DECLARATION
of 28 August 2009
amending Decree No. 31 / 1995 Coll., implementing Act No. 200 / 1994 Coll., on Geometry and amending and supplementing certain laws related to its implementation, as amended
The Czech office of surveyor and cadastral provides pursuant to § 20 paragraph 1 of Act No. 200 / 1994 Coll., on surveying and amending and supplementing certain laws related to its implementation, as amended by Act No. 186 / 2001 Coll., Act No. 319 / 2004 Coll. and Act No. 189 / 2008 Coll.:
Decree No. 31 / 1995 Coll., implementing Act No. 200 / 1994 Coll., on Geometry, and amending and supplementing certain laws related to its implementation, as amended by Decree No. 212 / 1995 Coll., Decree No. 365 / 2001 Coll. and Decree No. 92 / 2005 Coll., are amended as follows:
1. In Paragraph 1 (1), the words "comparative proficiency tests (" comparative test ')' are replaced by "differential tests'.
2. In Paragraph 1, the following paragraph 2 is inserted after paragraph 1:
"(2) This Decree was notified in accordance with Directive 98 / 34 / EC of the European Parliament and of the Council of 22 June 1998 laying down a procedure for the provision of information in the field of technical standards and regulations and rules and of rules on information society services, as amended by Directive 98 / 48 / EC. '
Paragraph 2 shall become paragraph 3.
3. In Article 1, at the end of paragraph 3, the dot is replaced by a comma and the following point (d) is added:
"(d) a permanent station for receiving signals from global navigation satellite systems (hereinafter referred to as" permanent stations ") a set of technical equipment that performs continuous data recording from global navigation satellite signals and allows the provision of such data or, where appropriate, other services and outputs based on such data to individual users.";
4. In Paragraph 2 (2), "(points 1 to 6) 'is replaced by" (points 1 to 5)';
5. in Article 4 (1), the following points (a) and (b) are inserted:
"(a) the procedure for the placing of the mark (4) on immovable property and for the transfer or removal of the mark or for the imposition of measures to protect the mark (5);
(b) the procedure for the destruction, damage and unauthorised transfer of the mark or, in the case of non-notification of a change or detected defects in the data of (7), ';
Points (a) and (b) shall be renumbered points (c) and (d).
(6) footnote 9 shall read:
"9) Decree No. 26 / 2007 Coll., implementing Act No. 265 / 1992 Coll., on the registration of property rights and other property rights, as amended, and Act No. 344 / 1992 Coll., on the cadastral law of the Czech Republic, as amended."
7. in Article 5 (3), the words "(points 2 to 6) 'are replaced by the words" (points 2 to 5)';
8. In Article 6 (2), the words "basic points and thickening points' are deleted.
9. In Article 6 (5), "3 'is replaced by" 4'.
10. in Paragraph 7 (1) (c), the words "permanent residence" are replaced by the words "permanent residence address."
11. in Paragraph 8 (2), footnote 25 is replaced by footnote 9;
footnote 25 is deleted.
12. in Paragraph 11 (2) (d), "place" is replaced by "location address."
13. In Section 11 (7), footnote 31 is replaced by footnote 9.
footnote 31 is deleted.
14. Article 12 shall be deleted, including the title.

Findings of documentation of the results of surveying activities used for the management and management of state mapping works acquired by global navigation satellite technology
(1) The documentation requirements for the details of the location point field targeted by the Global Navigation Satellite System (GNSS) technology are:
(a) a technical report, an integral part of which is the protocol for the determination of points of the detailed position point field of GNSS technology, including annexes; the template for the identification of points of the detailed position point field of GNSS technology is published on the Office's website,
(b) geodetic data on the points of the detailed position point (9).
(2) The documentation of detailed points is required to record detailed measurement of changes (9), the protocol of which includes the determination of detailed points of GNSS technology, including annexes; the template for the identification of detailed points of GNSS technology is published on the Office's website.
(3) The technical requirements for targeting and calculating points identified by GNSS technologies are set out in the Annex (point 9). "
footnote 31a is deleted.
16. in Article 13 (4) (e), the word "small" shall be deleted and the words "not subject to a building permit or notice" shall be inserted after the word "construction."
17. in Paragraph 13, paragraph 7 shall be deleted;
Paragraph 8 shall become paragraph 7.
18. In Section 14 (2) of the final part of the provision, the words "must be ensured in such a way as to comply with the criteria laid down in the special legislature8) 'shall be replaced by the words" must be ensured in such a way as to comply with the criteria laid down in the specific legislature46a (hereinafter referred to as "the designated standards'). '
Footnote 46a reads:
"46a) § 4a of Act No. 22 / 1997 Coll., on Technical Requirements for Products and on the Amendment and Addition of Certain Acts, as amended by Act No. 71 / 2000 Coll. and Act No. 205 / 2002 Coll. '.
19. In the heading of Section Four, the words "comparative tests' are replaced by the words" differential tests'.
20. in Article 15 (1) (a):
"(a) the name, surname, maiden name, title, date of birth, place of birth and address of permanent residence; where the applicant is a foreigner, his application shall contain the name, surname, date of birth, place of birth, citizenship, travel document number and indication by which he was issued and the address to which the mail is to be served; the application must be submitted in the Czech language, '.
