amending and supplementing Decree No. 149 / 1988 Coll., implementing the Social Security Act, as amended
The Ministry of Labour and Social Affairs provides, pursuant to § 177a paragraphs 1 and 2 of Act No. 100 / 1988 Coll., on Social Security, as amended by the Act of the Czech National Council No. 37 / 1993 Coll.:

1. § 4 (3), § 5 (4), § 18 (1), second sentence, § 24 (5), § 42 (2), § 56 (3), § 56a (3), first sentence, § 58 (3), second sentence, paragraph 4 and paragraph 5, second sentence, § 113, § 120 (6), § 143 to 147, § 148 (1), § 150 to 152, § 154, 156, 160 and § 172 to 174 are deleted.
2. In Paragraph 10 (1), the words "abroad 'are replaced by the words" under foreign law'.
3. In Article 11 (6), the words "the invalidity (partial invalidity) pension of the resistance participant under Article 63 (4) of the Act or 'shall be deleted.
4. In Paragraph 12 (9), the following shall be inserted after the words "employed ':" Except for the period after 30 June 1993 when a self-employed person was entitled to sickness benefit from the sickness insurance of self-employed persons or, where appropriate, to receive such sickness insurance, to carry out an armed service (civil service) or to receive financial assistance in the maternity (cash assistance) from the sickness insurance of self-employed persons'.
5. In Paragraph 19 (4), the second sentence reads: "In so doing, the expected or newly achieved earnings are compared with the average monthly earnings from which the partial disability pension is to be calculated or, where appropriate, if the citizen is partially disabled at the time of preparation for employment, the earnings determined in accordance with the second sentence of paragraph 5. '
6. In Section 23, the words "gainful activity 'and paragraph 2 are deleted in the title and paragraph 3. Paragraphs 3 and 4 shall become paragraphs 2 and 3.
7. in Article 24 (3) (b) and (c), the following words are added at the end: "nor has it begun to receive physical security for jobseekers."
8. Paragraph 37 shall be added to paragraph 7:
"(7) The placement of a child in a day-to-day establishment shall not be considered to be a place of the child until the end of compulsory education in a pre-school establishment or a school, provided that, as decided by the Director of such a establishment, his attendance in such an establishment is regulated in such a way that he does not exceed 10 hours a week. '
9. Paragraph 149 (2) reads as follows:
"(2) There is no record sheet for pupils and students."
10. Paragraph 153, paragraphs 3 and 4, paragraph 5, the words "gainful activity 'and" gainful activity' and paragraphs 6 to 9 shall be deleted. Paragraph 5 shall become paragraph 3.
11. In paragraph 157, the words "social welfare 'shall be inserted after the word" service' in paragraph 2 and paragraphs 1 and 3 shall be deleted; the numbering of paragraphs shall be deleted.
12. In Section 161, the words "in social welfare matters' are replaced by the words" services, pensioners'.
13. In the title of Part Five, the words "National Security Corps and Correspondent Corps' are replaced by the words" Police of the Czech Republic and members of the Prison Service of the Czech Republic '.
14. In Section 167, the words "National Security Corps, Members of Correctional Education Corps' are replaced by the words" Police of the Czech Republic, Prison Services of the Czech Republic, Members of other armed security corps and security services'.
15. Article 176 shall be added in paragraph 5:
"(5) Gross earnings of citizens active under the employment agreement and caregivers shall also be considered as pre-1 January 1994 earnings made as calendar months in which they did not participate in sickness insurance; these months shall also be included in the period for which the average monthly earnings are collected. ';
This Decree shall take effect on 1 January 1994.
