DECLARATION

amending and supplementing Decree No. 11 / 1994 of the Ministry of Finance Coll., laying down details on the labelling of certain tobacco products, as amended by Decree No. 257 / 1994 Coll.
The Ministry of Finance pursuant to § 40f of the Act of the Czech National Council No. 587 / 1992 Coll., on Consumer Taxes, as amended by Act No. 325 / 1993 Coll. and as amended by § 40h of the Act No. 148 / 1995 Coll., provides:
Decree of the Ministry of Finance No. 11 / 1994 Coll., laying down details on the designation of certain tobacco products, as amended by Decree No. 257 / 1994 Coll., is amended as follows:
Article 1 (1) reads as follows:
"(1) Tobacco sticker is 22 x 45 mm. The face side is printed with offset elements. The flat two-colour grid in yellow and grey blue colours consists of two types of simple patterns. The raster is interrupted in areas with a protective microtext surface with the inscription" CZECH REPUBLIC "in the colour of grey-blue and two color rosettes in the colours of grey-blue and old-pink. The centres are filled with the yellow part of the entire grid. The text" CZECH REPUBLIC "in dark blue colour is printed twice in parallel with the longer sides of the tobacco sticker. At the right angle to these labels, in parallel with the shorter sides of the tobacco sticker, a label of the type of tobacco sticker is printed twice, i.e. for example the text" KC.20 '(for short cigarettes of length up to 70 mm) or "DC.20' (for long cigarettes of length over 70 mm), with the number indicating the number of cigarettes. The dark blue texts are always readable when the tobacco sticker" tall "is oriented in its left lower part. The central motif of the tobacco sticker is the rotogravure rotogravure in green. The tobacco sticker may be chopped on the reverse to weaken it."
2. In Section 2, the words "customs authority 'are replaced by the words" office'.
3. In Section 3, the following sentence is added at the end: "The order must indicate the number of tobacco labels corresponding to the whole sheets. '
4. The following Section 3a is inserted after Section 3:
(1) Tobacco labels are distributed by the Office to manufacturers or importers of cigarettes in B-2 sheets, i.e. 500 mm x 700 mm. 315 tobacco stickers are printed on one sheet. Distribution shall be carried out at the customer's request on the back-up refundable pallets of the Office or on pallets supplied by the manufacturer or importer of cigarettes.
(2) The advance on the repayable pallet is charged by the Office at the cost of its purchase.
(3) The amount paid as advance payment on the repayable pallet shall be reimbursed by the Office to the manufacturer or importer of cigarettes at the same rate when returning the pallet. Only the quantities of pallets which have been withdrawn from the Office for an advance shall be taken over and paid. ';
5. in Article 4 (b), the words "the customs authority 'are replaced by the words" the Office';
6. In the introductory sentence of Section 6, the words "customs authority 'are replaced by the words" office' and the words "customs authority 'in point (d).
7. In Article 7 (1), the words "customs authority 'are replaced by the words" office', the words "customs authority 'and the words" customs authority' are replaced by the words "office '.
8. In Article 7 (2), "Article 40d (1) 'is replaced by" Article 40f (1)';
9. In Annex 1, "§ 40b (1) 'is replaced by" § 40d (1)';
10. Annex 2 is replaced by Annex 2 to the new version.
11. Annex 3 is replaced by Annex 3 to the new text.
12. In Annex 4, the words "customs authority 'are replaced by the words" office'.
This Decree shall take effect on 1 January 1996.
