of 26 October 2010
establishing protection zones for sources of natural mineral waters and natural medicinal resources in Kyselce and defining specific protection measures
According to Section 46 (3) (b) of Act No. 164 / 2001 Coll., on Natural Medical Resources, Natural Mineral Water Resources, Natural Spa and Spa Places and on the amendment of certain related laws (the Spa Act) (hereinafter referred to as the Act):
Establishment of protection zones
§ 1
(Articles 21 (1), 22 and 23 of the Act)
(1) The protection zones of Grade I and II are established to protect the sources of natural mineral water which are being taken into account in the cadastral territory
(a) Acid, Karlovy Vary Region,

(2) The protection zones of Grade I and II are established to protect a natural medical resource, which is contained in the cadastral territory of Radošov near Zakolka, the region of Karlovy Vary, with a well from the source of Jindřich on land parcel No 121.
§ 2
(1) The protection zone I shall be established for the territory comprising the surrounding area of the natural mineral water sources and the surrounding area of the natural medical source (hereinafter referred to as "sources"). At the same time, a physical resource protection zone is defined.
(2) The protection zone I of the sources referred to in § 1 (1) (a) to (c) and § 1 (2) is defined by the territory of which the border is situated from the south-west corner of plot 730 / 3 in the cadastral territory of Radošov in the case of Akilka, located 10 m east of the right-hand bank of the river Ohra in the municipality of Radošov, in the eastern direction of the south border of the parcel and in the contact with the border of plot 833 / 4, 833 / 5 and 823 / 1. Furthermore, it continues to the north on the west border of plot 823 / 1 to the south border of plot 1304 and then east on the north border of plot 855 and then on the west border of plot 1296 / 1. Following this border, the length of 130 m to the north continues to the intersection of the field roads and further to the east to the north border of plot 785 / 2 to the west border of plot 777 / 2 and then to the north to the south border of plot 777 / 1 and then to the east to the west border of plot 411 in the cadastral territory of Doupov near Hradiště. It continues along the border of this parcel gradually towards the north, east and south to the north border of plot 409 and then towards the east to the west border of plot 408 and then to the south and south-west to the north border of plot 5 and then 65 m to the east. In addition, it continues to the south to the riverbed of the Lomnice stream in the cadastral territory of Bražec near Hradiště and this stream of 120 m to the south to the crossing of the creek with the purpose of communicating east - west and west along the southern edge of this road to the western border of the plot of land No 88 and then along that border to the eastern border of the plot of land No 117 and then to the south to the eastern border of the plot of land No 143 and then to the east to the eastern border of the plot of land No 145 and then to the north to the north to the northern border of the plot of land parcel No 150 and then to the east to the eastern border of the plot of land parcel No 147 and then to the west to the east to the eastern border of the parcel No 145 and then 180 m to the north. It continues to the north-west to the northern border of plot 156 and then gradually to the west and to the south to the eastern edge of plot 1253 in the cadastral area of the Akilka. It continues to westward to the eastern border of plot 1243 and then north to the border of plot 1253, 1249 / 1 and 1252. Further, 20 m to the west of the eastern border of the land parcel No 442 in the cadastral territory of Nová Zálka, which is at the same time the right bank of the river Ohře, after which it breaks at the right angle to the west of the Ohří river to the western border of the land parcel No 236 and after which to the west of the eastern border of the land parcel No 15 / 1 / 1 and after that to the west of the land parcel No 11 and then to the eastern border of the land parcel No 133 and then to the north and northwest of the western border of the land parcel No 164 / 1 and then to the north to the western border of the land parcel No 644 in the south of the land parcel No 644. It continues 80 m to the southeast across the Ohří River to the eastern border of plot 1313 / 1, which is also the right bank of the Ohře River, and then 260 m to the north. From there it leads 10 m to the exit to the starting point, which is the southwest corner of the land parcel No 730 / 3 in the cadastral territory of Radošov u Zakelka.
(3) The tier I protection zone of the sources referred to in Sections 1 (1) (d) (1) to (8) and (e) (1) (2), (4) to (10) and (12) is defined by the area of the land parcel on which the resources are located.
(4) The protection zone I of the sources referred to in § 1 (1) (e) (3) and (11) is defined by the 10 m side square at the centre of which the sources are located.
(5) The physical protection zone for the resources referred to in
(a) Paragraph 1 (1) (a) (1), except for the source of the HV 16 well, is defined by the plastic housing;
(b) Paragraph 1 (1) (b) and the source of HV 16 bore is defined by a brick shaft;
(c) Paragraph 1 (1) (a) (2) and paragraph 2 are defined by a brick object;
(d) Paragraph 1 (1) (c) is defined by gazebo and fencing;
(e) Paragraph 1 (1) (d) and (e) is defined by the territory of the protection zone I.
(6) The first-degree protection zone is graphically marked on the base map of the Czech Republic in the scale 1: 50 000, the copy of which is annexed to this decree.
