DECLARATION
Ministry of Transport and Communications
of 10 January 2001
on driving licences and the register of drivers
The Ministry of Transport and Communications provides, pursuant to § 137 (2) of Act No. 361 / 2000 Coll., on road traffic and on amendments to certain laws, hereinafter referred to as "the Act ', for the implementation of § 87a (9), § 104 (5), § 105 (5), § 106 (4), § 107 (3), § 109 (10), § 110 (6), § 111 (9), § 113 (9), § 115 (8), § 122 (2) and § 125j (3):
RIGHTS
Czech driving licence
(1) The Czech Republic's driving licence 5) (hereinafter referred to as the "driving licence") is a document measuring 54 x 86 mm.
(2) The individual information in the driving licence referred to in paragraph 4 shall be given in the Czech language, legibly, in large letters in Latin alphabet and Arabic numerals. Information on the identification, title and scientific rank of the holder of the driving licence and the name of the issuing authority may also include small printing letters. The signature of the holder of the driving licence shall correspond to the signature drawn up by the applicant's own hand.
(3) The front of the driving licence referred to in paragraph 1 shall show:
(a) the words "CZECH REPUBLIC,"
b) the distinguishing mark of the Czech Republic "CZ," printed in white in blue rectangle, which is placed in a circle of twelve yellow stars,
(c) the inscription "ROAD TRADE,"
(d) the words "EUROPEAN UNION MODEL" in the Czech language and the words "driving licence" in the languages of the Member States of the European Union (hereinafter referred to as "Member State") in accordance with Annex 6, which are printed in pink and form the basis of the front of the driving licence.
(4) The following particulars shall appear on the front of the driving licence referred to in paragraph 1 under the following numbers:
1. the last name of the licence holder,
2. the name and, where applicable, the name and title of the holder of the driving licence,
3. the date and place of birth of the holder of the driving licence;
4a. the date of issue of the driving licence,
4b. the date of validity of the driving licence,
4c. the name of the office which issued the licence,
4d. the natural number of the holder of the driving licence, if any,
5th series and driving licence number,
6. photograph or other form taken by the holder of the licence, 1)
7. signature of the holder of the licence,
9. groups of vehicles which are entitled to drive the licence holder.
(5) The following particulars shall appear on the back of the driving licence referred to in paragraph 1 under the following numbers:
9. groups of vehicles which are entitled to drive the licence holder,
10. the date of creation of the driving licence for each group of vehicles, which shall be indicated in the order of the date, month and year (in DD.MM.RR format); that date shall be indicated on each driving licence newly issued to its holder for exchange of a driving licence or on a duplicate of a driving licence issued for loss, theft, damage or destruction of a driving licence;
11. the expiry date of the driving licence for each group of vehicles (in DD.MM. RR format),
12. a record of the suspension or limitation of the driver's driving licence and professional competence as specified by the harmonised code referred to in Article 11 and the national code referred to in Article 11a;
13. record of information relevant to the management of the driving licence by the host Member State;
14. other records.
(6) A space for the data chip shall be reserved on the back of the driving licence referred to in paragraph 1.
(7) The issue date of the driving licence referred to in paragraph 4, code number 4a shall be indicated as the date of the application for the driving licence (§ 12).
(8) The model driving licence is set out in Annex 1.
International driving licence issued by the Czech Republic
(1) The model of the international driving licence issued by the Czech Republic is set out in Annex 2 to this Decree. Data shall be entered in an international driving licence in accordance with the Convention on Road Traffic (Vienna 1968).
(2) The model of international driving licence issued by the Czech Republic is set out in Annex 3 to this Decree. Data shall be entered in an international driving licence in accordance with the Convention on Road Traffic (Geneva 1949).
International driving licence issued by a foreign State
(1) An international driving licence issued by a foreign State under the Convention on Road Traffic (Vienna 1968) shall be assessed in accordance with Annex 7 to this Convention.
(2) An international driving licence issued by a foreign State under the Convention on Road Traffic (Geneva 1949) is assessed in accordance with Annex 10 to this Convention.
