DECLARATION
of 2 November 2015
amending Decree No. 447 / 2001 Coll., on the Mining Rescue Service, as amended
Pursuant to § 6 (6) (a) and § 7 (9) of Act No. 61 / 1988 Coll., on Mining Activities, Explosives and on State Mining Administration, as amended by Act No. 542 / 1991 Coll.:
Čl. I
Decree No. 447 / 2001 Coll., on the Mining Rescue Service, as amended by Decree No. 87 / 2006 Coll. and Decree No. 379 / 2012 Coll., is amended as follows:
1. in Article 6 (1) (b), including footnote 6:
"(b) ensure that first aid is provided in the underground, on the smooth mines of Class II danger professional first aid (6).
6) Act No. 372 / 2011 Coll., on Health Services and Conditions of Provision (Health Services Act), as amended. '.
2. In Section 10 (2), the words "resuscitation ambulance vehicle and 'are deleted.
3. Paragraph 12 (4) reads as follows:
"(4) At least 3 replacement CO2 absorbers (hereinafter referred to as the" absorber ') and 3 refilled cylinders shall be provided for each oxygen breathing apparatus. It is necessary to have 3 spare filled cylinders ready for each air breathing apparatus. Oxygen may be used to fill the cylinders for oxygen breathing devices for breathing or breathing mixtures as specified by the manufacturer of the breathing apparatus and for air breathing appliances for hygienic air or other hygienic physiological breathing mixtures. Only the breathing mixture specified by the manufacturer may be used to fill the cylinders for life-saving devices.'
4. Paragraph 15 (d), including footnote 21, reads as follows:
"(d) medical practitioners qualified in the field of mining and medical rescue (21) qualified in the field of mining (hereinafter referred to as" doctors and medical paramedics "),
21) Act No 95 / 2004 Coll., on the conditions for obtaining and recognising professional competence and specialised competence for the exercise of the medical profession of doctor, dental practitioner and pharmacist, as amended. Act No. 96 / 2004 Coll., on the conditions for obtaining and recognising eligibility for the pursuit of non-medical medical professions and for carrying out activities related to the provision of medical care and amending certain related laws (Act on non-medical medical professions), as amended. '
5. In Paragraph 16 (2), "5% 'is replaced by" 4%'.
6. Paragraph 18 (2), including footnote 12, reads as follows:
"(2) The medical fitness is assessed and the medical assessment is issued by the provider of occupational medical services (12) with whom the employer has a written contract.

