of 12 March 1970
concerning the elections of judges from the People of the District and Regional Courts of the Slovak Socialist Republic
The Slovak National Council decided on this law:
(1) Judges of the people of the county and county courts participate in the performance of the judiciary as elected representatives of the working people.
(2) The Judges of the People of the District and Regional Courts are elected by the Regional National Committees (National Committees exercising their jurisdiction) at their plenary sessions by secret ballot.
(1) The number of judges of the people required for the activities of the District Court shall be determined by the President of the District Court.
(2) The number of judges from the people to be elected for the Regional Court shall be determined by the President of the Regional Court; At the same time, it shall determine how many judges from the people are to be elected by each national district committee whose territory lies within the district court.
(1) Proposals for candidates for the election of judges from the people are submitted by social organisations active in the workplace and in places at the initiative of the competent authority of the National Front.
(2) The conditions to be fulfilled by the candidate for the post of Judge of the People are laid down in the law. *) An application for the election of a judge of the people shall be submitted by the competent authority of the National Front to the District National Committee.
After the election, the judges of the people shall take the required oath in the hands of the chairman of the District National Committee; * *) after the oath has been made, the District National Committee shall issue them a certificate of election.
(1) The Judge of the People of the District Court or the Regional Court may remove the national district committee which elected him from office. Judges may be removed from office before the expiry of their term of office if:
(a) seriously infringes its judicial duties;
(b) without due cause, for a longer period of time, fails to fulfil its judicial obligations;
(c) his state of health does not permit him to perform his judicial duties properly.
(2) An application for the removal of a judge from office may also be made by the President of the court in which the judge from the people is active. If the appeal is lodged by the National Front institution, the opinion of the President of the Court with whom the judge of the people is active shall be requested before the decision is taken.
(3) The removal of a judge from the people shall be decided by the district national committee in plenary by secret ballot. Prior to the decision to withdraw from office, observations shall be requested from the Judge of the people concerned.
(1) The Judge of the People of the District Court or of the Regional Court may, at his request, release the District National Committee which elected him from office, provided that the conditions laid down by law are fulfilled. *)
(2) Before the decision of the District National Committee, the opinion of the President of the Court with whom the judge of the people is active shall be sought.
If it is not normally possible to ensure the appointment of chambers to judges from the people, the district national committee shall elect other judges from the people.
This Act shall take effect on the day of its publication.
