GOVERNMENT REGULATION
of 8 December 2004
establishing a list of sensitive civil aviation activities
The Government orders pursuant to § 81b (3) of Act No. 148 / 1998 Coll., on the Protection of classified information and on the amendment of certain laws, as amended by Act No. 310 / 2002 Coll.:
This Regulation (1) amends the list of activities relating to civil aviation, the misuse of which could jeopardise the security of the State or of any other important interest of the State (hereinafter referred to as "sensitive activity '), following the directly applicable regulation of the European Community2.
Sensitive activity at airports for commercial air transport means:
(a) management of civil aviation security activities;
(b) carrying out personal checks and checks on baggage and cargo carried under special legislation (3);
(c) carrying out security pre-flight checks on aircraft and ensuring airport surveillance;
(d) carrying out civil aviation security control activities;
(e) the activities of a member of the airport safety committee established under the international treaty (4);
(f) setting the sensitivity and maintenance of detection systems; or
(g) business and activities carried out in a work, service or similar relationship or when delivering goods or services on board aircraft in a restricted security area designated by the aerodrome operator, unaccompanied by a person, designated by the aerodrome operator and meeting the requirements for carrying out sensitive activities.
This Regulation shall enter into force on 1 January 2006.

1) It is issued for implementation and within the limits of a law already adapted to the directly applicable provisions of the European Communities.
2) Regulation (EC) No 2320 / 2002 of the European Parliament and of the Council of 16 December 2002 establishing common rules in the field of civil aviation security. Commission Regulation (EC) No 1217 / 2003 of 4 July 2003 laying down common specifications for national civil aviation security quality control programmes.
3) Paragraph 86 (1) of Act No. 49 / 1997 Coll., on Civil Aviation and amending and supplementing Act No. 455 / 1991 Coll., on Business Business (Trade Act).
4) Convention on International Civil Aviation of 7 December 1944 (Chicago Convention), published under No 147 / 1947 Coll., as amended.