(1) The indication of the imposition of a prohibition on the activity of prohibiting the driving of motor vehicles or the indication of the suspension, restriction or withdrawal of a driving licence shall be entered by the municipal authority of the municipality with extended scope on the inside of the third part of the envelope of an international driving licence issued by a foreign State pursuant to Article 3 in the box "Exclusion."
(2) The facts referred to in paragraph 1 shall be notified by the municipal authority of the municipality with the extended competence of the authority of the foreign State which issued the international driving licence issued by the foreign State pursuant to paragraph 1 by sending a copy of the final decision through the Ministry of Transport.
Driving licence issued by a foreign State
(1) The requirements of a driving licence issued by a foreign State under the Convention on Road Traffic (Vienna 1968) shall be assessed in accordance with Annex 6 to this Convention.
(2) The requirements of a driving licence issued by a foreign State under the Convention on Road Traffic (Geneva 1949) shall be assessed in accordance with Annex 9 to this Convention.
List of States
The list of States which, on a reciprocal basis, recognise driving licences and groups of vehicles corresponding to groups of vehicles under the Road Traffic Act is set out in Annex 6a to this Decree.
Harmonised codes
(1) The driving licence shall include harmonised codes under the 01 to 99 heading recording the conditions and limitations of the driving licence, the professional competence of the driver and other administrative matters.
(2) The list of harmonised codes referred to in paragraph 1 and their delimitation are set out in Part I of Annex 5.
National codes
(1) In addition, the driving licence shall indicate the national codes under the code number 100 and higher, recording certain other conditions and restrictions on the driving licence and other administrative matters.
(2) The list of national codes referred to in paragraph 1 and their delimitation are set out in Part II of Annex 5.
Application for a driving licence, issue of a driving licence and international driving licence
(1) The model of the application for a driving licence and the application for a driving licence is set out in Annex 7.
(2) The application for an international driving licence for the holder of a driving licence is filed by hand or machine. The applicant shall indicate in the box the reason for the application for an international driving licence the countries in which he intends to drive the motor vehicle. At the request of the municipality with extended scope, the municipal authority shall issue an international driving licence either under the Convention on Road Traffic (Vienna 1968) or under the Convention on Road Traffic (Geneva 1949), according to the State in which the applicant will use the international driving licence.
(3) The model of the application for an international driving licence is set out in Annex 7a.
Details of delivery via the delivery point
(1) When applying for the issue of a driving licence through an issue point, the applicant shall choose the place of issue from the offer contained in the user interface established by the Ministry of Transport. The selected output point cannot be changed.
(2) The applicant shall be informed of the time at which the driving licence may be withdrawn at the place of issue and of the manner and conditions in which the driving licence may be withdrawn at the point of issue. The applicant shall also be informed if, for operational reasons, this period or the place of issue is subsequently changed.
(3) If the applicant does not collect his driving licence from the place of issue at the time when it was possible to do so, he shall be informed of his transfer to the competent municipal authority of the municipality with extended scope. The applicant shall be informed of the possibility of taking over the licence at the competent municipal authority of the municipality with extended scope.
(4) The information referred to in paragraphs 2 and 3 shall be sent to the applicant for the contact details which he has selected when submitting the application in the user interface established by the Ministry of Transport.
(5) Paragraphs 1 to 4 shall also apply to the delivery of the driver card.
Joint delivery of the driving licence and driver card through the dispensing point
If the driver card is to be issued together with the driving licence and is to be delivered via the place of issue, the two documents shall be delivered together.
Time range for selecting the start date of the licence
The date of the start of validity of the driving licence may be selected from the offer contained in the user interface established by the Ministry of Transport when applying for a driving licence, and may not be later than the date on which:
(a) three months after the application for a driving licence has been submitted; or
(b) the driving licence of which the applicant for a driving licence is the holder expires.
Handling of driving licence forms and international driving licences
(1) The Ministry of Transport shall keep records of driving licence forms and international driving licences.
(2) The municipal authorities of the municipalities with extended competence keep records of the issued driving licence forms and international driving licences.
(3) The records referred to in paragraphs 1 and 2 shall be kept chronologically according to the registration numbers of the forms allocated and the means of calculation may be kept.