§ 3
(1) The Level II protection zone is established to protect part of the infiltration territory of the established resource structure. It is defined by the territory whose border is drawn from the north edge of Velikhov, from the intersection of Velikhov - Vojkovice road with a field road along the eastern edge of this road to Vojkovice. At the intersection in Vojkovice the border continues after local communication on the eastern edge of the village towards the northeast and after 400 m the road Vojkovice - Jakubov passes. It continues 400 m to the north-west and north edge of the forest on the right bank of the Ohře. Furthermore, the border is led to the northeast between a group of three ponds and turns north. At a distance of 150 m east of the bridge through the Ohří, it crosses the military panel path and follows the pedestal 330 m above the sea in a northeast direction according to the Ohře to the edge of the forest. Then the border continues along the field road to the northeast. At the intersection of the field road with the local road in Jakubov, it turns sharply towards the southeast and continues along the southeast edge of the local road leading along the left bank of the Jakubov creek. After 440 m, in the third bridge, the border is led along the right bank of the Jacubov creek to the southeast. After 220 m, it is diverted from the watercourse and along the southern edge of the local communication passes to the east-northeast. The Jacubov stream crosses and turns sharply towards the southwest. At the point of passage of the left-hand tributary of the Jakubov creek under the road to Olešnice, it turns to the east on its southern edge. He's following the southwest edge of this northeast road. At a distance of 850 m northeast of the intersection of the field road Jakubov - High with the road Olešnice - Velichov is turning in the southeast direction in Olešnice, Petrovský brook crosses and in the straight direction is guided over the cubit 650 m above the sea, Watchtower 722 m above the sea to the cubit 746 m above the sea. Here it turns in the south direction and after 100 m is guided along the field road in the southwest direction, in the turn of the field road it passes in the straight direction to the cubicle of Kameniste 698 m above the sea. From there it continues in the southeast direction to the crossroads. It is also guided by a field road to the southeast to the intersection of the field road with the road Zakšov - Doupov. Following its northeast edge it is led to the intersection with the road Svatobor - Doupov in Jalová Dvoře, where it turns in a sharp angle along the northwest edge of this road to the southwest. It is also guided by the southwest edge of the road Svatobor - Doupov. At the crossroads at the hunting grounds, it turns in a sharp angle along the forest road to the southeast. After 260 m it is diverted to the southwest at the right angle and continues in the straight direction through the Truce stream on the forest road on the right bank of the Truce creek. Following the forest road is led northwest to a sharp corner at the point of the right-hand tributary of the Truce Creek. It continues in a straight west direction to a cubicle 590 m above sea level. It is further led to the north edge of the triangle draw. It turns southwest and continues after 280 meters on the forest road to Lucina. At a distance of 80 m below the confluence of Lucinské creek with right-hand nameless watercourse it is guided along the north-northwest edge of the road to Dubina. At a distance of 220 m northeast of the right turn of the Dubin road - The acid turns along the border of the protection zone after the flow of the Dublin stream to the northwest and after 200 m crosses the Ohří. It continues in the northwest direction under high voltage up to about 450 m southeast of the pod Na Pastviny - 516.4 m above sea level to the intersection of the road with the forest road. From this intersection it is led in a northern direction along a forest road to the northern edge of the Cold Hill Forest Complex. It continues in a direct direction towards the northwest. At a distance of 600 m west-southwest of the children's health facility in Radošov, the road Stráň - Radošov passes at the point of transit from which it leads about 300 m in the north direction to the rock formation. It continues in a 100 m northeast direction, where it is led along a forest road to a cubicle of 475 m above sea level. It continues along the forest path in the form of the letter "S" to the northeast to the cubicle 495 m above the sea (Above the Pond). From there, it is guided by a forest road to the northeast. It turns further along the forest road to the east on the edge of the forest. At a distance of 90 m south-east of the bridge under the road Moríčev - Velichov turns southeast along the southwest edge of the road Moríčev - Velichov to the sharp corner of the road where it turns sharply towards the northeast. The border is on the eastern edge of the road. Over the bridge over the Ohře cross the northern edge of the road and up to the intersection with the road Kylka - Vojkovice in the village Velichov. From the crossroads it is guided to a local road in a 100 m southeast direction and at the crossroads in the shape of "Y" it turns to a local road to the north to the starting point, at the crossroads with Velikhov - Vojkovice on the north edge of Velikhov.
(2) The Class II protection zone is graphically marked on the base map of the Czech Republic in the scale 1: 50 000, the copy of which is annexed to this decree.
§ 4
The definition of protection zones I in a copy of the cadastral map in the scale 1: 2 000 and protection zones II in the basic maps of the Czech Republic in the scale 1: 10 000 and 1: 50 000 is available at the Ministry of Health, the Municipal Office in Kyselce, the Central Office of the Military Debit of the Hradiště and the Regional Office of the Karlovy Vary Region.
Definition of specific safeguard measures
§ 5
(K § 22 of the Act)
(1) In the protection zone I, unless the zone of physical protection of the source is at the same time, it is prohibited to:
(a) conduct mining activity, mining activity (1) and landscaping (2) permanently disrupting continuous soil cover and rock ground; If the work and arrangements necessary for the protection and use of resources are concerned, the provisions of Section 37 of the Spa Act shall be followed;
(b) carry out the tearing work1),
(c) to establish heat energy wells;
(d) carry out activities affecting minimum groundwater levels;
(e) to conduct intensive livestock and game farming (3);
(f) apply fertilisers with rapidly released nitrogen (4);
(g) treat particularly dangerous substances or dangerous substances or substances to a greater extent, or when handling them is associated with an increased risk to surface or groundwater; If the treatment required for the protection and use of resources is concerned, the Water Act (5) shall be followed;
(h) establish and operate waste lands6),
(i) to establish waste sinks, slaughterhouses and incinerators;
j) camp freely in nature.
(2) The activities provided for in paragraph 1 (b), (c), (d), (f), (g), (i) are prohibited in the protection zone II.
§ 6
(1) The Class I protection zones provided for in paragraphs 3 and 4 of Section 2 shall be fenced.
(2) In the territory of the zone of physical protection of sources of natural mineral water and natural medical resources, unauthorised entry is prohibited.
§ 7
Transitional provision
The activities referred to in Article 5 (1) and (2), if carried out in protection zones I and II, shall be completed within 2 years of the entry into force of this Decree.
§ 8
Efficacy
This Decree shall take effect on 1 January 2011.
