GOVERNMENT REGULATION
of 27 January 1999
establishing the list of products and packaging subject to the re-collection obligation and the details of the handling of packaging, packaging materials and waste from used products and packaging
The Government orders pursuant to § 19 (3) of Act No. 125 / 1997 Coll., on Waste:
(1) The list of products subject to the readmission obligation is set out in Annex 1 to this Regulation.
(2) The list of packaging subject to the removal obligation is set out in Annex 2 to this Regulation.
Any person who places a product or packaging on the market, (1) who is subject to the obligation to withdraw, shall ensure that the product or packaging is withdrawn after its use without payment.
Packaging, packaging materials and waste from used products and packaging recovered in one calendar year shall be used and recycled at the latest by the end of the following calendar year to the extent provided for by specific legislation.2)
This Regulation shall enter into force on the day of its publication.

List of products subject to the readmission obligation
Withdrawal shall be subject to:
| 1. Minerální oleje a oleje ze živičných nerostů, jiné než surové; přípravky jinde neuvedené ani nezahrnuté, obsahující nejméně 70 % hmotnosti nebo více minerálních olejů nebo olejů ze živičných nerostů, jsou-li tyto oleje podstatnou složkou těchto přípravků. | (kód celního sazebníku 2710 00 EX) |
| 2. Elektrické akumulátory | (kód celního sazebníku 8507) |
| 3. Galvanické články a baterie | (kód celního sazebníku 8506) |
| 4. Výbojky a zářivky | (kód celního sazebníku 8539 31 - 8539 39) |
| 5. Pneumatiky | (kód celního sazebníku 4011, 4012). |
Explanatory note: "EX 'shall apply only to tariff headings 2710 00 87 to 2710 00 98.

List of packaging subject to the obligation to withdraw
Withdrawal shall be subject to:
1. Consumer packaging, i.e. packaging meeting the requirements of the sale of goods to the consumer (e.g. boxes, bottles, cans).
2. Transport packaging, i.e. packaging meeting the requirements for transport, handling and storage of goods (e.g. barrels, crates, bags); Where packaging fulfils both the role of consumer and transport packaging, it shall be regarded as a transport packaging.
3. Grouped and commercial packaging, if not covered by point 1 or 2, i.e. packaging and packaging materials allowing an appropriate grouping of consumer packaging for easy handling, presentation and sale of packaged goods (e.g. cardboard boxes, overpacks).
