GOVERNMENT REGULATION
of 3 September 2003
amending Government Regulation No 86 / 2001 Coll., laying down the conditions for granting financial aid for the placing of land at rest and financial compensation for the placing of land at rest and the principles for the sale of oilseed rape on land put at rest, as amended
The Government orders the implementation of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act on the State Agricultural Intervention Fund), as amended by Act No. 128 / 2003 Coll.:
Government Decree No. 86 / 2001 Coll., laying down the conditions for granting financial support for the placing of land at rest and financial compensation for putting land at rest, and the principles for the sale of oilseed rape produced on land put at rest, as amended by Government Decree No. 454 / 2001 Coll. and Government Decree No. 294 / 2002 Coll., are amended as follows:
1. In Paragraph 1 (1) of the Introductory Part of the provision, the words "Under Paragraph 1 (2) (a) (2) and (5) of the Act," shall be deleted, "after the words" (hereinafter referred to as the Fund), "shall be inserted after" (hereinafter referred to as the Fund), "and in the final part of the text the words" during the period 'shall be replaced by "after the period' and" 2005 'shall be replaced by "2003'.
2. in Paragraph 1 (1) (a), "financial support" is replaced by "subsidy."
3. in Paragraph 1 (1) (b), "financial compensation" is replaced by "subsidy."
4. In Section 5, the amount "600 CZK 'is replaced by" 1000 CZK'.
5. In Article 10, the words "in the period until the end of the 2002 / 2003 marketing year 'shall be added at the end of the text of paragraph 4.
6. In Paragraph 11, the following paragraph 3 is inserted after paragraph 2:
"(3) Where a lower quantity of oilseed rape than that offered by the Fund pursuant to paragraph 1 is delivered to the Fund, the Fund shall purchase such different quantities in the selection procedure announced by it or on commodity or crop exchanges, as appropriate. ';
Paragraph 3 shall become paragraph 4.
7. in Paragraph 13 (2) (b):
"(b) an undertaking by the buyer to produce during the processing year from each tonne of oilseed rape bought under this Treaty 0,2658 tonnes of rapeseed methyl ester at the average oilseed oil content of at least 36%, or 0,2874 tonnes of rapeseed methyl ester at the average oilseed oil content of at least 38%, or 0,3125 tonnes of rapeseed methyl ester at the latest by 30 April 2004,"
8. in Article 13 (2), points (c), (d) and (g) are deleted;
Points (e), (f) and (h) to (j) shall be renumbered as points (c), (d) and (e) to (g).
9. In Paragraph 14 (1), the words "(f) and (g) 'are replaced by" (d)'.
10. in Article 16a (5), "1 August to 30 September" is replaced by "1 April to 31 August";
11. in Paragraph 17 (2), "30 September 2005" is replaced by "30 April 2004";
12. In Annex 4, point 2, "40% 'is replaced by" 36%'.
Transitional provision
For the 2002 / 2003 marketing year The Fund shall decide on the granting of financial compensation and forward its written decision to the applicant by 31 October 2003.
Efficacy
This Regulation shall enter into force on the day of its publication.