21. in Article 15 (2), point (a) shall be deleted;
Points (b) to (e) shall be renumbered as points (a) to (d).
22. in Article 15 (2) (a), the words "or, where appropriate, proof of recognition of such an education awarded outside the Czech Republic," shall be deleted. Part of the sentence behind the semicolon shall be replaced by the words "documents relating to the completion of higher education in the geographical direction shall be assessed according to the legislation in force at the time when the education was completed."
23. In Paragraph 15 (2) (b), the words'; a citizen of a Member State of the European Union who holds an authorisation similar to an official authorisation under Article 13 of the Act shall be added to the application for a certificate of three years of professional experience only if he does not perform a comparative test '.
24. in Article 15 (2), point (c) is deleted;
Point (d) shall be renumbered (c).
25. in Paragraph 15 (3), "2 (c)" is replaced by "2 (b)";
26. in Paragraph 15 (4) of the introductory part of the provision, "2 (c)" is replaced by "2 (b)."
27. in Article 15 (4) (b), the word "place" shall be replaced by "location address."
28. in Paragraph 15 (4) (d), "2 (c)" is replaced by "2 (b)";
29. In Article 15 (6), the words ", year, month of processing 'shall be inserted after the words" the name'.
30. in Article 16 (1), "Article 15 (2) (b)" is replaced by "Article 15 (2) (a)";

32. in Paragraph 17 (2), the word "place" shall be replaced by "address of the place."
33. Paragraph 18, including the title, reads:
Form for verifying the results of the agricultural activities
(1) Verification of the professional accuracy of the results of the surveying activities (hereinafter referred to as "verification of results") in paper form is characterised by the attachment of the text referred to in Article 16 (4) of the Act in the lower right-hand corner of the last part of each part constituting the result of the surveying activities. If these parts consist of multiple sheets, they shall be firmly joined.
(2) Verification of results in paper form shall be indicated on all of its originals which are transmitted to the client and used in accordance with Article 4 (2) of the Act.
(3) Verification of paper-based results in the case of an activity resulting in the digitisation of a cadastral operator shall be indicated only on the last page of each technical report and on the last page of the list of parts of the elaborate.
(4) When verifying the results in paper form, the signature, the date of verification of the result and the number of the records of the verified results shall be affixed to the stamp of an officially authorised surveying engineer.
(5) The verification of the results in electronic form shall be carried out by attaching a text file containing the text referred to in Article 16 (4) of the Act, the date and fingerprints of the files containing the verified results, generated by a hash function, to which an officially authorised surveyor shall attach an guaranteed electronic signature based on a qualified certificate issued by an accredited certification service provider and that qualified certificate. The qualified certificate used for the verification of results shall include the name and surname of the officially authorised surveyor, the number of the item under which it is kept in the Office's list, and the scope of the official authorisation referred to in Article 13 (1) of the Act.
(6) The format of the text file referred to in paragraph 5 is published on the Office's website.
(7) The verification of the geometrical plan, its copy and the specified allocation plan are governed by specific legislation9).
(8) The size and specimen of the stamp of an officially authorised surveyor are set out in the Annex (point 7). "

37. In the Annex, point 9, including the title, shall read:
"9. Technical requirements for measuring and calculating points determined by GNSS technology
9.1 When measuring and processing the results of measurement work using GNSS-based technologies, such GNSS receivers, processing computer programs and measurement procedures shall be used to guarantee the required accuracy of the results of the measurement and calculation work carried out (hereinafter referred to as "results'). In both measurement and numerical processing, the principles set out in the documentation for the relevant apparatus and for the processing programme used shall be observed. For measurements it is possible to use signals from all operated and functioning satellites of all available global navigation satellite systems based on a similar principle to the US GPS- NAVSTAR system.
9.2. In order to achieve the results, real-time and subsequent processing measurements may be used in compliance with the provisions of paragraph 9.1. For measurements with subsequent processing, the steady-state measurement methods (hereinafter static methods), as well as measurements while moving (hereinafter kinematic methods) may be used. The period of measurement at point for static methods shall be sufficiently long in relation to the measurement method used, the length of the vector used, the apparatus used and the number of satellites contained in the subsequent processing result, the kinematic methods and real-time measurements shall include at least 5 records. For real-time measurements, static and kinematic methods, only solutions that have been achieved under the condition that ambiguities have been identified as integers may be used for further processing, and the distance of points between which the relationships are directly determined shall not be longer than the maximum distance for which those relationships can be solved by the processing programme used.
9.3. In order to achieve the results, individual permanent stations or outputs and services (hereinafter referred to as "virtual reference stations") may be used in compliance with the provisions of points 9.1 and 9.2 if they are generated by a network of permanent stations. The virtual reference station of a given permanent station network may not be used if it is provided at a greater distance from the nearest permanent station of that network than indicated in the documentation for that network with regard to its technological solution, or if it is not specified otherwise by practice.
