of 12 September 2016
amending Decree No. 480 / 2012 Coll., on Energy Audit and Energy Assessment
The Ministry of Industry and Trade provides pursuant to § 14 (4) of Act No. 406 / 2000 Coll., on Energy Management, as amended by Act No. 165 / 2012 Coll., Act No. 318 / 2012 Coll., Act No. 310 / 2013 Coll. and Act No. 103 / 2015 Coll., to implement § § 9 (1) (a), § 9 (2), § 9 (6) and § 9a (5) of this Act:
Čl. I
Decree No. 480 / 2012 Coll., on Energy Audit and Energy Assessment, is amended as follows:
1. In Article 2 (1) and (2), the words "under Article 9 (1) of the Act 'shall be inserted after the words" arising'.
2. In Article 4 (3) (d) (2), the word "update 'is replaced by" specify' and the words "and the energy flows in each section 'are deleted.
3. in Articles 4 (3) (g) and 4 (c), the word "s" shall be inserted after the words "management."
4. In Article 5 (2), at the end of point (c), the comma is replaced by "a 'and point (d) is deleted.
Point (e) shall be renumbered as point (d).
5. in Article 5 (2) (d), the words "total energy balance" shall be replaced by the words "adjusted annual energy balance."
6. In Article 5 (4), the words "authorised to process an energy audit 'shall be inserted after the words" specialists' and, at the end of point (f), the comma shall be replaced by the words "a '; at the end of point (g), the words" a' shall be replaced by the words "a ';
7. in Article 6 (d):
"(d) the identification of an energy specialist authorised to process an energy assessment;"
8. in Article 6, the following point (e) is inserted after point (d):
"(e) the recommendation of an energy specialist authorised to process the energy assessment and its feasibility conditions,"
Points (e) and (f) shall be renumbered as points (f) and (g).
9. Paragraph 7 (3) reads as follows:
"(3) The findings of an energy expert authorised to process an energy assessment in relation to the subject matter and purpose of the assessment shall include:
(a) an assessment of the technical feasibility of alternative energy supply systems in the case of energy assessments under Sections 9a (1) (a) and 9a (2) (a) of the Act;
(b) an assessment of the economic feasibility to be carried out in the manner set out in Annex 5 to this Regulation; except for energy assessments under § 9a (1) (f) and § 9a (2) (e) of the Act,
(c) an evaluation of the environmental feasibility to be carried out in the manner set out in Annex 6 to this Regulation; with the exception of energy assessments pursuant to § 9a (1) (b), (c), (d) and (f) and § 9a (2) (d) and (e) of the Act,
(d) an assessment of the costs and benefits of ensuring high-efficiency cogeneration or recovery of waste heat in the case of an energy review pursuant to Article 9a (1) (b), (c) or (d) of the Act, which is carried out in accordance with Annex 8 to this Decree;
(e) an assessment of the performance of the parameters in the case of the processing of an energy report under Section 9a (1) (f) of the Act;
(f) the description and evaluation of the existing situation and the results set out in Annex 9 to this Decree in the case of energy assessments under Section 9a (1) (e) of the Act;
(g) an evaluation of the recommended or implemented measures in the case of the processing of an energy report pursuant to § 9a (2) (b), (c) and (d) of the Act; and
(h) an assessment of the achievement of limits in the case of the processing of an energy report pursuant to § 9a (2) (e) of the Act. ';
10.Paragraph 7 (4) reads as follows:
"(4) The recommendation of the energy expert authorised to process the energy report and its feasibility conditions shall be based on the findings made by the energy specialist authorised to process the energy report referred to in paragraph 3. ';
11. in Article 7, paragraph 5 is deleted;
12. Annex 1 to this Decree reads:

"Annex No 1 to Decree No 480 / 2012 Coll.

