amending Act No. 178 / 2005 Coll., on the abolition of the National Property Fund of the Czech Republic and on the jurisdiction of the Ministry of Finance in the privatisation of the Czech Republic (Act on the abolition of the National Property Fund), as amended, and certain other related laws

Parliament has decided on this law of the Czech Republic:

ČÁST PRVNÍ

Amendment to the Act repealing the National Property Fund

Čl. I

Act No. 178 / 2005 Coll., on the abolition of the National Property Fund of the Czech Republic and on the jurisdiction of the Ministry of Finance in the privatisation of the Czech Republic's assets (Act on the abolition of the National Property Fund), as amended by Act No. 171 / 2006 Coll., Act No. 228 / 2006 Coll., Act No. 443 / 2006 Coll., Act No. 26 / 2008 Coll., Act No. 31 / 2008 Coll., Act No. 112 / 2009 Coll., Act No. 15 / 2012 Coll., Act No. 503 / 2012 Coll., and Act No. 357 / 2015 Coll., is amended as follows:

„§ 4

(1) The funds of the Fund which are to be transferred to the State, the funds from the proceeds of the sale of privatised assets, the funds from the profit of the State's participation in commercial companies and the additional revenue transferred from the State budget after the date of entry into force of this Act, are held by the Ministry in special accounts which are subordinate to the general account of the Treasury and are not part of the revenue or expenditure accounts of the State budget.

(2) For the purposes of this Act, additional revenue transferred from the State budget shall mean funds transferred to special accounts where the amount of funds in special accounts is insufficient to cover the expenditure referred to in Section 5 (3). ';

2. In Section 5 (3) of the Introductory Part of the provision, the words "and the profit from the State's participation in companies may only be used for these purposes' are replaced by the words", the profit from the State's participation in companies and the additional revenue transferred from the State budget may only be used for those purposes'.

3. In Article 5 (3) (b), the word "or 'shall be added at the end of point 2.

4. In Article 5 (3) (b), points 4 to 6 are deleted.

5. In Article 5 (3) (c) (4), the words "and to cover the costs of saving the jewels of our national identity and architectural heritage of the Czech Republic 'are replaced by", or'.

6. in Article 5 (3) (c) (5):

"5. to transfer to the state budget."

7. In Article 5 (3) (c), points 6 to 8 are deleted.

ČÁST DRUHÁ

Amendment of the Act on the Conditions for Transfer of State Assets to Other Persons

Čl. II

In Article 12 (2) of Act No. 92 / 1991 Coll., on the terms of the transfer of State assets to other persons, as amended by Act No. 210 / 1993 Coll., Act No. 179 / 2005 Coll. and Act No. 503 / 2012 Coll., at the end of point (c) comma is replaced by a dot and point (d) is deleted.

ČÁST TŘETÍ

Amendment of the Act on the State Fund for Transport Infrastructure

Čl. III

In Article 4 (1) of Act No. 104 / 2000 Coll., on the State Fund for Transport Infrastructure, as amended by Act No. 179 / 2005 Coll., Act No. 80 / 2006 Coll., Act No. 152 / 2011 Coll., Act No. 196 / 2012 Coll. and Act No. 129 / 2016 Coll., point (a) is deleted.

Points (b) to (m) shall be renumbered as points (a) to (l).

This Act shall take effect on 1 January 2019.
