Local availability
Dossier periods expressing the local availability of health services covered by public health insurance (hereinafter referred to as "covered services') are set out in Annex 1 to this Regulation. The range periods specified for each branch or service are defined as the most final possible.
Time availability
(1) For the purposes of this Regulation, scheduled paid services shall be those covered by the provision of which, for reasons of public interest (1), must be planned in such a way as to ensure adequate, sustainable and balanced access for insured persons. The planned covered services are listed in Annex 2 to this Regulation.
(2) The planned paid services shall be provided within a period which is medically justifiable and based on an objective medical assessment of the current health status of the insured person, the history and the likely course of his illness, his pain or the nature of his illness (hereinafter referred to as "time-availability period '). The time-limit for availability shall be set in the framework of the establishment of an individual treatment procedure (2) treating the healthcare worker (3), which indicated the intended service to be paid, which shall not exceed the time-limit set for that scheduled service in Annex 2 to this Regulation. The period of availability shall begin on the day following the day on which the medical practitioner indicated the intended service and the need for the service and the period of availability for providing it has been entered in the health file by the insured person. This is not the case where the health insurance undertaking ensures that the insured person provides the planned service within the specified time limit, but the insured person chooses another contractual provider to provide the planned service after that period.
(3) The planned services are not covered and the procedure referred to in paragraphs 1, 2 and Annex 2 to this Regulation shall not apply if the health service referred to in this Annex needs to be provided as emergency or emergency medical care.
Efficacy
This Regulation shall take effect on 1 January 2013.
