Czech Geographic and Catastral Office
of 1 February 1995
implementing Act No. 200 / 1994 Coll., on surveying and amending and supplementing certain laws relating to its implementation
The Czech office of surveying and cadastral provides pursuant to § 20 paragraph 1 of Act No. 200 / 1994 Coll., on surveying and amending and supplementing certain laws related to its implementation:
Preliminary provisions
(1) The Order provides for:
(a) the subject matter and content of the management of the point fields and the particulars of the submission concerning the point fields;
(b) the subject matter and content of the administration of basic and thematic national map works and the procedure for the standardisation of geographical nomenclature;
(c) subject matter and content of database management;
(d) the form of the provision of data from documented results of surveying activities, from managed bases of data and from the operation of the national network of permanent stations for accurate positioning and remuneration of the surveying office;
(e) the subject matter and formalities of the results of the agricultural activities used for national map works, the management of the real estate register or the management of a digital technical map;
(f) subject to verification, the subject matter and particulars of the results of the surveying activities under construction;
(g) the elements of the project for the results of the agricultural activities; and
(h) the formalities for verifying the results of the agricultural activities.
(2) This Decree was notified in accordance with Directive 98 / 34 / EC of the European Parliament and of the Council of 22 June 1998 laying down a procedure for the provision of information in the field of technical standards and regulations and rules and of rules on information society services, as amended by Directive 98 / 48 / EC.
(3) For the purposes of this decree:
(a) a geodetic point (hereinafter referred to as "point") permanently marked with a point specified by the measuring marks and signalling or protective devices (hereinafter referred to as "marks");
(b) geodetic data a set of written, numerical and graphic data (hereinafter referred to as "data") on points of the position, height and gravity point field which are part of the documented results of the geographical activities or of the point field database;
(c) the point field database, a separate part of the surveying information system in which the data on the points documented by the surveying authorities and the cadastral are kept;
(d) a geo-portal of a web interface operated by the Geometry Office for the purpose of publishing and providing data from the database, orthopotope of the Czech Republic, state map work, database file of geographical nomenclature, point field database and other data from documented results of surveying activities and from the operation of the state network of permanent stations for accurate positioning.
SUBJECT MATTER AND CONTENTS OF THE ADMINISTRATIVE MANAGEMENT OF BODIES AND OF THE SUPERVISORY OF ADMINISTRATION RELATING TO BODIES
Subject matter and content of point field management
Subject of point field management
(1) Point field management is
(a) points of the basic position, height and gravity point field;
(b) the concentration points of the position point field; and
(c) points of the detailed position and height point field.
(2) The division of point fields and the technical requirements for points include an Annex (points 1 to 5) which forms an integral part of this Decree.
Content of basic point field management
The management of basic points (3) includes:
(a) the procedure for the placing of the mark (4) on immovable property and for the transfer or removal of the mark or for the imposition of measures to protect the mark, 5)
(b) identification of the current status of the mark and implementation of the measures necessary for its maintenance, restoration and protection;
(c) an infringement procedure consisting of carrying out an activity which could jeopardise the mark in the protection zone of the base field mark or make it difficult or impossible to use it, an infringement consisting of destruction, damage or transfer of the mark or an infringement consisting of non-notification of the change and detected defects in the geodetic data of the points of the surveying authority and the cadastr7);
(d) laying down conditions for the limited applicability of points;
(e) the performance of surveying activities in the construction, restoration and maintenance of points;
(f) keeping a dossier on points; and
(g) keeping points in the point field database.
Content of concentration points management and detailed point fields
(1) The management of thickening points includes:
(a) the procedure for the placing of the mark (4) on immovable property and for the transfer or removal of the mark or for the imposition of measures to protect the mark (5);
(b) the processing of documents for the initiation of infringement proceedings consisting of the destruction, damage or transfer of the mark or the making of the mark unusable and the non-notification of the change and of the defects detected in the geodetic data of the points of the surveying authority and the cadastr65);
(c) the performance of surveying activities in the construction, restoration and maintenance of condensing points;
(d) keeping documentation on thickening points; and
(e) keeping data on points in the point field database in cooperation with the database administrator.
(2) The management of the detailed position point field contained in the property register, 8) and the technical requirements for these points are laid down in a separate regulation. 9)
(3) The management of the detailed height point field includes:
(a) ensuring the performance of the surveying activities in addition to the destroyed points as required by the documentation of the results of the surveying activities in the mandatory geodetic reference system, 6)
(b) the processing of documents for the initiation of infringement proceedings consisting of the destruction, damage or transfer of the mark or the making of the mark unusable and the non-notification of the change and of the defects detected in the geodetic data of the points of the surveying authority and the cadastr65);
(c) keeping documentation on these points; and
(d) keeping data on points in the point field database in cooperation with the database administrator.
