THE LAW
of 12 November 1997
amending and supplementing Act No. 113 / 1993 Coll., on the Fund for Children and Youth
Parliament has decided on this law of the Czech Republic:
Act No. 113 / 1993 Coll., on the Fund for Children and Youth, is amended as follows:
1. In Article 4 (2), the following shall be inserted after the words "natural and legal persons':" and from the sale of such holdings'.
2. In Paragraph 5 (3), the first sentence is: "At the end of the year, the Fund shall draw up the annual accounts at the same time as the annual activity report of the Fund (hereinafter referred to as the" Annual Report ") and submit them to the Government and to the Chamber of Deputies for approval within three months of the end of the financial year. '
3. In Article 6 (1), the following words are added after the words "the law" and "comma," and at the end, the words "the Fund" are added: "and the business and other activities referred to in Article 4 (2)."
4. In Article 6 (4) (b), the following shall be inserted after the word "property ':" and participating interests'.
5. In Article 6 (4) (c), the following shall be inserted after the words "commercial company ':", general utility company, 2a)' and the words "or cooperative 'shall be replaced by the words" cooperative'.
6. Note No 2a) reads as follows:
"(2a) Act No. 248 / 1995 Coll., on public utility companies and amending and supplementing certain laws."
7. In Article 6, the following paragraph 6 is inserted after paragraph 5:
"(6) The Government shall be entitled, where justified, to give its consent to the Fund's action which would lead to a reduction in the total value of the assets at comparable prices than the value of the assets entrusted to the Fund by this Act on the effective date of registration of the Fund. ';
Paragraph 6 shall become paragraph 7.
8. In Paragraph 6 of the new paragraph 7, the words "on the activities of the Fund (hereinafter referred to as the" Annual Report ") 'are deleted.
9. in Paragraph 9 (3) (d), the dot at the end is replaced by a comma and the following point (e) is added:
"(e) where he performs a function incompatible with the duties of chairman or member of the Committee.";
10. Paragraph 18 shall be added in paragraph 5:
"(5) Pending the adoption of the Special Act, the Fund shall, in the exercise of its rights and obligations in the management of assets, comply mutatis mutandis with the provisions of Decree No. 119 / 1988 Coll., on the Management of National Property, as amended. '
11. in Article 19 (1), the words "the Special Act" shall be replaced by the words "the Decree of the Government issued under this Act."
12. In Article 19 (2), the words "enter into force of a special law 'are replaced by the words" enter into force of a government regulation pursuant to paragraph 1'.
The effective date of this Act is transferred to the Fund of Children and Youth Real Estate Property Owned by the Czech Republic, to which the right of permanent use was established for the former Socialist Youth Union, and which was not revoked on the effective date of this Act.
This Act shall take effect on the day of its publication.
