DECLARATION
of 21 November 2007
amending Decree No. 101 / 1995 of the Ministry of Transport Coll., published by the Order on the Health and Proficiency of Persons in the Operation of Railways and Railway Transport, as amended
The Ministry of Transport provides pursuant to § 66 (1) of Act No. 266 / 1994 Coll., on Railways, as amended by Act No. 23 / 2000 Coll., Act No. 77 / 2002 Coll., Act No. 103 / 2004 Coll., Act No. 181 / 2006 Coll. and Act No. 191 / 2006 Coll., for implementation of § 45 (3) of the Act:
Decree No. 101 / 1995 Coll., published by the Order on the Health and Proficiency of Persons in the Operation of Railways and Rail Transport, as amended by Decree No. 455 / 2000 Coll. and Decree No. 194 / 2005 Coll., is amended as follows:
1. In Article 8, the following paragraph 4 is added:
"(4) To drive a driving vehicle in the event of a shift 9a) on a national, regional and tug track on the territory of the Czech Republic, except for the shift of railway vehicles occupied by passengers, persons who have reached the age of 19 can.
9a) § 1 (n) of the Decree of the Ministry of Transport No. 173 / 1995 Coll., which is issued by the Railway Regulations. '.
2.Paragraph 9, including footnotes 10, 11, 11a, 12 and 13, reads as follows:
(1) The conditions of education and professional competence of persons to drive an electric motor vehicle on the national, regional and tug track are:
(a) completed secondary education with a graduate examination (10);
(b) professional competence in electrical engineering with a qualified person trained;
(c) the completion of the teaching of professional theoretical knowledge according to the content of the test referred to in Annex 4, Part A;
(d) professional experience in the repair and maintenance of electric power vehicles, training in the repair plant of electric power vehicles aimed at the knowledge of the design and maintenance of the vehicle and training to carry out a technical inspection of towed traction vehicles of a duration of at least 10 weeks;
(e) driving training in the control and operation of an electric driving vehicle under supervision of at least 24 weeks;
(f) a test of professional theoretical and practical knowledge before the Examination Committee.
(2) The conditions of education and professional competence of persons to drive an electric motor vehicle when moving on a national, regional and tug track, except for the shift of train vehicles occupied by passengers are:
(a) completed secondary education with teaching listes11) mechanical, electrical or transport orientation;
(b) professional competence in electrical engineering with a qualified person trained;
(c) the completion of the teaching of professional theoretical knowledge according to the content of the test referred to in Annex 4, Part A; the content of the test in item 1. of the Annex focuses only on the shift;
(d) professional experience in the repair and maintenance of electric power vehicles, training in the repair of electric power vehicles aimed at the knowledge of the construction and maintenance of the vehicle and training for the conduct of technical inspections of towed electric vehicles of a duration of at least 10 weeks;
(e) driving training in the control and operation of an electric driving vehicle under supervision of at least 12 weeks;
(f) a test of professional theoretical and practical knowledge before the Examination Committee.
(3) The conditions of education and professional competence of persons to drive an electric motor vehicle on a tractor only are:
(a) completed secondary education with teaching listes11) mechanical, electrical, construction or transport specialisation or completed secondary education with graduate examinations 10);
(b) professional competence in electrical engineering with a qualified person trained;
(c) the completion of the teaching of professional theoretical knowledge according to the content of the test referred to in Annex 4, Part A; the content of the test in item 1 of Annex is limited to the operation of the tractor;
(d) training in the repair plant of electric traction vehicles aimed at knowledge of vehicle design and maintenance of at least 3 weeks;
(e) driving training in the control and operation of an electric driving vehicle under supervision of at least 4 weeks;
(f) a test of professional theoretical and practical knowledge before the Examination Committee.
(4) The conditions of education and professional competence of persons to drive a motor vehicle on the national, regional and tug track are:
(a) completed secondary education with a graduate examination (10);
(b) professional competence in electrical engineering with a qualified person trained;
(c) the completion of the teaching of professional theoretical knowledge according to the content of the test referred to in Annex 4, Part B;
(d) professional experience in the repair and maintenance of motor propulsion vehicles, training in the repair plant of motor propulsion vehicles aimed at the knowledge of the design and maintenance of the vehicle and training to carry out a technical inspection of towed train vehicles of a duration of at least 10 weeks;
(e) driving training in the steering and operation of a motor propulsion vehicle under supervision of at least 24 weeks;
(f) a test of professional theoretical and practical knowledge before the Examination Committee.