Placing a mark on real estate
(1) The mark must be placed
(a) on the parcel in such a way that the technical requirements for points are complied with and that the mark can be tolerated by the owner of the parcel; 11) the location of the mark on the agricultural parcel is not subject to the protection of agricultural land under a special law, 12)
(b) on surfaces of roads and other structures serving the operation of vehicles or walking at surface level or below the surface in a shaft with a cover at surface level, after prior consultation according to the law, 13)
(c) to the vertical or horizontal surface of the construction of structures in such a way that it does not project more than 70 mm from the construction;
(d) the vertical construction of a real cultural monument (14) so that it does not stand out from the structure by more than 50 mm; the shape, colour and manner of the marking must not interfere with the appearance of the cultural monument unless otherwise agreed by law. 13)
(2) The mark is placed in such a way that it does not jeopardise stability or restrict the use of the construction.
(3) The types of spot field tags are included in the Annex (points 2 to 5). The types of marks of the detailed position point field contained in the cadastral property are specified in a separate regulation. 9)
Point field databases
(1) Data on the points of the position, height and gravity point field are to be kept in the point field database.
(2) Point field database management is carried out by the Geographical Office.
(3) Data on points of the basic position point field, thickening points and points of the height and gravity point field are entered in the database of point fields of the brand manager. Data on the points of the detailed position point field shall be taken by the administrator of the point field database from the cadastral information system.
(4) Data on point fields are published by the Geographical Office in the form of open data as well as through a web application for interactive user work.
Forms of submission concerning point fields
(1) The written notification of amendments and defects detected in item data, damage or destruction of the mark (18) contains, in addition to the procedural requirements laid down in the Rules of Procedure
(a) the name of the district, the cadastral territory and the number of the point or parcustoms number of the parcel on which the mark is placed; and
(b) the type of change or defect detected in the data point, the damage or destruction of the mark.
(2) The notification referred to in paragraph 1 may be made directly to the brand manager in writing, orally or through the cadastral office, (1) within whose territorial competence the item is located. The notification may also be made by means of a form published on the Office's website.
(3) Notification of the transfer, removal or taking of any other measure to protect the mark and notification of the threat to point 19) of the base point (s) shall be submitted to the brand manager and shall include in particular:
(a) the particulars referred to in paragraph 1 (a);
(b) justification for the notification or indication of the cause of the threat to the mark;
(c) the date on which the mark is to be moved or removed;
(d) a semi-anecdotal sketch of the area concerned by the construction when transferring the point for construction reasons.
(4) Restoring the damaged or destroyed mark of the point shall be performed by the brand manager. This recovery shall be carried out on the expense of the person who caused the damage.
(5) The notification of changes at the points of the detailed position point field contained in the property register is governed by a separate regulation. 9)
SUBJECT MATTER AND CONTENTS OF THE MANAGEMENT OF BASIC AND THEMATIC STATE MAPS AND DATABASE, PROCEDURE IN THE STANDARDISATION OF GEOGRAPHICAL NAMES AND DATA PROVISION
Subject matter of administration of state map works
(1) The subjects of the administration are:
(a) basic state map works, 22)
(b) thematic national map works issued by the Office or other central government bodies or, where appropriate, by the Office for Other Authorities.
(2) The Office for the Establishment of the Administration26) of State Map Works is published on the Office's website.
Content of administration of state map works
(1) The content of the administration is:
(a) the creation, renewal, extradition and provision of state map works;
(b) the management of documentation funds and data sets of the digital form of basic state map works.
(2) The creation and renewal of basic national map works is based on the current status of the database as the default data geographic standard and the standardised geographical nomenclature according to Article 11 (6).
Subject of database management
Data on geographical objects are the subject of database management. The database contains geographical data from the whole territory of the Czech Republic, processed according to uniform principles and standards. The list of geographical objects and their attributes together with the categorisation of these objects contains an annex (point 8).
