DECLARATION
Energy Regulatory Authority
of 20 August 2001
on the quality of electricity supply and related services in electricity
According to Article 98 (8) of Act No. 458 / 2000 Coll., on the terms and conditions of business and on the exercise of public administration in the energy sector and on the amendment of certain laws (hereinafter referred to as "the Act '), the Energy Regulatory Authority provides for the implementation of Article 17 (7) (a) of the Act:
Basic provisions
(1) This decree sets out the quality of the supply of electricity and related services, which is expressed in quality standards for the supply of electricity and related services. Quality electricity supply means the supply of electricity to a customer of a transmission system operator or distribution system operator meeting all the quality standards referred to in this Decree and in special legislation.1)
(2) Compliance with the quality standards for electricity supply and related services is included in regulated prices. Failure to comply with quality standards for electricity supply and related services is a reason for adjusting regulated prices. Non-compliance with the quality standards of supply and related services is not considered to be a restriction or interruption of the supply of electricity to the extent necessary pursuant to § 24 (3) (c) and § 5, § 25 (4) (d) and § 6 of the Act.
(3) The quality standards for electricity supply and related services are subdivided into:
(a) guaranteed standards of supply of electricity and related services which determine the level of supply and services to be achieved in each individual case;
(b) the general quality standards for the supply of electricity and related services referred to in Article 3 which apply where it is not possible to apply guaranteed standards but where customers have the right to expect a pre-determined level of service.
Guaranteed quality standards for electricity supply and related services
(1) The guaranteed quality standards for electricity supply are:
(a) the electricity quality standard, which is primarily the frequency and voltage quality guaranteed by the transmission system operator and distribution system operator in accordance with the recommended CSN standard, 2)
(b) the standard for the removal of fault breaks in the main low-voltage housing, which is part of the electrical connection, by the distribution system operator is less than 6 hours, except for the accumulation of failures that have elapsed since the transmission system operator or distribution system operator was informed of the failure of the fuse;
(c) the standard for the restoration of the supply of electricity to the transfer point when the transmission system operator or distribution system operator commences work on the restoration of electricity supply
1. from an installation up to a voltage level of 1 kV within 3 hours from the time it is informed of the failure in the distribution system and within 24 hours it shall restore the supply of electricity to all customers connected to that voltage level,
2. from an installation with a voltage greater than 1 kV within 2 hours from the time it is informed of a failure in the transmission or distribution system and within 12 hours it shall restore the supply of electricity to all customers connected to that voltage level installation.
(2) The guaranteed standards of electricity supply services are:
(a) the standard of communication of the terms and conditions for the connection of the customer demand point to the transmission or distribution system operator's facility, which means communication of the terms and conditions of the demand point connection of the transmission or distribution system operator sent within 30 calendar days of receipt of the request. In the event that the measurement of network operation is necessary, this deadline shall be extended by the measurement period, but not more than 60 calendar days; the applicant must be informed within 21 calendar days of the date of receipt of the application at the latest;
(b) the standard of connecting the customer's demand point to the transmission system operator's or distribution system operator's installation of the electrometer and the start of electricity supply by the transmission system operator or distribution system operator within 5 working days of the customer meeting the conditions for connecting the demand point prescribed by the transmission system operator or distribution system operator;
(c) the standard of handling the electricity quality complaint by the transmission system operator or distribution system operator, which means the deadline for handling the electricity quality complaint, i.e. checking the validity of the electricity quality complaint and the written notification by the complainant within 30 calendar days of receipt of the complaint. The notification shall include a statement of the validity of the complaint and, where the complaint is justified, a way of rectifying the deficiencies or of extending the period of execution. In this case, the complainant must be informed of the date of the final decision on the validity of the complaint, with an extension not exceeding a total period of 90 calendar days from receipt of the complaint,
(d) the standard of processing the application for a check on the accuracy of the measurement equipment by the transmission system operator or distribution system operator, which means the exchange of the measuring equipment or the verification of the accuracy of measurements within 15 calendar days of receipt;
(e) the standard of handling the electricity bill complaint, which means informing the complainant in writing of how the electricity is to be charged by the TSO or distribution system operator within 15 calendar days of receipt of the complaint; the standard also includes a response to the customer's request to change payment terms,
(f) a standard for the negotiation of meetings with customers, which means the offer of a meeting by the TSO or distribution system operator to the client to deal with its issues; The meeting shall be agreed at an agreed time between 8 and 18 hours on working days, the deadline being communicated to the customer in writing, exceptionally, if this agreed deadline cannot be complied with, the new appointment must be agreed in writing,
(g) the re-connection standard of the customer demand point disconnected from the transmission operator's or distribution system operator's installation due to a repeated non-compliance with the agreed method of payment for the electricity withdrawn, including advances or non-compliance with the payment obligations resulting from the evaluation and settlement of actual purchases, which means the connection of the customer's demand point to the transmission system operator's or distribution system operator's facility within 24 hours of the customer's proof of full payment to the relevant transmission system operator or distribution system operator;
(h) the standard of sending a response to a customer's correspondence within 15 calendar days of receipt, unless it is the standard referred to in paragraph 2 (a), (c), (e), (g);
(i) the standard of exchange or transponder of the electrometer which is meant for distribution system operators
1. exchange of measuring equipment on change of tariff within 5 working days from the moment the customer has fulfilled the conditions for granting the new rate;
2. the transfer of the measuring equipment within 5 working days of receipt of the customer's request, provided that the sampling site complies with the legislation and technical standards.
