laying down the types of contaminants and toxicologically relevant substances and their permitted levels in foodstuffs
According to Article 19 (1) (a) of Act No. 110 / 1997 Coll., on Food and Tobacco Products, and amending and supplementing certain related laws, as amended by Act No. 306 / 2000 Coll. and Act No. 146 / 2002 Coll., hereinafter referred to as "the Act":
§ 1
This decree, in accordance with the law of the European Communities (1), establishes the permitted quantities and types of contaminants, toxicologically relevant substances and substances resulting from the activities of micro-organisms which may contain food and raw materials. The maximum permitted levels of radioactive contamination of foodstuffs are laid down in specific legislation.2)
§ 2
(1) For the evaluation of the occurrence of individual contaminants in food:
(a) the maximum quantity permitted (hereinafter referred to as "NPM") exceeding which the food and food material are excluded from circulation is set out in the Annex; or
(b) the authorised quantity (hereinafter referred to as "PM"), the conditions for the assessment of foodstuffs according to this limit value shall be determined by the limit value set out in the Annex for the contaminants histamine.
(2) Contaminants, (3) toxicologically relevant substances and substances resulting from the activity of micro-organisms, the limits and other conditions of their occurrence in foodstuffs are set out in the Annex.
(3) The quantity of undesirable additives and contaminants whose content in the pure substance (in food supplement and additive) is limited by a specific legislation, 4) is reduced in diluted forms according to the degree of dilution.
(4) The established limit values for each contaminants apply to the edible portion of the food. Edible holding means food disposed of from non-edible parts (e.g. skin, stone, bone). Dried and dehydrated products shall be evaluated if they are renewed with the addition of water, in a state after recovery. Concentrated products shall be evaluated according to the limit for the original raw materials and converted into a coefficient characterising the relevant water loss, unless the limit is determined directly for the concentrated or dried product.
(5) Where, in the case of foodstuffs intended for infant formulae, "milk-based '," cereals-based' and other foods, it is understood that the product contains more than 50 per cent of those raw materials. Where it is stated: "containing... ', the proportion is less than 50 per cent.
(6) The amount of nitrates is determined as the nitrate ion NO3-.
§ 3
Transitional provision
Foodstuffs which have been produced and put into circulation before the date of application of this Order shall be assessed in accordance with existing legislation.
§ 4
Efficacy
This Decree shall take effect on 20 May 2004.
