DECLARATION
of 24 October 2024
amending Decree No. 418 / 2001 of the Ministry of Justice Coll., on procedures for execution and other activities, as amended
The Ministry of Justice provides, pursuant to § 131 (1) (g) of Act No. 120 / 2001 Coll., on Judicial Executives and Enforcement Activities (Enforcement Order) and amending other laws, as amended by Act No. 286 / 2021 Coll.:
Decree No. 418 / 2001 Coll., on procedures for execution and other activities, as amended by Decree No. 463 / 2009 Coll., Decree No. 491 / 2012 Coll., Decree No. 149 / 2013 Coll., Decree No. 365 / 2014 Coll., Decree No. 461 / 2017 Coll., Decree No. 264 / 2021 Coll., Decree No. 517 / 2021 Coll. and Decree No. 394 / 2023 Coll., are amended as follows:
1. In Article 5b (1), the words "and the essential information on the execution of the enforcement proceedings and the documents sent, the call for compliance with the enforcement 'are deleted.
2. Paragraph 5b (2) is deleted.
Paragraph 3 shall become paragraph 2.
3. In the introductory part of Annex 6, point 1 is replaced by the following point 1a:
"1a. model of notification of the start of execution for the debtor - cash execution,"
4. In the introductory part of Annex 6, the following points 1b and 1c are inserted after point 1a:
"1b. the model of notification of the execution for the debtor - the recovery of non-cash transactions,
1c. a template of the notification of the execution for the creditor, ';
5. In the introductory part of Annex 6, point 2 reads as follows:
"2. a template for the notification of the commencement of execution - the establishment of an executive lien,"
6. In Annex 6, Model 1 is replaced by the following:

7. In Annex 6, the following models 1b and 1c are inserted after Model 1a:

"
Transitional provision
The court executor may, for a period of 5 months from the date of entry into force of this Order in the execution procedure, choose the procedure provided for in Decree No. 418 / 2001 Coll., as effective before the date of entry into force of this Order.
Efficacy
This Decree shall take effect on 1 November 2024.
