defining common maintenance and minor repairs related to the use of the apartment
The Government orders the implementation of Act No. 89 / 2012 Coll., Civil Code:
Preliminary provisions
This Regulation defines the concepts of normal maintenance of the apartment and minor repairs related to the use of the apartment.
Normal maintenance of the apartment
Ordinary maintenance of the apartment means the maintenance and cleaning of the apartment, including the equipment and equipment of the apartment, which is usually carried out when using the apartment. This is mainly about painting, repair of plaster, wallpaper and cleaning of floors, including floor coverings, wall tiles, and cleaning of enclosed waste up to vertical distribution. In addition, normal maintenance means the maintenance of the apartment equipment in functional condition, regular inspection and cleaning of the items referred to in § 4 (g) and (h), checking the functionality of thermostatic warheads with electronic control, checking the functionality of the smoke alarm including the exchange of source, checking and maintenance of water supply batteries with electronic control.
Small apartment repairs
The repair of the apartment and its interior equipment shall be regarded as minor repairs if the equipment is part of the apartment and is owned by the lessor, depending on the definition in substance or the amount of costs.
Minor corrections according to the substantive definition
According to the substantive definition, minor corrections shall be deemed to be:
(a) repair of individual floors, repair of floor coverings and exchange of thresholds and bars;
(b) repair of individual parts of doors and windows and their parts, fittings and doorknobs, locks, including electronic opening of the entrance door of the apartment, and repairs of fittings, doorknobs, shutters and blinds for windows entering the interior of the apartment;
(c) repairs and exchanges of electrical terminal equipment and distribution equipment, in particular switches, sockets, circuit breakers, bells, home phones, data network outlets, signals of analogue and digital television and light sources in lighting bodies, repairs of satellite television reception equipment, repairs of audiovisual equipment used to open door doors to the house, repairs of control units and switches of ventilation, air conditioning and central vacuum cleaners, repairs of electronic security systems and automatic communication systems;
(d) replacement of shut-off valves for the gas distribution, except for the main closure for the flat;
(e) repair and replacement of closing fittings for water distribution, except for the main enclosure for apartment, exchange of siphons and fat traps;
(f) repair and certification of apartment meters according to the law on metrology or equipment for distributing the costs of heating and repairing and certification of indoor water meters hot and cold water, repair of fire detectors and smoke detectors, repair of space temperature regulators for heating systems allowing individual temperature control;
(g) repair of water effluents, odors, vapours, digestors, mixing batteries, showers, water heaters, bidets, washbasins, vans, sinks, sinks, washers, kitchen stoves, baking pipes, cookers, infrared heaters, kitchen cabinets, built-in and built-in cabinets,
(h) repair of solid fuel, gas and electricity stoves, flue-gas pipelines, electricity boilers, liquid and gaseous fuels, flue-gas pipelines, closing and regulating fittings and control thermostats of electric heating; However, the repair of radiators and central heating distribution systems shall not be regarded as such,
(i) the exchange of small parts of the articles referred to in points (g) and (h).
Minor corrections by cost
According to the cost level, additional repairs of the apartment and its equipment and the replacement of individual items or parts thereof, not listed in § 4, are considered as minor repairs if the cost per repair does not exceed CZK 1,500. Where several corrections are made on the same subject, which are related and follow-up in time, the sum of the costs of the related corrections is decisive. Transport costs shall not be included in the costs of such repairs and shall be borne by the lessee.
Annual cost limit
(1) If the sum of the costs of small repairs referred to in Sections 4 and 5 in a calendar year exceeds an amount equal to 150 CZK / m2 of floor space, further repairs in a given calendar year shall not be considered minor repairs. Transport costs shall not be included in the costs of such repairs and shall be borne by the lessee.
(2) For the purposes of this Regulation, the floor area of an apartment shall mean the sum of the floor areas of the apartment and of all areas used with the apartment, including outside the apartment, when used exclusively by the tenant of the apartment; the floor area of cellars which are not rooms, and the floor area of balconies, logbooks and terraces shall be counted only half.
Efficacy
This Regulation shall take effect on 1 January 2016.