(4) If the applicant for a driving licence does not take over a driving licence with the municipal authority of the municipality with extended scope until the end of its period of validity, the procedure laid down in Article 14 (3) shall apply.
Submission of a driving licence and international driving licence
(1) The surrender of a driving licence or an international driving licence shall be recorded by the municipal authority of the municipality with extended scope in the driver's registration card.
(2) The surrendered driving licence or international driving licence which is invalid or expired, as well as the driving licence or international driving licence, which will no longer be able to return to the person in whose name it is issued, shall be invalidated by cutting off the upper right corner.
(3) In the list annexed to the shredding protocol, the municipal authority of the municipality with extended scope when submitting a driving licence or an international driving licence shall record the following:
(a) the name and surname of the holder of the surrendered driving licence or international driving licence;
(b) the natural number of the holder referred to in (a); if no birth number has been assigned to the holder, the date of birth shall be indicated;
(c) the series and registration number of the surrendered driving licence or international driving licence and the date of surrender;
(d) the series, registration number and date of issue of the new driving licence or international driving licence.
(4) According to paragraphs 2 and 3, the municipal authority of the municipality with extended scope shall not proceed where the expiry of the driving licence or international driving licence is due to the invalidity.
(5) The model of the document of surrender of a driving licence or an international driving licence is set out in Annex 8.
Forms of certificate of detention
(1) The certificate of retention of the driving licence shall be drawn up in the Czech language and shall contain:
(a) the designation of the department of the Police of the Czech Republic (hereinafter referred to as the "police") of which the police officer who has detained the driving licence is a member,
(b) the name, surname and address of the holder of the detained driving licence;
(c) the natural number of the holder of the detained driving licence, if any, or the date of birth;
(d) the number and date of issue of the seized driving licence and the designation of the office which issued the detained driving licence;
(e) the reason for the detention of a driving licence, including a brief description of the action on the basis of which the driving licence was detained, indicating the place and time of the offence,
(f) information on the consequence of the retention of a driving licence;
(g) the date of issue of the certificate of possession and the signature of the officer holding the licence;
(h) the statement of the holder of the detained driving licence, if he wishes to comment on the retention of the driving licence;
(i) the signature of the holder of the detained driving licence or, where applicable, by a police officer who has refused to sign the holder of the detained driving licence.
(2) The model of the certificate of retention of a driving licence is set out in Annex 9a.
ROAD REGISTER AND CENTRAL ROAD REGISTER
Driver Register
(1) The register of drivers contains driver registration cards and driver files.
(2) The driver registration card contains:
(a) personal data on the driver on the driving licence and the international driving licence;
(b) data on groups of vehicles which the driver is entitled to drive;
(c) details of licences issued,
(d) details of international driving licences issued;
(e) data on driving licences issued in exchange for driving licences issued by a foreign State or for driving licences issued by other Member States;
(f) details of surrendered driving licences and international driving licences;
(g) data on offences committed under the Road Traffic Act;
(h) data on the suspension, restriction, suspension or withdrawal of driving licences for the loss of medical or professional fitness to drive and return motor vehicles;
(i) details of cancellation of the licence;
(j) renunciation data for a group or groups of vehicles;
(k) details of the prohibitions on the management of motor vehicles imposed by a court for offences committed or by an administrative authority for offences committed;
(l) data on lost, stolen, damaged or destroyed driving licences and international driving licences and data on issued driving licences for lost, destroyed or unfit driving licences;
(m) details of licences issued for licences lost, stolen, destroyed or damaged issued by other Member States;
(n) data on the points achieved in the driver score and on the netting and deduction of points;
(o) data on the cancellation of the driving licence and data on the return of the driving licence,
(p) data relating to the waiver of the right to drive a motor vehicle within the territory of the Czech Republic for a period of one year by reaching a number of 12 points in the score, in the case of a driver holding a driving licence issued by another Member State, a driving licence issued by a foreign State, an international driving licence issued by a foreign State,
(q) records of transport psychological examinations carried out;
(r) details of the execution order in execution by suspension of the licence;
(s) data on issued driver's proficiency certificates under another legislation (6) or data on driver's professional competence recorded on the driving licence;
(t) details of certificates issued for teachers of teaching and training under another legislation (6);
(u) data on participation in regular training of drivers under another legislation (6);
(v) details of the detention of the driving licence;
(w) data on the mentor;
(x) details of the completion of the training of the initial driver and of the transport psychological interview;
(y) details of completion of the therapeutic programme;
(z) the data relating to the request for each change in the score.