13. In Annex 2 to this Decree, in the table, the word "TTO 'is replaced by the word" TO'; in the column "Fuel and energy inputs, the line" LTO 'is deleted; the word "Nafta' is replaced by" TOEL '; the words "Secondary resources' are replaced by the words" Secondary resources'; the words "Renewable resources' are replaced by" Renewable resources 2); and the following explanatory notes are added after the table:
"Explanatory notes:
1) Secondary sources and their share of energy use will be reported separately.
2) Renewable sources and their share of use of energy will be listed separately. ';
14. Annex 5 to this Decree reads:

Economic evaluation
1. Economic evaluation shall be carried out according to the following criteria, with the main decision-making criterion for selecting the optimal option being the net present value criterion (NPV), the additional criteria for information by the contracting authority being the internal rate of return criterion (IRR) and the real return time criterion (TSD).

In the case of energy efficiency projects financed from support programmes from state, European funds or funds resulting from the sale of greenhouse gas emission allowances, the calculation of the economic efficiency referred to in the energy report is determined (from the point of view of the project, from the so-called system point of view) without tax and financing at constant prices corresponding to the costs of the implementation of the project. The cash flows of the project are assessed without the effect of the envisaged aid.
Explanatory notes:
1) The costs include in particular material costs, repair of equipment, planned and preventive maintenance.
2) The costs include, in particular, the costs of service, service and revision of equipment.
(3) For energy assessments under Section 9a (1) (e) of the Act, the value of the discount factor of 1,04 is determined. "
15. Annex 6 to this Decree reads:

ECOLOGICAL ASSESSMENT

Část I

Procedure for assessing the ecological feasibility of the proposal for evaluation of options for measures and optimal options for energy audit and evaluation in energy assessments.
The environmental feasibility assessment for the evaluation of the options of the measure and the optimal options in the framework of the energy audit and evaluation in the framework of the energy assessments, with the exception of the energy assessment referred to in Sections 9a (1) (a) and 9a (2) (a) of the Act, shall be carried out on the basis of a change in the emissions of pollutants at present and after the implementation of the proposed options. The calculation of pollutant emissions shall be carried out in accordance with Part II. Where production increases, an environmental feasibility assessment shall be carried out on the basis of a change in the specific production emissions of pollutants.
For the purposes of drawing up an energy assessment pursuant to § 9a (1) (a) and § 9a (2) (a) of the Act, the environmental feasibility assessment shall be carried out in a manner determined in accordance with another legislation governing the energy performance of buildings.

A. Calculation of pollutant emissions
1. the amount of pollutant emissions (TZL, SO2, NOx, NH3, VOC) shall be calculated as the product of the specific production emissions and the relevant reference values per year. The measured production emissions shall be used from a single emission measurement report carried out by an authorised person under another legislation, not more than 3 years old. If no specific production emissions data are available, the amount of emissions shall be determined as the product of the current emission factor published for the corresponding stationary resource group in the Ministry of the Environment Bulletin and the number of units of the relevant reference quantity per year. If no emission factor is available for any pollutant, emissions shall not be calculated for that pollutant. Where the main source of energy is electricity heating, the amount of emissions of pollutants from total consumption and the values referred to in point 3 shall be determined.
2. From the emission value of TZL, according to the particle ratio PM10 and PM2,5 in TZL, specific to each specific stationary source according to its technological equipment, the particulate emissions of PM2,5 shall be calculated. Current particle ratios PM10 and PM2,5 in TZL are published in the Ministry of the Environment Bulletin.

4. The calculation of the energy feasibility indicators of the design shall be made by comparing the calculated amount of emissions of individual pollutants of the starting state and the proposed variants of the design for the measure or design according to the specified criteria. If more than two variants are assessed, the table is extended accordingly, depending on the number of design variants

B. Calculation of carbon dioxide emissions
The emission factors of carbon indicate the amount of carbon or carbon dioxide per unit of energy in the fired fuel. Carbon emission factors are defined either as general or locally specific.

