On 7 September 2010, the Constitutional Court decided on the plenary of the President of the Court of Paul Rychett and the Judges Stanislav Balík, František Duchona, Vlasta Formankova, Mran Güttler, Ivana Jana, Vladimir Krorka, Dagmar Lastovecká, Jiří Mucha, Jan Musil, Jiří Nykodým, Miloslav Excellent, Eliška Wagner and Michaela Židlická on the proposal of the Ministry of the Interior to abolish part of Section 2 (2) and Section 2 (3) of the Ordinary Decree of the City of Jesenik 1 / 2008 on the prohibition of the consumption of alcoholic beverages in public space, with the participation of the City of Jeseník and the Ombudsman as an intervener
as follows:
The application for annulment of the provisions of Section 2 (2) of the Ordinary Order of the City of Jeseník No 1 / 2008 in the words "or to stay in a public place with an open bottle or other container with an alcoholic drink 'and Section 2 (3) of the same legislation in the words" or the supply of an open bottle or other container with an alcoholic drink' is rejected.
