of 18 November 1999
on the prohibition of the use, storage, production and transfer of anti-personnel mines and their destruction and amending Act No. 140 / 1961 Coll., Criminal Act, as amended
Parliament has decided on this law of the Czech Republic:
PROHIBITION OF USE, STORAGE, PRODUCTION AND TRANSFER OF AGRICULTURAL MINES AND THEIR DEROGATIONS
(1) It is prohibited to own, hold and use all types of anti-personnel mines referred to in the Convention on the Prohibition of the Use, Storage, Production and Transfer of Anti-personnel Mines and on Their Destruction ("anti-personnel mines") or parts thereof, unless otherwise provided for in this Law.
(2) The development, manufacture, transfer, storage or collection of stocks of anti-personnel mines or their components shall be prohibited.
(3) It shall be prohibited to use and transfer patent rights for the production of anti-personnel mines or their components and patent rights for manufacturing processes intended for the production of anti-personnel mines or their components.
(1) Anyone holding anti-personnel mines or parts of them is required to report their number to the Ministry of Defence (hereinafter referred to as "the Ministry") within 180 days of the date of entry into force of this Act and to transmit them to the Ministry within 60 days of notification.
(2) Patent owners for the production of anti-personnel mines or parts thereof and patent holders for production processes intended for the production of anti-personnel mines or parts thereof are required to report this fact to the Ministry within 90 days of the entry into force of this Act.
(1) Within four years of the date of application of this Act, the Ministry will ensure the destruction of the collected stocks of all anti-personnel mines.
(2) The Ministry may hold or transfer a minimum of anti-personnel mines absolutely necessary for the development and teaching of mine detection, mine clearance or destruction techniques.
(1) Anyone holding anti-personnel mines or parts thereof shall be subject to compliance with this law. The Ministry is conducting surveillance.
(2) Members of the international investigating mission may participate in the oversight exercise, in accordance with their mandate under the Convention on the Prohibition of the Use, Storage, Production and Transfer of Anti-personnel Mines and on their Destruction.
(3) Anyone holding anti-personnel mines or parts of them is obliged to allow control officers and members of the international investigation mission access to the required site of surveillance.
EFFICIENCY OF THE LAW
This Act shall take effect on the date of its publication, except for Part Two, which shall take effect 240 days after the date of entry into force of this Act.