9.4 The position of the point shall be determined either from two independent measurement results using GNSS technology, or from one GNSS measurement result and one measurement result using a classic method. The coordinates of the point shall comply with the accuracy characteristics laid down in this Regulation for trigonometric points and thickening points and special legislation9) for points of the detailed position point field and detailed points.
9.5 Repeated GNSS measurements shall be independent and shall therefore be carried out in the independent position of satellites, i.e. that repeated measurements shall not be made at the time of the verified measurement at intervals:
< -1 + n.k; n.k + 1 > hours
where: k is the number of days and can only acquire values of non-negative integers
n = 23,9333 hours (23 hours 56 minutes) for the US GPS- NAVSTAR system and 22,5000 hours (22 hours 30 minutes) for the Russian GLONASS system.
9.6. The result of the GNSS measurement, for which the GDOP parameter (Geometric Dilution of Precision) or PDOP parameter (Position Dilution of Precision) is greater than 7,0, cannot be verified by another GNSS measurement result, for which the GDOP parameter or the PDOP parameter value is greater than 7,0 if the time verifying the measurement against the measured time is within the interval:
< -3 + n.k; n.k + 3 > hours
9.7 If the position of the point is determined by measuring with subsequent processing only from the results of a single GNSS measurement carried out at the specified point, the following conditions shall be met:
(a) the antenna height above the point shall be determined in two independent ways or determined before and repeatedly after measurement;
(b) if the continuous measurement time with subsequent processing used to achieve the result is less than 1 hour, the GDOP or PDOP shall not exceed 7,0 for any measurement result used;
(c) the position of the point shall not be determined solely by the use of virtual reference stations provided by permanent station networks or by a combination of virtual reference stations and permanent stations from the same permanent station network.
9.8 When determining the location of the points of the detailed position point field, the auxiliary points and the detailed points, the repeated measurement of GNSS may be replaced by verifying the position of the newly determined points or by verifying their position with respect to the current point, the coordinates of which meet the accuracy characteristics given for the specified point, using an appropriately selected number of controlled lengths, angles or combinations thereof. In order to verify the position of the point, it is not possible to use as control element:
(a) the length, directly or indirectly, measured between points which have not been determined independently;
(b) an angle in a triangle containing at least two points which have not been determined independently if it is not part of a cap in a pattern containing at least two points whose position has been verified;
(c) a cap in the figure created by points which have not been determined independently.
9.9 When determining the position of an auxiliary point determined by the classical method from points identified by GNSS technologies, the position of which has not been verified may be replaced by the control measurement at that point by verifying its position:
(a) by means of the control of coordinates of at least two independently determined points by means of measurements carried out from that auxiliary point; or
(b) the control direction of this auxiliary point by a classical method of other points identified by GNSS technologies, the position of which has also not been verified. In so doing, the location of the points used for the control focus shall be independent of the location of the points used in the control focus.
9.10Connecting to the same implementation of the WGS84 coordinate system in which another measurement campaign has been processed or to the ETRS coordinate system in epoch 1989.0 can be done:
(a) by measuring at least two connecting points, the verified relationship between these points must meet the required accuracy characteristics; or
(b) an independent pair of measurements using GNSS technology that meets the required accuracy characteristics at one connecting point the position of which has been verified with the required accuracy; or
(c) the use of a permanent station which is approved by the Office or virtual reference stations provided by a network of such permanent stations for connection to the ETRS in epoch 1989.0 without the need for verification measurements.
9.11 The transformation of coordinates from the geocentric coordinate system WGS84 or ETRS in epoch 1989.0 to S-JTSK may only be carried out by means of a processing programme approved by the Office by:
(a) the transformation of the detailed points between ETRS in epoch 1989.0 and S-JTSK without the choice of identical points by means of an enhanced global transformation, provided that the procedure set out in the instructions for using such a programme is followed; or
(b) transformation using a local key and selecting identical points, subject to the following conditions:
(ba) at least four identical points are used to determine transformation parameters;
(bb) the coordinates at all identical points have been obtained by measurements or taken from valid geodetic data;
(bc) the coordinates of all identical points are determined to an accuracy greater than or equal to that required for the specified points;
bd) the geocentric coordinates of all identified and identical points are in the same geocentric system, in the case of WGS84 then in the same implementation,
(be) identical points are spread evenly, the average distance between adjacent identical points is not more than 5 km and no distance between adjacent identical points is more than 8 km;
(bf) the circumferential polygon intersected with identical points does not form a pattern with an inner angle of less than 20 °;
(bg) none of the designated points outside the pattern formed by identical points lies from the nearest link between the two adjacent identical points at a distance of more than 1 / 10 of the length of the link;
(bh) if the coordinates at an identical point have been obtained by measuring and transforming the observed deviation exceeds the maximum permitted deviation at that point, either such a point shall be excluded from the transformation and another identical point shall be selected, or the validity of the relationship between the coordinate systems for that point shall be demonstrated by verifying the position of the identical point and, if necessary, coordinates in the geocentric coordinate system and in the S-JTSK. ';
Efficacy
This Decree shall take effect on 1 October 2009.
