DECLARATION
of 7 September 2012
amending Decree No. 323 / 2004 Coll., implementing certain provisions of the Vineyard and Wine Act, as amended
The Ministry of Agriculture provides, pursuant to Article 42 of Act No. 321 / 2004 Coll., on Vinohradship and Wine and on the amendment of certain related laws (Vinohradship and Wine Act), as amended by Act No. 179 / 2005 Coll., Act No. 411 / 2005 Coll., Act No. 215 / 2006 Coll. and Act No. 256 / 2011 Coll., to implement § 4 (4) (d), § 6 (4), § 11 (3), § 12 (7), § 16 (9), § 17a (2), § 23 (14), § 26 (12), § 26a, § 28 (8), § 30 (6) and § 37 (10):
Decree No. 323 / 2004 Coll., implementing certain provisions of the Vineyard and Wine Act, as amended by Decree No. 437 / 2005 Coll. and Decree No. 28 / 2010 Coll., is amended as follows:
1. paragraphs 2, 3, 6 and 8 shall be deleted, including the headings and footnotes 1e and 1f;
2. Paragraph 4a (1), including footnote 1b, is deleted.
Paragraphs 2 and 3 shall be renumbered paragraphs 1 and 2.
3. In the reference under Section 7, the words "(a) 'are deleted.
4. In Article 7 (1), the words "in the manufacture of products' are deleted.
5. In the reference under Section 9, "10 'is replaced by" 9' and "(b) 'is deleted.
6. in Article 9 (2) (b):
"(b)" claret, "" clairet "or" claret "in the case of white wine produced from blue grapes without fermentation," '
7. In Paragraph 9 (2), the comma at the end of point (h) is replaced by a dot and point (i) is deleted.
8. In Article 10, the words "paragraph 6 'are deleted.
9. in Article 10 (2), the words "Annex No 1 'are replaced by the words" Section 1 (1)';
10. In the reference under Section 11, "15 'is replaced by" 14'.
11. Paragraph 11 (1) is deleted and paragraph 2 is deleted.
12. in Article 12 (1) and (2):
"(1) Sampling of wine pursuant to Article 26 (4) of the Act shall be carried out by:
(a) partial sample And for laboratory analysis - one bottle of a minimum of 1 litre, for wine already bottled enough bottles to have a total volume of at least 1 litre,
(b) subsample B for the sensory evaluation of wine - one bottle of a minimum volume of 0,5 litres, for wine already bottled enough bottles to have a total volume of at least 0,5 litres;
(c) sub-sample C for storage as a reference sample at the State Agricultural and Food Inspection (hereinafter referred to as "Inspection") for any examination of the results of laboratory analyses, or for verification of the identity of the classified batch of wine, or as a back-up sample for sensory evaluation of the wine in case the B sub-sample does not comply with the cork - one bottle of a minimum volume of 1 litre, for wine already bottled so that its total volume is at least 1 litre.
(2) The sub-samples submitted for wine A, B and C shall be taken in such a way that they are representative of the whole lot of wine to be classified. '
13. In the reference under section 13, "6 'is replaced by" 8' and "and Article 29 (5) 'is deleted.
14. Paragraph 13 (2) to (6), including footnote 2b, is deleted and the designation of paragraph 1 is deleted.
15. in Article 13, the words "provided for in paragraphs 2 to 5" are replaced by the words "published by the Ministry on its website."
16. The reference under Section 14 reads:
"[Articles 6 (4), 11 (3) (c) and 30 (6) of the Act] '.
17. in Article 14 (5) (b), the words "producer" shall be replaced by the words "person referred to in Article 30 (1) of the Act" and the words "producer for 5 years" shall be deleted;
18. In Article 14 (10), the words "producer 'are replaced by the words" person referred to in Article 30 (1) of the Act'.
19. in Paragraph 14 (12), the words "second and" shall be deleted and the words "or 33" shall be inserted after the words "Annex No 33a";
20. Paragraph 15, including the title, reads:
Flat-rate amounts for wine certification costs
(Articles 17a (2) and 26a of the Law)
The amount of the flat-rate amount of the costs of certification of wine without a protected designation of origin, a protected geographical indication or a traditional term with the name of the variety or the designation of the year shall be CZK 500 per inspector per hour of activity. The appropriate amount of the flat-rate amount of the costs shall be determined for each start-up hour of the activity of one inspector in verifying compliance with the specifications of the protected designation of origin or protected geographical indication. ';
21. After Paragraph 15, the following Section 15a is inserted:
Wine certification procedure
(Paragraph 37 (10))
Certification of wine shall be carried out in particular by checking the records and documents proving the origin of the wine. ';

This decree shall take effect on the day of its publication.
