laying down certain conditions for the implementation of exceptional financial support to agricultural sectors affected by specific problems affecting the economic viability of farmers in 2023
The Government orders pursuant to § 2b (2) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 85 / 2004 Coll., Act No. 291 / 2009 Coll., Act No. 179 / 2014 Coll. and Act No. 382 / 2022 Coll., and § 1 (3) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act No. 441 / 2005 Coll., Act No. 291 / 2009 Coll. and Act No. 179 / 2014 Coll.:
§ 1
Subject matter
This Regulation provides for certain conditions for the implementation of exceptional financial support for agricultural sectors affected by specific problems affecting the economic viability of farmers in 2023, hereinafter referred to as "exceptional aid ', following the directly applicable regulation of the European Union1. The State Agricultural Intervention Fund (" the Fund').
§ 2
Request for emergency support
(1) The Fund shall grant exceptional support on application for:
(a) fruit growers;
(b) vegetable growers,
(c) hop growers; or
(d) breeders of cows kept in the dairy farming system (the dairy farmer).
(2) The applicant shall submit to the Fund an application for emergency support by 31 October 2023 at the latest.
§ 3
Conditions for granting exceptional aid to fruit growers
(1) An applicant for exceptional aid for fruit growers may be a natural or legal person who manages the agricultural land registered on the land register as a type of agricultural culture of fruit orchards and receives aid for the production of fruit species during the grant period of 2022.
(a) a very high level of work pursuant to Article 22 of the Government Regulation No 50 / 2015 Coll., laying down certain conditions for the granting of direct payments to farmers and amending certain related regulations of the Government, as amended, and at the same time applying for the subsidy period of 2023 for aid for the production of fruit species with very high working capacity pursuant to Article 30 of the Government Regulation No 83 / 2023 Coll., laying down conditions for the granting of direct payments to farmers; or
(b) by virtue of Article 23 of the Decree of the Government No. 50 / 2015 Coll. and at the same time applied for the subsidy period of 2023 for aid for the production of high-performance fruit species pursuant to Article 31 of the Decree of the Government No. 83 / 2023 Coll.
(2) The Fund shall grant to the applicant the exceptional support referred to in paragraph 1 (a) for the area of the cultivated part of the soil block or part thereof kept in the land use register according to the user relations of the applicant with the type of agricultural culture fruit orchards for which the applicant has received aid for the production of fruit species with a very high working capacity in accordance with Article 22 of Decree-Law No 50 / 2015 Coll.
(3) The Fund shall grant the applicant exceptional support under paragraph 1 (b). (b) the area of the cultivated part of the soil block or part thereof kept in the land use register according to the user relations of the applicant with the type of agricultural culture of fruit orchards for which the applicant has received aid for the production of high-performance fruit species under Section 23 of the Government Decree No. 50 / 2015 Coll.
§ 4
Conditions for granting exceptional aid to vegetable growers
(1) An applicant for exceptional support for vegetable growers may be a natural or legal person who manages the agricultural land registered on the land register as a type of agricultural culture, a standard arable land, another permanent culture or area with multi-annual production crops, and has received aid for the production of vegetable species during the subsidy period of 2022 with:
(a) a very high level of work pursuant to Article 25 of Decree-Law No 50 / 2015 Coll. and at the same time applied for aid for the production of vegetable species with very high working capacity pursuant to Article 32 of Decree-Law No 83 / 2023 Coll. or for the production of vegetable species with high working capacity pursuant to Article 33 of Decree-Law No 83 / 2023 Coll., or
(b) by virtue of Article 26 of Decree-Law No 50 / 2015 Coll. and at the same time applied for the subsidy period of 2023 for aid for the production of vegetable species with very high working capacity pursuant to Article 32 of Decree-Law No 83 / 2023 Coll. or for the production of vegetable species with high working capacity pursuant to Article 33 of Decree-Law No 83 / 2023 Coll.
(2) The Fund shall provide the applicant with the exceptional support referred to in paragraph 1 (a) for the area of the cultivated part of the soil block or part thereof kept in the land use register according to the user relations of the applicant with the type of agricultural culture standard arable land or other permanent culture for which the applicant has received aid for the production of very high-performance vegetable species under Section 25 of Government Decree No 50 / 2015 Coll.
(3) The Fund shall grant the applicant exceptional support under paragraph 1 (b). (b) the area of the cultivated part of the soil block or part thereof kept in the land use register according to the user relations of the applicant with the type of agricultural culture of standard arable land for which the applicant has received aid for the production of high-performance vegetable species in accordance with § 26 of the Government Decree No. 50 / 2015 Coll.
§ 5
Conditions for granting exceptional aid to hop growers
(1) The applicant for the grant of exceptional aid to hop growers may be a natural or legal person who manages the agricultural land registered on it in the land use register as a type of agricultural hop culture and has received aid for the production of hops pursuant to Article 21 of Decree-Law No 50 / 2015 Coll. and at the same time submitted an application for aid for the production of hops under Article 29 of Decree-Law No 83 / 2023 Coll.
(2) The Fund shall provide the applicant with the exceptional support referred to in paragraph 1 for the area of the cultivated part of the soil block or part thereof held in the land use register according to the user relations of the applicant with the type of agricultural crop of hops for which the applicant has received aid for the production of hops in accordance with Article 21 of the Government Regulation No 50 / 2015 Coll.
§ 6
Conditions for granting exceptional support to dairy farmers
(1) The applicant for the grant of exceptional aid for dairy cows may be a natural or legal person who is registered on the date of receipt of the aid application as a dairy farmer under the Breeding Act and at the same time applied for the grant period of 2023 for the aid for breeding of cows kept in a system of dairy farming pursuant to Article 37 of Decree-Law No 83 / 2023 Coll.
(2) The Fund shall grant the applicant exceptional support referred to in paragraph 1 for the total number of cows kept by the applicant in a system of dairy farming on 31 March 2023 kept in the central register under the breeding law provided that the number was at least 2.
§ 7
Publication of exceptional aid rates
The amount of the exceptional support rates shall be published by the Fund by 30 November 2023 at the latest in a way that allows remote access.
§ 8
Refusal of an application for emergency aid
The Fund shall reject the application if it finds that the applicant:
(a) has received an application for emergency aid after the period laid down in Paragraph 2 (2); or
(b) has not fulfilled the conditions for granting exceptional aid.
§ 9
Efficacy
This Regulation shall take effect on 15 October 2023.
