laying down certain conditions for the supply of food from intervention stocks for the benefit of the most deprived persons
The Government orders pursuant to § 2b (2) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 128 / 2003 Coll. and Act No. 441 / 2005 Coll., and under § 1 (3) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act on the State Agricultural Intervention Fund), as amended by Act No. 441 / 2005 Coll.:
Subject matter
This Regulation (1) provides for certain conditions for the supply of food obtained from agricultural products or processed agricultural products from intervention stocks (hereinafter referred to as "intervention stocks') for the benefit of the most deprived persons by the State Agricultural Intervention Fund (hereinafter referred to as" the Fund ') in the Czech Republic.
Food Distribution Organisations
(1) The distribution of food from intervention stocks under the European CommunityRegulation (4) to persons in an unfavourable social situation linked to the loss of housing (hereinafter the "poorest persons") is carried out by:
a) Czech Federation of Food Banks registered with the Ministry of the Interior of the Czech Republic under the number II / S-OS / 1-23800 / 94-R, Warsaw 37, 120 00 Prague 2,
b) Association of Czech Catholic Charities registered with the Ministry of Culture of the Czech Republic under the number 8 / 1-00-702 / 1999, Vladislav 12, 110 00 Praha 1
("distributor ').
(2) Foodstuffs referred to in paragraph 1 shall be provided in the form of food or food aid for the provision of food in shelters and in low-threshold daily centres providing outpatient and, where appropriate, off-road services for shelters.
Application for the supply of food from intervention stocks
(1) An application for the supply of food from intervention stocks (hereinafter referred to as "the application") shall be submitted by the distributor of the Fund by 15 March of the calendar year in which he intends to open the distribution of food from intervention stocks using the form issued by the Fund.
(2) The application shall include:
(a) an indication of the number of the most deprived persons who have received or helped to provide food and the type and quantity of food provided to the most deprived in the calendar year preceding the calendar year of application;
(b) an indication of the quantity and the nominal quantity of 5) for each of the food types listed in the Annex to this Regulation which the distributor requires, with the lowest total annual requirement being 500 kg per type of food,
(c) the timetable for the collection of foodstuffs referred to in point (b), which shall be set at monthly intervals;
(d) the address of no more than 5 warehouses on the territory of the Czech Republic to which each type of food is to be delivered,
(e) a declaration by the distributor and the legal persons associated with the distributor that they will provide food from intervention stocks for the benefit of the most deprived persons free of charge.
(3) The maximum requirement for each type of food from intervention stocks for the relevant calendar year per person is set out in the Annex to this Regulation.
(1) The Fund shall decide on the supply of food from intervention stocks to the distributor in the quantity indicated in the application referred to in Article 3 (2) (b), where appropriate adjusted in accordance with paragraph 2 and following the results of the selection procedure referred to in Article 5.
(2) If the total quantity requirements for food from intervention stocks referred to in non-rejected applications exceed the values set out in the annual plan adopted by the European Commission7), the Fund will reduce the quantity of food from intervention stocks to all distributors by using the conversion factors set out in the Annex to this Regulation.
Selection procedure
(1) The Fund will select a natural or legal person in the selection procedure to supply distributors with food from intervention stocks stored in the territory of the Czech Republic or in the territory of other Member States of the European Union (the supplier).
(2) The invitation to the Fund to submit tenders shall include:
(a) the identification of the agricultural product offered or the processed agricultural product, the place of its storage, the conditions for its removal by the specified data8);
(b) the designation of the food types required as set out in the Annex to this Regulation, their quantity and the type of nominal quantity of content;
(c) the addresses of the distributors' warehouses and delivery dates to the distributors' warehouses according to the timetable;
(d) the requirement to ensure the transport of food from intervention stocks from the supplier to the stores of distributors.
(3) The Fund shall select the most favourable tender in respect of:
(a) the quantity of agricultural product or processed agricultural product required to obtain each type of food from intervention stocks;
(b) the prices of food transport from intervention stocks to distributors' warehouses.
(4) Where an agricultural product or processed agricultural product is not stored in intervention warehouses in the territory of the Czech Republic or in any of the other Member States of the European Union9), the Fund shall issue and evaluate the selection procedure referred to in paragraphs 1, 2 (b) to (d) and 3 (b) and according to the quantity of food offered listed in the Annex to this Regulation obtained on the European Union market.
Supply of food from intervention stocks
(1) The supplier, selected in accordance with Article 5 (1), shall mark the food from intervention stocks on the packaging intended for consumers or food service establishments by the words "EC assistance," in a visible, easily legible, not covered, uninterrupted by other data and in an indelible manner.
(2) Fund
(a) provide payment for the processing and packaging of food from intervention stocks and provide payment for the packaging of processed agricultural products in the form of an agricultural product and a processed agricultural product, or for food from intervention stocks obtained on the European Union market in cash;
(b) provide payment for the transport of food from intervention stocks from the supplier to distributors in cash.
Transitional provision
In 2006, the application referred to in Article 3 (1) shall be submitted to the Fund within 10 days of the date of entry into force of this Regulation.
Efficacy
This Regulation shall enter into force on 15 June 2006.