footnote 13 is deleted.
7. Paragraph 18 (4), including footnote 14, reads as follows:
"(4) A mining rescue worker cannot perform the tasks of the mining rescue service if:
(a) are not subject to periodic medical examinations at least once a year under the legislation governing medical fitness assessment14);
(b) not undergo an emergency medical examination where there is reasonable grounds for suspecting that a change in his state of health has taken place in the course of his or her medical fitness; or
(c) a medical opinion has been issued on the basis of the inspection carried out, with the conclusion that it is not fit to carry out the activity of a mining rescue worker.
14) Act No. 373 / 2011 Coll., as amended. Decree No. 79 / 2013 Coll., on the implementation of certain provisions of Act No. 373 / 2011 Coll., on specific health services (Decree on occupational medical services and certain types of assessment). '
8. Paragraph 18 (5) reads:
"(5) The mining paramedic shall maintain his professional competence by receiving training and practical training in the range of 1 shift at least once a quarter. This training includes the use of a breathing apparatus in a pipe and training for the use of a respirator; mining rescue workers working on a coal mine will also attend the heat chamber as part of this training. Once a calendar year, this training may be replaced by participation in respiratory interventions. The place of practical training and its conditions shall be governed by the training rules of the main mining rescue station (§ 30). '
9. Paragraph 18 (6) and (7) are deleted.
Paragraph 8 shall become paragraph 6.
10. Paragraph 20 (1), including footnote 15, reads as follows:
"(1) The main mechanic of the main mining rescue station and its representative may be a mining paramedic who has a university education obtained by successful completion of at least a Bachelor's study programme in the field of engineering and, where applicable, electrical engineering sciences, with at least four years of professional experience, of which at least two years of rescue practice; in the case of a staff member with a secondary education with a graduate examination (15) in the field of mining or other technical field, the requirement of professional and rescue practice is doubled.
15) Act No. 561 / 2004 Coll., on pre-school, primary, secondary, higher vocational and other education (Education Act), as amended. '
11. in Paragraph 21 (1), including footnote 10,
"(1) The head of a mining mining rescue station and its representative may be only a mining rescue worker who has the professional qualifications obtained by graduating from secondary education with a graduate examination in the field of mining or other technical field, professional experience in mining or mining activities for 6 years, of which at least two years of experience in the mining rescue corps, and successfully passed the mining rescue test before the commission of the district mining authority (10); in the case of higher education in the field in question, the requirement for professional practice is halved. The verification of competence shall be carried out in accordance with a specific legislative act (3a).
10) Paragraph 41 (1) (d) of Act No. 61 / 1988 Coll., on Mining Activities, Explosives and State Mining Administration, as amended. '
12. in Article 27 (c):
"(c) to ensure the provision of first aid in the underground, on the fluent mines of the 2nd class danger of professional first aid; and ';
13. in Paragraph 31 (5):
"(5) Commander of the Mining Rescue Corps
(a) calling and designating platoons and, where appropriate, individual mining rescue workers for the performance of tasks;
(b) determine the deployment of bases and their commanders;
(c) ensure compliance with the orders of the accident manager;
(d) decide on the type of breathing apparatus to be used in the intervention and its adaptation in terms of its duration;
(e) decide on the presence of a mechanic and a doctor or medical examiner at the base and determine their tasks;
(f) decide to set up rescue patrols; One-man patrol may only be located where there is a direct link with the base commander or the commander of the Mining Rescue Corps. ';
14. Paragraph 32 (5) is deleted.
Paragraphs 6 and 7 shall become paragraphs 5 and 6.
15. In Paragraph 34 (3), the second sentence is replaced by the following: "After carrying out the rescue check, the sergeant shall carry out a chauffeur's inspection of the breathing apparatus for all members of the platoon (" the chauffeur's inspection ")."
16. in Paragraph 34 (6):
"(6) The Sergeant may order the platoon to return to the base; it shall so decide whenever there has been a failure of the breathing apparatus, injury or manifestations of health problems in any mining rescue crew or where the supply of oxygen, air or breathing mixture in the cylinder of any breathing apparatus has fallen so far that it would not allow a safe return to the base. ';
17. Article 36 shall be deleted, including the title and footnote 17.
18. in Paragraph 37 (4), the third sentence is deleted;
19. In Paragraph 39 (6), the words "or, where appropriate, by a nibble, where the use of a nib is permitted 'are deleted.
20. In Paragraph 39 (12), the words "set out in Annex No 1 to this Order; other equipment of the platoon 'are deleted.
21. in Paragraph 43 (a), the part of the second sentence after the semicolon, including the semicolon, shall be deleted;
22. in Paragraph 43 (b), the sentences of the second and third shall be deleted;

„§ 44
Intervention under difficult microclimatic conditions
The period of intervention of mining rescue workers under difficult microclimate conditions shall be governed by the Staff Regulations of the Main Mining Rescue Station. '
24. in Paragraph 46 (4):
"(4) The decompression times at stops and the total period of stay below the surface during the intervention shall be governed by the Staff Regulations of the Main Mining Rescue Station. '
25. in Article 49 (1) (e), the words "and the estuary" shall be deleted;
26. in Paragraph 49 (1), point (h) is deleted;
Points (i) to (n) shall be renumbered as points (h) to (m).
27. Paragraph 49 (4), including footnote 20, reads as follows:
"(4) The Mining Rescue Station shall keep the documents and records (20) referred to in paragraph 1 (a) for 10 years after the end of the activity of the Mining Rescue Officer in the Mining Rescue Corps, in paragraph 1 (b) to (l) for a year after the expiry of the document and in paragraph 1 (m) for 10 years after the end of the year in which the activity was carried out.
20) Act No. 499 / 2004 Coll., on archiving and file services and on amending certain laws, as amended. '
28. Annexes 1 to 3 are deleted.

This Decree was notified in accordance with Directive (EU) 2015 / 1535 of the European Parliament and of the Council of 9 September 2015 laying down a procedure for the provision of information in the field of technical and information society services.
Čl. III
Efficacy
This Decree shall enter into force on 1 December 2015.