Content of database management
The content of database management is
(a) the maintenance of the database as a digital model of the territory of the Czech Republic, including the spatial harmonisation of individual geographical objects and the retention of the content of the database in a time series;
(b) updating the database implemented
1. periodically for the full content of the database in a cycle of no more than 6 years in the whole territory of the Czech Republic, on the basis of data from long-distance survey of the Earth, a survey of selected information with local public authorities and a topographical survey of changes in the field; or
2. a continuous record of substantial changes in the content of the database using outputs from public administration information systems;
(c) integrating the database within the framework of public administration information systems by gradually supplementing links to selected objects of other public administration information systems;
(d) harmonisation of the database in the framework of international cooperation for the development of spatial information infrastructure in the European Community63),
(e) progressive improvement of the content of the database in order to develop territorial-oriented public administration information systems;
(f) the gradual improvement of the spatial identification of the geographical objects of the database using the selected results of the surveying activities carried out in the public interest; and
(g) the provision of database data.
Procedure for standardisation of geographical nomenclature
(1) The subject of the standardisation of geographical nomenclature (64) is:
(a) names of non-residential geographical objects from the territory of the Czech Republic,
b) Czech version of the names of resident and non-resident geographical objects outside the Czech Republic; and
(c) historical forms of current names of geographical objects.
(2) Proposals for the standardisation of geographical nomenclature are submitted to the Commission of the Czech Geographic and Catastral Office (hereinafter referred to as the "Envelope Commission"), which is the advisory body of the Office. The proposal shall include, in addition to the procedural requirements laid down in the Rules of Procedure:
(a) the full text of the name of the geographical object which is proposed to be standardised and the current alternative name of the object;
b) a brief description of the geographical object and the location of the name of the object in the map; and
(c) the expression of the State administration or of the local authorities (29), or, where appropriate, of the institution within whose territorial or material competence it is to express its views on the proposal for the name of the geographical object.
(3) The tasks and organisational provision of the activities of the Envelope Commission are defined in its Statute issued by the Office. The members of the Election Commission shall be appointed by the President of the Office after consultation with the heads of the relevant central government bodies, scientific and other institutions. The Statute and the composition of the Election Commission shall be published on the Office's website.
(4) The names of the geographical objects referred to in paragraph 1 (a) are standardised according to the principles and rules of the written Czech language. In standardisation, the factual and linguistic correctness of the geographical name shall be assessed by experts, taking into account the locally used form of the name and the localisation of the standardised name. The result of standardization is the only binding form of the name of the geographical object.
(5) The standardisation of the names of geographical objects referred to in paragraph 1 (b) is based on the following principles:
(a) the designation of geographical objects shall be determined by the State in whose territory the object is located;
(b) for geographical objects from the territory of States which use non-Latin characters, the way they are translated into Latin shall be governed by the recommendations of the United Nations Conference on Standardisation of Geographical Nomenclature; and
(c) for the names of geographical objects in which there are established Czech forms (exonyma), their use is governed by the recommendations of the United Nations Conference on Standardisation of Geographical Nomenclature.
(6) Standardised names of geographical object65) are listed in the geographical nomenclature information system. Files of standardised geographical names are published on the Office's website. The sets of standardised geographical names referred to in paragraph 1 (b) are published in the nomenclature publications of the series "Geographic Nomenclature Lists of the United Nations - Czech Republic."
(7) The standardised names of geographical objects are binding on publication of the names of geographical objects in the state map works64) and in the database.
Provision of data
(1) The Geometry Office publishes data from the database, orthopho of the Czech Republic, state map work and database file of geographical nomenclature as open data through web applications published on the geoportal, via web services or on technical data carriers.
(2) Data from the database, orthopote of the Czech Republic, the state map work and the database set of geographical nomenclature in forms other than those referred to in paragraph 1 and other data from documented results of the surveying activities and from the operation of the state network of permanent stations for accurate positioning shall be provided by the Geometry Office, at the request, in the form and for remuneration specified in point 11 of the Annex to this Regulation.
(3) The Geographical Authority is entitled to prevent access to download services by a user who overloads the technical infrastructure of the Office. In the case of access to a large number of users at the same time, the Geographical Authority shall limit access to data depending on the time of application of the requirement, while maintaining equal treatment and non-discrimination.
(4) Where the applicant disseminates or makes available the data provided under paragraph 1, it shall indicate the source and date of the last update.
Subject matter and details of the results of the agricultural activities, of the project of the results of the agricultural activities and of the verification of the results of the agricultural activities
Findings of documentation of the results of surveying activities used in the public interest of the acquired technologies of the global navigation satellite system
(1) The documentation requirements for the details of the location point field targeted by the Global Navigation Satellite System (GNSS) technology are:
(a) a technical report, an integral part of which is the protocol for the identification of points of GNSS technology, including annexes; the model of the GNSS technology identification protocol is published on the Office's website,
(b) geodetic data on the points of the detailed position point (9).