(3) The driver's file shall contain:
(a) an application for a driving licence;
(b) an application for a driving licence;
(c) an application for an international driving licence;
(d) a request for a decision on the professional competence of the driver;
(e) an application for the exchange of a driving licence issued by a foreign State or a driving licence issued by another Member State for a driving licence;
(f) an application for a licence for a lost, stolen, destroyed or damaged driving licence issued by another Member State;
(g) a decision to suspend, restrict or withdraw a driving licence;
(h) notice of surrender of a group of driving licences or driving licences;
(i) the decision to revoke the condition or restriction and to return the licence;
(j) a decision on infringements under the Road Traffic Act;
(k) copies or copies of judgments or decisions of administrative authorities imposing a prohibition on motor vehicle driving;
(l) notification of the imposition of a fine by an on-the-spot injunction under the Road Traffic Act;
(m) a final decision imposing an administrative penalty for an offence committed by an act included in the score, or a notice of the acquisition of legal power for such a decision;
(n) notification by the Court of Justice of the acquisition of legal power of a judgment punishable by a criminal offence committed by an act in a point-to-point assessment;
(o) a copy of the document with the driver's objections against the record of points in the score and a copy of the written notification of the correction made to the record of points or a copy of the final decision rejecting the objection and confirming the record of points made;
(p) a driving licence issued by a foreign State in accordance with Paragraph 116 (7) of the Act,
(q) a detained driving licence pursuant to Article 118c (1) of the Act,
(r) a copy of the acknowledgement of deposit;
(s) an assessment of the result of the transport psychological examination and a certificate of completion of the therapeutic programme;
(t) a certificate of completion of a transport psychological interview and a certificate of completion of training for starting drivers;
(u) an execution order in execution by suspension of a driving licence;
(v) evidence of participation in regular training of drivers completed under another legislation (6);
(w) the application for registration of the mentor and the documents relating to the revocation of the mentor,
(x) request to send information on any change in the score;
(y) other official records and documents relating to the driver.
(4) The driver registration card may be kept by means of computer technology provided that the programme complies with the following requirements:
(a) the registered data relating to the driver are conclusive and exclude the possibility of confusion between the different registered drivers;
(b) records of the driver's record may be kept on an ongoing basis;
(c) individual data on the driver can be continuously viewed, printed and stored on a portable storage medium in the required time period;
(d) the printed form of the driver's registration card shall be marked with the name and address of the competent municipal office of the municipality with extended scope;
(e) the registered data shall be protected against erasure, transcription and other unauthorised interference;
(f) throughout the period of storage, the programme shall ensure the possibility of entering and changing the data in the driver's record card and the possibility of printing, subject to the conditions referred to in (e).
(5) When applying for a driving licence, applying for a driving licence or applying for a driver's professional competence decision through a user interface established by the Ministry of Transport, such applications shall not be entered in the driver's file; the driver registration card contains an indication that the application has been submitted via the user interface established by the Ministry of Transport.
(6) The driver's file and the driver's registration card are kept for one year after his death.
Information about any change in the score can be sent
(a) a short text message to a telephone number registered in the population register; or
(b) to the e-mail address indicated in the population register.
Transmission of data to the Central Register of Drivers
The municipal authority of the municipality with extended scope shall transmit changes in the data from the driver's registration card to the central register of drivers in electronic form. In paper form, the municipal office of the municipality shall transmit them with extended scope unless it holds the driver's registration cards in accordance with § 17 (4).
Equipment necessary for the proper conduct of the transport psychological examination
(1) Equipment necessary for the proper conduct of transport psychological examination shall include:
(a) the examination room by psychological diagnostic techniques;
(b) the examination room by other techniques;
(c) waiting room, reception or other appropriate facilities;
(d) psychological diagnostic techniques and standardised tests to perform psychological performance and personality tests.
(2) Individual rooms must be technically separated from each other.