General quality standards for electricity supply and related services
(1) The general quality standards for electricity supplies are:
(a) the standard of the aggregate interruption of the supply of electricity to transmission system operators and distribution system operators;
(b) the frequency of interruption of electricity supply to transmission system operators and distribution system operators.
(2) On the basis of the fulfilment of the general standards referred to in paragraph 1, the Authority shall evaluate the reliability of the supply of electricity to transmission and distribution customers.
(3) Exceptional interruptions in the supply of electricity recognised by the Authority shall mean all forced interruptions in the supply of electricity to customers in cases where there is an emergency under Paragraph 54 (1) of the Act.
(4) The calculation of the general electricity quality standards shall be carried out by the TSO or distribution system operators in accordance with a single procedure approved by the Authority.
(5) Any interruption in the supply of electricity shall be any interruption in the supply of electricity to a customer with a duration of more than 3 minutes, regardless of whether the cause of the event was in or outside the transmission system operator's facility or distribution system of another operator. The interruption of the supply of electricity shall not be considered as a interruption of the supply of electricity to a customer whose own demand facility or the electricity connection owned by it or the common home installation is the cause of which there is no restriction on the supply of electricity to any other customer.
(6) The failure of the supply of electricity is:
(a) any interruption in the supply of electricity to customers when the transmission system operator's installation is created and removed pursuant to Article 24 (3) (c) (7) or the distribution system operator pursuant to Article 25 (4) (d) (7) of the Act;
(b) any self-disconnection of the supply of electricity or of the incorrect disconnection of the supply of electricity by personnel connected with the interruption of supply of electricity to customers;
(c) any hopelessness in the transmission system or distribution system resulting from the interruption of the supply of electricity outside that system, the transmission system or the distribution system of another operator.
(7) The forced interruption of the supply of electricity to customers is the interruption of the supply of electricity for the reasons set out in Section 24 (3) (c) (1) to (5), (8) and (9), (d) (25) (4) (1) to (5), (8) and (9) of the Law.
(8) The planned interruption of the supply of electricity to customers is the interruption of the supply of electricity resulting from the planned operating and maintenance work of the transmission system or distribution system, including customer demand facilities connected to it within the meaning of § 24 (3) (c) (6) and § 5, § 25 (4) (d) (6) and § 6 of the Act.
(9) The statement of interruption of the supply of electricity and the frequency of such interruptions for the relevant year shall be transmitted by the transmission system operator or distribution system operator to the Authority on 30 April of the following year on a form, a model of which appears in Annex 1. The report shall be transmitted to the Authority on 30 April of the following year by the transmission system operator on a form the model of which is set out in Annex 3 or by the distribution system operator on a form the model of which is set out in Annex 2.
Publication of achieved standards
The level of compliance with all standards by each distribution system operator and transmission system operator in the relevant year shall be published in the Energy Regulatory Bulletin by 30 June of the following year. The level of compliance with these standards will be taken into account when adjusting regulated prices.
Efficacy
This decree shall take effect on the day of its publication.