(5) The conditions of education and professional competence of persons to drive a motor vehicle when moving on a national, regional and tug track, except for the shift of train vehicles occupied by passengers, are:
(a) completed secondary education with teaching listes11) mechanical, electrical or transport orientation;
(b) professional competence in electrical engineering with a qualified person trained;
(c) the completion of the teaching of professional theoretical knowledge according to the content of the test referred to in Annex 4, Part B; the content of the test in item 1 of the Annex focuses only on the shift;
(d) professional experience in the repair and maintenance of motor propulsion vehicles, training in motor propulsion vehicle repair plant aimed at the knowledge of the design and maintenance of the vehicle and training to carry out technical inspections of towed train vehicles of a duration of at least 10 weeks;
(e) driving training in the steering and operation of a power-driven vehicle under supervision of at least 12 weeks;
(f) a test of professional theoretical and practical knowledge before the Examination Committee.
(6) The conditions of education and professional competence of persons to drive a motor-powered motor vehicle are only on a tractor;
(a) completed secondary education with teaching listes11) mechanical, electrical, construction or transport specialisation or completed secondary education with graduate examinations 10);
(b) professional competence in electrical engineering with a qualified person trained;
(c) the completion of the teaching of professional theoretical knowledge according to the content of the test referred to in Annex 4, Part B; the content of the test in item 1 of the Annex is limited to the operation of the tractor;
(d) training at a motor propulsion vehicle repair plant aimed at knowledge of vehicle design and maintenance for a duration of at least 3 weeks;
(e) driving training in the steering and operation of a motor propulsion vehicle under supervision of at least 4 weeks;
(f) a test of professional theoretical and practical knowledge before the Examination Committee.
(7) The conditions of education and professional competence of persons to drive a steam vehicle on the national, regional and tug track are:
(a) competence to drive an electric or motor driving vehicle on a national, regional and tug track, driving as a train 11a);
(b) the completion of teaching of professional theoretical knowledge according to the content of the test referred to in Annex 4, Part C;
(c) evidence of knowledge of the operator of the locomotive chop 12),
(d) driving training in the control and operation of a steam vehicle under supervision of at least 160 hours;
(e) the test provided for in Section 16 (3) (a) of this Decree.
(8) The conditions of education and professional competence of persons to drive a special driving vehicle on a national, regional and tugboat track are:
(a) completed secondary education with teaching listes11) mechanical, electrical, construction or transport specialisation or completed secondary education with graduate examinations 10);
(b) professional competence in electrical engineering with a qualified person trained;
(c) the completion of teaching of professional theoretical knowledge according to the content of the test referred to in Annex 4, Part D;
(d) operator training of a special part of the propulsion vehicle, maintenance and repair of at least 4 weeks;
(e) driving training in the control and operation of a special propulsion vehicle under supervision of at least 60 hours;
(f) a test of professional theoretical and practical knowledge before the Examination Committee.
(9) The conditions of education and professional competence of persons to drive a special driveline are
(a) basic education13),
(b) professional competence in electrical engineering with a qualified person trained;
(c) the completion of the teaching of professional theoretical knowledge according to the content of the test referred to in Annex 4, Part D; the content of the test in item 1 of the Annex is limited to the operation of the tractor;
(d) operator training of a special part of the propulsion vehicle, maintenance and repair of at least 4 weeks;
(e) driving training in the control and operation of a special driving vehicle under supervision of at least 40 hours;
(f) a test of professional theoretical and practical knowledge before the Examination Committee.
(10) The conditions of competence of persons to drive on a national, regional and railway track, driving as a train 11a) if the applicant holds a driving licence when moving on a national, regional and tuber track, are:
(a) practice in driving a driving vehicle for at least three years and driving training in driving and operating the relevant type of driving vehicle when driving a train under supervision for a period of at least 8 weeks, carried out immediately before the test is carried out, or driving training in driving and operating the relevant type of driving vehicle when driving a train under supervision for a period of at least 3 years;
(b) the completion of teaching of professional theoretical knowledge according to the content of the test referred to in Annex 4, Part A or Part B, items 1 and 2, according to the type of driving vehicle concerned;
(c) a test of professional theoretical and practical knowledge before the test committee, aimed at knowledge of the rules governing the operation of the runway and the operation of the runway, the conditions for the construction of the runway and the operability of the runway, as set out in Annex 4, Part A or B and the type of propulsion vehicle concerned.

3. In Article 15 (1) (b), the following point 2 is inserted after point 1:
"2. the national, regional and tug track in the Czech Republic; only for driving the driving vehicle when moving, except for displacement with the traction vehicles occupied by passengers (C-P), ';
Points 2 to 7 shall be renumbered 3 to 8.
4. in Article 16a (2) (e), the words "four weeks" are replaced by the words "160 hours, of which 48 at night period 15a)."

5. In Article 18 (2) (b), "and the difference test referred to in Article 16a 'is replaced by" and the test referred to in Article 9 (7) and (10) or Article 16a'.
This Decree shall take effect on 1 January 2008.
