sum of the costs of criminal proceedings determined pursuant to § 1 shall be increased
a) if at least two experts have been recruited to submit an expert opinion, by an amount of CZK 7,000,
b) in other cases by an amount of CZK 3,800.
(1) Flat-rate amount of costs referred to in Section 153 (1) of the Criminal Code
(a) the procedure for the application for renewal shall be determined in accordance with Article 1,
b) in the proceedings for a completely inconsequential application, the amount is CZK 10,000.
(2) The flat-rate amount of the costs of the criminal proceedings determined in accordance with paragraph 1 shall be increased in accordance with Article 3, provided that the expert has been recruited in the proceedings for a completely unsuccessful application for renewal or for an appeal.
The costs of criminal proceedings in cases of final termination before the date of application of this Order shall be determined in accordance with the existing provisions.
The Order of the Ministry of Justice of the Czech Socialist Republic No 66 / 1980 Coll., setting out the lump sum of the costs of criminal proceedings, is hereby repealed.
This Decree shall take effect on 1 January 1996.