2. Local specific emission factors for carbon dioxide
The calculation of CO2 emissions from the combustion of fossil fuels shall be made using the formula
(fuel mass) x (fuel calorific value) x (carbon emission factor) x (1 - newer)
- where: carbon emission factor (kg CO2 / GJ fuel calorific value) is determined on the basis of the composition of the local fuel used to ensure the energy needs of a particular design,
- the recommended values for doping are 0,02 for solid fuels (stove 0,05), 0,01 for liquid fuels and 0,005 for gaseous fuels. ';

17. The following Annexes 8 and 9 are inserted after Annex 7 to this Decree:

Assessment of costs and benefits in the processing of energy assessments pursuant to § 9a (1) (b), (c) or (d) of the Act
The assessment shall be carried out by comparing the planned construction of the new installation or the planned substantial reconstruction of the existing installation (variant 1) with the comparator with the waste heat recovery system and the supply of heat from high-efficiency cogeneration or the heating supply system or from industrial plants (variant 2).
Where the construction of a new plant for separate generation of electricity or a plant without waste heat recovery is planned, a comparison shall be made between the planned new plant or the planned reconstruction of the existing plant and the comparator plant which produces the same amount of electricity or heat but has a waste heat recovery system and provides heat through high-efficiency cogeneration or heat supply systems. In doing so, any appropriate existing or potential heat demand location shall be considered with regard to technical feasibility and distance from the installation concerned.
1. Geographical and systemic delimitation of the area
The bordering of the area to be addressed shall include the planned installation and the geographical area containing the location or places of demand for heat and cold supply, the existing and planned heat supply infrastructure and future heat and cold demand.
The border of the area shall be marked on an appropriate scale and form of a cadastral map of the area concerned.
Existing source, distribution and consumer facilities are indicated in the area.
2. Determination of the default level
Data on the planned installation and the comparison device shall be summarised according to the models of the starting level tables for each of the two variants:

3. Procedure for establishing cost-benefit options
3.1. The cost-benefit analysis shall be based on a description of the planned installation and of the comparator or comparator installations and a comparison of the total cost of providing heat and electricity for these two variants. In urban areas, it also includes costs that would arise if a group of buildings or a part of a city were equipped with a new district heating network or connected to a new district heating network, i.e. infrastructure costs for both planned and comparative installations are included in the comparison.
3.2 A description shall be made for each variant containing the essential characteristics of the operation, in particular the installed thermal and electrical power, the type of primary energy source, the intended use, the planned annual number of operating hours, the location and demand for electricity and heat. If there is more than one planned installation within the system, the description shall be made for each installation. The model tables referred to in point 2 shall be used for the specification of the data in a reasonable form.
3.3 For the comparison of variants, specifications shall be made for capital costs for equipment and equipment, capital costs for related energy networks, variable and fixed costs, energy costs, environmental and health charges, determination of heat energy demand, determination of environmental effects and determination of production effects.
3.4 The economic assessment shall be carried out in accordance with Annex 5 to this Decree. Where the same manufacturing effect of the comparable variants is ensured, it may be performed as cost.
4. Recommendation of the energy specialist entitled to process the energy assessment
4.1 Based on the cost-benefit analysis of variants, a variant whose sum of discounted benefits is higher than the sum of discounted costs is recommended. In the case of a cost assessment, a variant with the lowest discounted sum of costs is recommended.
4.2 The recommendation of an energy expert authorised to process the energy assessment includes the recommended option, including the specification of the marginal conditions for its implementation.

5. Material for energy assessment
5.1 The energy assessor shall provide the energy specialist with the basic data on the planned equipment and the data on the existing system needed to determine the starting level.
5.2. In the absence of certain data on the existing system, a commented expert estimate shall be used. The data thus used shall be referred to as "expert estimate '.
5.3 The territorial plan of the cadastral territory concerned is the basis for determining the planned development in the area covered by the scheme.

