of 4 August 2000
amending Act No. 156 / 1998 Coll., on Fertilisers, Soil Auxiliary Substances, Auxiliary Plant Products and Substance and on Agrochemical Testing of Agricultural Soils (Fertilisers Act) and Act No. 569 / 1991 Coll., on the Land Fund of the Czech Republic, as amended
Parliament has decided on this law of the Czech Republic:
Amendment of the Fertiliser Act
Act No. 156 / 1998 Coll., on fertilisers, soil aid, plant aid products and substrates and on agrochemical testing of agricultural soils (Fertilisers Act) is amended as follows:
1. In Article 1 (2), at the end of point (c), the comma is replaced by a dot and point (d) is deleted.
2. In Article 2 (b), the word "in particular 'shall be inserted after the word" emerging'.
3. In Article 2 (f), the words "manure," shall be inserted after the words "manure,"
4. In Article 2, at the end of point (i), the comma is replaced by a dot and point (j) is deleted.
5. in Article 3 (1) (a), the comma after the word "the law" shall be replaced by a semicolon and the following words shall be inserted: "this shall not apply in respect of a fertiliser complying with the requirements of this law which corresponds to the type of fertiliser referred to in the Decree, which the Decree provides for as EC fertiliser and which is marked by the words" EC FERROY. "
6. In Paragraph 4 (2) (c), the word "commercial 'is deleted.
7. in Article 4 (6) (b), the figure "12" is replaced by the figure "18."
8. In Article 4 (10), the words "(including EC fertilisers) 'shall be inserted after the words" fertiliser types'.
9. in Article 5 (1) (d), the words "including restrictions on the use of fertiliser for fertiliser mixtures" shall be deleted;
10.Paragraph 5 (6) reads as follows:
"(6) Where the Institute makes a decision to cancel the registration of a fertiliser referred to in paragraph 4 (b), it may at the same time provide that the fertiliser must be withdrawn from circulation. ';
footnote 8 is deleted;
11. in Article 7 (1) (f), the words "where appropriate, instructions for use," shall be deleted;
12. in Article 7 (1) (g), the words "packing units or deliveries" are replaced by the words "fertilizers supplied."
13. footnote 9 shall read:
"9) For example Act No. 20 / 1966 Coll., on the care of the health of the people, as amended, § 9 et seq. of Act No. 634 / 1992 Coll., Act No. 157 / 1998 Coll., on Chemicals and Chemicals and on the amendment of certain other laws, as amended."
14. In Article 7, the following paragraph 8 is inserted after paragraph 7:
"(8) Fertilisers complying with the provisions of this Act which correspond to the type of fertilizer referred to in the Decree and which the Decree provides to be EC fertilisers shall be referred to as" EC FERTINGS. "'
Paragraph 8 shall become paragraph 9.
15. in Paragraph 8 (1), the words "owners of forest land operating on such land" shall be inserted after the words "(hereinafter referred to as" the farmer in agriculture ")."
16. In the first sentence of Article 8 (3), "water 'is replaced by" water'.
17. in Article 9 (1), the words "and owners of forest land operating on these parcels" shall be inserted after the words "Farmers in Agriculture."
18. in Paragraph 9 (2), the introductory sentence is replaced by the following: "Fertilisers, manure and aids shall not be used on agricultural land and forest land."
19. in Article 9 (2) (a):
"(a) where the way in which they are used does not allow for uniform coverage of the land,"
footnote 12 is deleted;
20. in Paragraph 9 (2) (c), the words "land" shall be inserted after the words "threatening."
21. in Article 9, paragraph 3 is deleted;
Paragraphs 4 to 6 shall become paragraphs 3 to 5.
22. in Article 9 (3), the words "operating on such land" shall be inserted after the words "owners of forest land."
23. in Article 9 (4), the words "under paragraph 4" shall be replaced by the words "under paragraph 3" and the words "on these parcels" shall be inserted after the words "forest owners."
24. the first sentence of Paragraph 10 (4) shall read: "The administrative rules shall not apply to the issue of authorisations. 13)."
25. in Article 12 (2) (b), the words "and owners of forest land operating on such land" shall be inserted after the words "farmers in agriculture."
26. In Article 12 (3), the words "and owners of forest land operating on such land 'shall be inserted after the words" agricultural entrepreneurs'.
27. in Article 13 (1), the words "or the owners of forest land operating on such land" shall be inserted after the words "farmers in agriculture."
28. In Article 13, the following paragraph 4 is added:
"(4) The provisions of paragraphs 1 to 3 shall apply mutatis mutandis to the excipients.";
29. in Article 14 (2), the words "the operator of such land" shall be inserted after the words "or the owner of forest land" and the words "pursuant to § 9 (4) and (5)" shall be replaced by the words "Article 9 (3) and (4)."
30. In Article 14 (3), the words "or the owner of forest land operating on such land 'shall be inserted after the words" an agricultural operator'.
31. in Paragraph 14 (4) (b), the words "or the owner of forest land" shall be inserted after the words "farm operator."
32. In the introductory sentence of Article 16, the words "§ 7 (8) 'are replaced by the words" § 7 (9)', the words "§ 9 (6) 'are replaced by the words" § 9 (5)' and in point (b) the words "(including EC fertilisers) 'are inserted after the words" fertiliser types'.
EFFECTIVE
This Law shall enter into force on 1 January 2001, with the exception of Part Two, which shall take effect on the day of its publication, and with the exception of Part One, paragraph 1, paragraph 1, of Article 2, paragraph 1, of this Article. I points 5 and 14, which take effect on the date on which the Treaty of Accession of the Czech Republic to the European Union enters into force.