(2) The documentation requirements for auxiliary points and detailed points are a record of detailed measurement of changes (9), the protocol for determining points of GNSS technology, including annexes; the model of the GNSS points protocol is published on the Office's website.
(3) The technical requirements for targeting and calculating points identified by GNSS technologies are set out in the Annex (point 9).
Subject matter of the results of the agricultural activities under construction
(1) Verification of the results of the surveying activities under construction is subject to:
(a) a geodetic base for construction;
(b) the design and documentation of the establishment, maintenance and renewal of the point field for construction purposes;
(c) a drawing of each object;
(d) a coordination drawing of the construction,
(e) panel elaborate of the construction,
(f) documentation of the layout of the construction site perimeter;
(g) documentation of the layout of the spatial position, dimension and shape of the construction or parts thereof;
(h) documentation of the positioning of existing civil engineering networks and the scope of their protection and safety zones;
(i) the design and documentation of control measurements, transfer measurements and reformation of objects; and
(j) documentation of the spatial location, dimension and shape of the completed construction or part of it or its technological equipment.
(2) The verification shall also be subject to the design and documentation of geodetic measurements of slope movements and deformations, provided that they are influenced by the existing or implemented structure and that these measurements are not carried out in the framework of metering according to other legislation41).
(3) If no excavation technology is used, the position and height orientation of all underground structures and equipment shall be carried out in the land-based activities referred to in paragraph 1 before or after their cover.
Requirements for the results of surveying activities under construction
(1) The geodetic base for construction contains:
(a) a numerical expression of the results of the spatial location, dimension and shape of existing ground, underground and above-ground objects and equipment, including technical equipment;
(b) graphical representation usually on the scale 1: 200, 1: 500 or 1: 1,000, showing all existing objects and equipment and points of the point field for construction purposes;
(c) a technical report including data on the person who carried out the surveying activities.
(2) The project and documentation for the establishment, maintenance and renewal of the point field for construction purposes includes:
(a) a point field project for construction purposes which contains:
1. numerical expression of the spatial position of future point field points for construction purposes;
2. graphical representation usually in scale 1: 200, 1: 500 or 1: 1,000 with display of all future points of the point field for construction purposes and with display of the design situation of the construction and existing buildings,
3. the technical report, including data on the project processor;
(b) documentation of setting up and targeting points of the point field for the purposes of construction, their protection against damage or destruction and their maintenance and restoration for the period of construction which includes:
1. numerical expression of the spatial position of point field points for construction purposes,
2. graphical representation usually on 1: 200, 1: 500 or 1: 1,000 scale, showing all points of the point field for construction purposes and showing the design situation of the construction and existing buildings,
3. sketches with information on security and numerical expression of the spatial position of the point field points for construction purposes,
4. a technical report including data on the person who carried out the surveying activities.
(3) The drawing of the individual objects contains:
(a) numerical expression of the spatial position determining the points of each object;
b) graphical representation of individual objects on a scale of 1: 100, 1: 200 or 1: 500 with display of all defining points of each object;
(c) a technical report including data on the person who carried out the surveying activities.
(4) The coordination drawing of the construction contains:
(a) a graphical representation of all objects in the spatial layout, usually on a scale of 1: 1 000, 1: 2 000 or 1: 5 000;
(b) a technical report including data on the person who carried out the surveying activities.
(5) The book elaborate of the construction contains
(a) a situation drawing of the records of the building generally on a scale of 1: 500, 1: 1 000 or 1: 2 000, showing all objects in the spatial layout including the valid state of the cadastral map;
(b) a technical report including data on the person who carried out the surveying activities;
(c) the table output of the list of parcels affected by the lock of the construction.
(6) Documentation of the construction site perimeter layout includes:
(a) numerical expression of the spatial position determining the points of the construction site perimeter and all its parts;
(b) a graphical representation of the perimeter of the construction site and of all the objects in the spatial layout, usually on a scale of 1: 200, 1: 500 or 1: 1,000, showing all the defining points of the construction site circuit;
(c) a technical report including data on the person who carried out the surveying activities.
(7) Documentation of the layout of the spatial position, dimension and shape of the construction or its parts
(a) numerical expression of the spatial position of determining the object points;
b) graphical representation of objects on a scale of 1: 200, 1: 500 or 1: 1,000, showing all defining points of the objects;
(c) numerical expression of deviations of defined and projected spatial positions determining object points;