Annex No 9 to Decree No 480 / 2012 Coll.
Procedure for the processing of an energy report pursuant to § 9a (1) (e) of the Act
The energy report shall contain, in respect of the subject matter, only the relevant data from the following, including the relevant parts of the annexes to this decree.
1. Description of current status
A description of the current state of the subject of the energy assessment shall contain information on:
1.1. energy assessment subject, namely:
1.1.1.the characteristics of the main activities covered by the energy review;
1.1.2. a description of the technical installations, systems including the description of the cogeneration unit according to Decree No. 37 / 2016 Coll., on electricity from high efficiency cogeneration of electricity and heat and electricity from secondary sources, and buildings subject to an energy review;
1.1.3. a situation plan,
1.2. Energy inputs over the previous 3 years, including average values obtained from accounting documents or converted into climatic conditions; the model of table processing of basic energy input data is set out in Annex 2 to this Decree,
1.3. Own energy sources, the basic technical indicators of which are set out in Annex 3 to this Decree; the annual balance of energy production from own energy sources is included,
1.4. Energy distribution; the required data are collected for main lines with the following information:
1.4.1. the species, its length, capacity, diameter, age and technical condition, thickness and state of thermal insulation,
1.4.2. energy distribution schemes, their condition and equipment shall be evaluated,
1.5. significant energy appliances, which are data on the type of appliance, power consumption, annual operating hours, the way of regulation,
1.6. The thermal technical characteristics of buildings; and
1.7. Energy management system according to EN ISO 50001.
2. Evaluation of current status
The evaluation of the current state of the subject matter of the energy review shall include:
2.1. Evaluation of energy efficiency
2.1.1. in energy sources,
2.1.2 in heat and cold distribution,
2.1.3. in significant energy appliances,
2.2. evaluation of the thermal technical properties of building structures,
2.3. Evaluation of the level of the energy management system;
2.4. the initial annual energy balance, the table of which is set out in point 1 of Annex 4 to this Decree,
2.5. a description of the possibilities of defining the system boundary of the cogeneration unit according to § 3 (5) of Decree No. 37 / 2016 Coll., and
2.6. a description of the possibilities for measuring the quantity of useful heat and the possibilities for measuring the quantity of fuel consumed pursuant to § 7 (4) (b) and (c) and § 7 (5) and (6) of Decree No. 145 / 2016 Coll., on the reporting of electricity and heat from supported sources and on the implementation of certain other provisions of the Act on Supported Energy Sources.
3. Recommendation of the energy specialist entitled to process the energy assessment
The recommendation of the energy specialist entitled to process the energy assessment concerning the proposal under consideration contains:
3.1. Description of the proposal under consideration,
3.2. Annual energy savings in MWh following the implementation of the proposal under consideration,
3.3. costs in thousands of CZK / year for implementation of the proposal
3.4. Average annual operating costs in thousands of CZK / year for implementation of the proposal under consideration,
3.5. the revised energy balance for the proposal under consideration,
3.6. a proposal for an appropriate concept of the energy management system;
3.7. a description of the marginal conditions for the proposal under consideration,
3.8. The definition of the system boundary of the cogeneration unit according to § 3 paragraph 5 of Decree No. 37 / 2016 Coll.,
3.9. the economic efficiency of using a direct method of measuring the amount of useful heat and measuring the amount of fuel consumed pursuant to § 7 (4) (b) and (c) and § 7 (5) and § 7 (6) of Decree No 145 / 2016 Coll., on the reporting of electricity and heat from supported sources and on the implementation of certain other provisions of the Act on Supported Energy Sources. '
Čl. II
Transitional provisions
1. The energy audit started before the date of entry into force of this Order shall be completed in accordance with Decree No. 480 / 2012 Coll., as effective before the date of entry into force of this Order.
2. An energy audit prepared before the date of entry into force of this Order shall be considered as an energy audit carried out under Decree No. 480 / 2012 Coll., as effective from the date of entry into force of this Order.
3. An energy assessment prepared before the date of entry into force of this decree is considered to be an energy assessment carried out under Decree No. 480 / 2012 Coll., as effective from the date of entry into force of this decree.
Čl. III
Efficacy
This decree shall take effect on the 15th day following its publication.
